MINUTES OF THE REGULAR MEETING OF THE AVON LAKE MUNICIPAL COUNCIL DECEMBER 8, 2025 The regular meeting of the Avon Lake City Council was called to order on December 8, 2025, at 7 p.m. in the Council Chamber with Council President Fenderbosch presiding. Ms. Gentry led Council, staff, and the public in the Pledge of Allegiance. Present: Councilmembers Zach Arnold, Jennifer Fenderbosch, Amy Gentry, David Kos, Rob Shahmir, Geoff Smith, and K. C. Zuber; Mayor Mark Spaetzel; Law Director Gary Ebert; Finance Director Beth Krosse; Public Works Director Jon Liskovec; and Clerk of Council Valerie Rosmarin. APPROVAL OF MINUTES The minutes of the regular Council Meeting held on November 24, 2025, were approved as prepared and published. PROCLAMATION Mayor Spaetzel presented Pamela Ohradzansky, Director of Community Resource Services (CRS), with a proclamation in recognition of her dedicated service to CRS and the community it serves for the past 15 years. RESOLUTION OF GRATITUDE Resolution No. 25-207, A RESOLUTION OF GRATITUDE AND APPRECIATION FOR ROBERT HAAS, was read in its entirety. Mr. Smith moved for suspension of the rule requiring three readings. Yes: Gentry, Kos, Shahmir, Smith, Zuber, Arnold, Fenderbosch No: None Motion passed. Mr. Smith moved for passage of Resolution No. 25-207. This legislation will be adopted to memorialize the exemplary volunteer service of Robert Haas, who served on the Environmental Affairs Advisory Board for two two-year terms and Planning Commission for two five-year terms. December 8, 2025, Council Meeting 2 PUBLIC INPUT 1. Len Lieber, American Legion Post 211, thanked Council for its support of the American Legion Post 211 over the past year and described the Post’s annual Pearl Harbor Day salute at Learwood Middle School. He announced that the Post’s New Year’s Eve event will feature the band Guitars for Vets, which provides free guitar instruction and instruments to disabled veterans, and he noted that part of the event’s $45 ticket price supports the program. The public event will include appetizers at 5:30 p.m., dinner at 6:00 p.m., live music from 7–10:00 p.m., and a television broadcast of the Ohio State Cotton Bowl game. Tickets are available daily at the Post’s canteen. Mr. Lieber concluded by sharing his intention to move to Avon Lake next year and expressed appreciation for the community. 2. William Zimmerman, Avon Lake, voiced his opposition to Ordinance No. 25-102, which will allocate an additional $25,000 to Attorney Todd Davis. He also expressed concern about the City’s financial condition, rising employee salaries, and what he views as ineffective leadership. He opposed the possibility of a future tax levy and urged Council to reduce spending, bring in new leadership where needed, and focus on fiscal responsibility. MAYOR’S REPORT Mayor Spaetzel reported that Avon Lake Play Space (ALPS) Phase 2 is nearly complete, with only a few minor items remaining this week. ALPS is now open for public use, though a formal opening ceremony will be postponed until spring due to the weather. Residents are encouraged to enjoy the new amenities, including the four-season sledding hill and the lake overlook. COUNCIL PRESIDENT’S REPORT Council President Fenderbosch reported on the following: 1. The next Collective Committee Meeting is Monday, December 15, 2025, at 7 p.m. in the Council Chamber, followed by a Council Meeting. PUBLIC WORKS DIRECTOR’S REPORT Public Works Director Liskovec reported on the following: 1. Leaf Pickup Staff from the Public Works Department are actively collecting leaf piles, despite the winter weather. 2. Yard Waste Kimble Recycling & Disposal will stop collecting yard waste for this season on December 31, 2025.

December 8, 2025, Council Meeting 3 COMMUNICATIONS, ENVIRONMENTAL, AND RECREATIONAL PROGRAMMING COMMITTEE REPORT Mr. Shahmir reported on the Communications, Environmental, and Recreational Programming Committee as follows: 1. The next Communications and Technology Commission meeting is Thursday, December 11, 2025, at 6 p.m. at the Avon Lake Public Library. FINANCE COMMITTEE REPORT Mr. Zuber reported on the Finance Committee as follows: 1. The Committee met on December 1, 2025.  The agenda included the Neighborhood Alliance contract, non-bargaining employee wage increases, Impact Group contract, Bramhall contract, short-term rental registration fee, 2026 budget, year-end appropriations, and income tax capital revenue increase. 2. The income tax collection as of December 1, 2025, is $18.7 million, or $780,000, which is 4.2% higher than last year at this time. 3. Suspension of the rule requiring three readings on an emergency basis will be requested for Ordinance No. 25-200, authorizing the Neighborhood Alliance contract. HUMAN RESOURCES COMMITTEE REPORT Mr. Smith reported on the Human Resources Committee as follows: 1. Suspension of the rule requiring three readings on an emergency basis will be requested for Ordinance No. 25-202, approving wage increases in Avon Lake Municipal Court, and Ordinance No. 25-204, approving the Collective Bargaining Agreement with Avon Lake Regional Water (ALRW) personnel. PUBLIC SAFETY AND HEALTH COMMITTEE REPORT Mr. Kos reported on the Public Safety and Health Committee as follows: 1. The next Committee meeting will be announced at the Council Meeting on December 15, 2025. 2. Suspension of the rule requiring three readings on an emergency basis will be requested for Resolution No. 25-205, supporting the Blue Envelope Program.

December 8, 2025, Council Meeting 4 PUBLIC SERVICE COMMITTEE REPORT Council President Fenderbosch reported on the Public Service Committee as follows: 1. The Committee met earlier tonight.  The agenda included a discussion on the Ohio Department of Transportation (ODOT) award of $311,626 for the Lake Road East Sidewalk project; advertisements of bids for concrete, asphalt, and aggregate contracts and the Miller Road Park Sand Dredging Project; Tree Inventory and Management Plan; and HZW landfill contract. 2. Suspension of the rule requiring three readings on an emergency basis will be requested for Ordinance No. 25-195, repealing Codified Ordinance Section 1065.11: Green Team certification; Ordinance No. 25-196, amending Codified Ordinance Chapter 272: Avon Lake Historical Preservation Commission; and Ordinance No. 25-197, amending Codified Ordinance Chapter 288: Tree Commission. PLANNING COMMISSION REPORT Mr. Smith reported on Planning Commission as follows: 1. Planning Commission met on December 2, 2025.  A site plan was approved for the administrative building expansion for ALRW at 201 Miller Road.  A site plan was approved for a warehouse addition for Woodside Holdings, LLC, at 32950 Pin Oak Parkway.  A preliminary plat was postponed for Matthew’s Hollow Subdivision, located northeast of the Lear Road and Krebs Road intersection. ZONING BOARD OF APPEALS REPORT Mayor Spaetzel reported on the Zoning Board of Appeals as follows: 1. The next Board meeting is Wednesday, December 10, 2025, at 7 p.m. at the Council Chamber. TREE COMMISSION REPORT Council President Fenderbosch reported on the Tree Commission as follows: 1. The next Commission meeting is Wednesday, January 14, 2026, at 6 p.m. at the Old Firehouse and Community Center.

December 8, 2025, Council Meeting 5 MOTIONS Council President Fenderbosch moved to accept a donation of $600 from the Avon-on- the-Lake Garden Club to the City of Avon Lake for the purchase of trees to be planted in City-owned parks. Council President Fenderbosch moved to authorize the Public Works Director to advertise for bids for concrete, asphalt, and aggregate to be used by the Public Works Department during the 2026 construction season. Third Readings: Ordinance No. 25-175R2, AN ORDINANCE AMENDING CODIFIED ORDINANCE SECTION 208.01, ENTITLED FEE SCHEDULE, was read by title only. Mr. Zuber moved for passage of Ordinance No. 25-175R2. This legislation will amend the Fee Schedule for Police Department video recordings by establishing a fee of $75 per request, not to exceed $750, and $5 per flash drive for public records requests; increase the pool fees by 12% annually for 2026 and 2027; eliminate the Green Team registration, no longer in use; and add the short-term rental registration fee of $150. December 8, 2025, Council Meeting 6 Council President Fenderbosch moved for passage of Ordinance No. 25-178. This legislation will establish a lodging excise tax pursuant to Ohio Revised Code Sections 5739.08 and 5739.091, which authorize municipalities to levy an excise tax on lodging transactions for stays of 30 days or less. A tax of 3% is imposed on the gross rent paid for lodging furnished to a transient guest within the City, to be collected and remitted by lodging platforms. If any person fails to remit the tax as required, a penalty of 10% shall be imposed, together with interest at a rate of 1% per month until the tax is paid. The tax revenue shall be divided, with 50% dedicated to tourism, recreation, and visitor-related services and the remaining 50% deposited into the General Fund. Ordinance No. 25-184, AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A PURCHASE AGREEMENT WITH THE AVON LAKE CITY SCHOOL DISTRICT FOR THE ACQUISITION OF THE FORMER ERIEVIEW SCHOOL PROPERTY, LOCATED AT 32630 ELECTRIC BOULEVARD, AVON LAKE, OHIO, AND DECLARING AN EMERGENCY, was read by title only. Council President Fenderbosch moved for passage of Ordinance No. 25-184. This legislation will authorize the Mayor to enter into a purchase agreement with the Avon Lake City School District for the acquisition of the former Erieview School property, totaling 9.5 acres, for $500,000, payable in five annual installments of $100,000 beginning July 1, 2027, and continuing each July 1 thereafter until paid in full. Mayor Spaetzel explained that the purchase price for the 42,000-square-foot building will be paid from the Recreation Trust Fund, with no impact on the General Fund. The City has begun its due diligence, including reviewing assessment reports and assigning costs, with Council having received preliminary information. The purchase includes furniture, desks, and other fixtures remaining in the building. Operations will be phased in to ensure a practical and cost-effective transition, with the Recreation Department scheduled to move into the building and begin operations by the first quarter of 2026. In response to Mr. Kos, Mayor Spaetzel explained that the Recreation Trust Fund is financed through fees paid by developers as homes are built, with each dwelling contributing a fee. These funds are specifically restricted to the purchase of parkland for recreational and community purposes, and the funds cannot be used for salaries, General Fund expenses, or any purpose other than acquiring parkland. Council President Fenderbosch further explained that during the planning process, the Recreation Trust Fund is addressed at the time of the final plat. She noted that there is a strict process for the filing of funds from developers.

December 8, 2025, Council Meeting 7 Mr. Kos highlighted the significance of purchasing Erieview School, a 60–70-year-old, structurally sound building located near the center of town. The purchase is an example of how developer fees and planning processes over the years have contributed to community benefits. The acquisition will preserve the building for community use, expand recreational programming, and protect the property from being sold to a charter school or redeveloped for housing. Under State law, if the City did not purchase the building, it could be offered to a charter school. The purchase price equates to approximately $53,000 per acre for the 9.5-acre site, which is considered highly favorable for the City. He emphasized that the transaction safeguards public school interests and allows the school district the right of first refusal if the City later decides to sell the property. This legislation will amend the Environmental Affairs Advisory Board (EAAB)’s structure to ensure staggered terms and consistent code language, following recommendations from the Boards and Commissions Structure Review Ad Hoc Committee. Although the Committee suggested a balanced ratio of Council and Mayoral appointments, this was not included. Established in the 1990s, the EAAB operates independently to provide unbiased recommendations to Council, distinguishing it from other advisory boards. This legislation will approve the 2026 wage increases of 3% for non-bargaining unit personnel. This legislation will support the Blue Envelope Program, introduced by Resident Carla Fitch, which is designed to improve interactions between police and individuals with conditions such as autism, anxiety, PTSD, or dementia. Participants place a blue envelope in their vehicle containing essential documents, such as proof of insurance, that is easily identifiable by police during traffic stops or other interactions. A decal on the vehicle alerts officers to request the envelope at the start of the interaction. Envelopes will be available at the Police Department for residents and their families. The program also

Ordinance No. 25-210, AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A PERSONAL SERVICES AGREEMENT FOR ENVIRONMENTAL CONSULTING SERVICES AND DECLARING AN EMERGENCY, was read by title only. This legislation will authorize the Mayor to execute a personal services agreement with HZW Environmental Consultants, LLC, of Mentor, Ohio, for monitoring services at the closed landfill in an amount not to exceed $64,900. MISCELLANEOUS BUSINESS AND ANNOUNCEMENTS 1. Mr. Kos announced that this is the last week for the public to drop off new, unopened toys for the Lorain County Toys For Tots Program at City Hall, Avon Lake Public Library, or Avon Lake Fire Department. 2. Council President Fenderbosch announced that two scholarships are available for college students in their sophomore, junior, or senior years, as well as for graduate students. The scholarships are offered through the National Garden Club (NGC) and the Garden Clubs of Ohio, with a deadline of February 1, 2026. Mr. Kos moved for adjournment.
