PROJECT OVERVIEW Matthew’s Hollow Subdivision (formerly Cavalry Court Subdivision) is a proposed 13-lot single- family subdivision on approximately 9.35 acres northeast of the Lear Road and Krebs Road intersection. Site Area: 9.35 acres Density: 1.4 dwelling units per acre. Current Zoning: R-1A Single Family Residence District Surrounding Context The subdivision is located in a predominantly residential area. To the west and south, the property fronts Lear Road and Krebs Road, while a tree line and drainage ditch buffer the eastern edge from adjacent homes. The northern boundary abuts privately owned land. The area maintains a consistent low- density single-family character. Comprehensive Land Use Plan: The Future Land Use Map designates the area as Low- Density Residential, intended for single-family neighborhoods at one to three units per acre. Matthew’s Hollow is consistent with this designation and with the established residential character of the surrounding area. Memo TO: Members of the Planning Commission FROM: Kelly La Rosa, AICP, Planning & Zoning Manager DATE: December 30, 2025 SUBJECT: CPC-25-15, Shire Glen Green Management LLC, Major Subdivision Preliminary Plat Approval for Matthew’s Hollow Subdivision, located northeast of the Lear Road and Krebs Road intersection. ______________________________________________________________________ This memo is intended to update the Planning Commission on the current status of the Matthew’s Hollow Subdivision application and to clarify which issues have been resolved and which remain outstanding as the next meeting approaches. At the prior Planning Commission meeting, Mr. Pavicic requested that the case be tabled to allow time for his attorney, Matt Vola of Kohrman Jackson & Krantz, to confer with the Law Director and City staff regarding stormwater basin ownership, long-term maintenance obligations, and related engineering considerations. As of the date of this memo, this discussion has not taken place. This update is being provided with recognition that Planning Commission packets are scheduled to be distributed this week, and the next meeting is approximately one week away. The following summarizes the City Administration’s current understanding of the key issues: 1. Fire Hydrant Requirement The Fire Department has clarified that an additional hydrant was required under an earlier version of the plan that included three homes in the northwest portion of the site. With the current layout showing a single home, the Fire Department has confirmed that an additional hydrant is not required. This issue is considered resolved. 2. Wetlands Clarification The City Engineer has requested a wetland delineation to confirm the conditions described in the letter provided by the applicant’s engineer. While the applicant has indicated that they are complying with jurisdictional governance under U.S. Army Corps of Engineers regulations and believes no additional submittals are required for Planning Commission approval, the City Engineer continues to request confirmation through a delineation to verify existing site conditions. This item remains outstanding. 3. Stormwater Basin Ownership and Configuration The placement and ownership of the stormwater retention basin remain unresolved. City departments have consistently indicated that locating the basin within a dedicated HOA- owned block would be preferable for long-term maintenance, access, and enforcement

2 purposes. The applicant continues to propose the basin within an easement on a private lot. This issue is central to the application and remains under discussion pending further legal and engineering coordination. Please reference sheet 6 in the attached preliminary plat that describes the applicant’s proposed stormwater management inspection and maintenance agreement. City staff will continue to coordinate internally and with the applicant as information becomes available and will provide additional updates to the Planning Commission as appropriate. At this time, key issues remain unresolved as the case approaches the next scheduled Planning Commission meeting. Please do not hesitate to contact staff if you have any questions or require further clarification.

Memo TO: Members of the Planning Commission FROM: Kelly La Rosa, AICP, Planning & Zoning Manager DATE: January 29, 2026 SUBJECT: CPC-25-15, Shire Glen Green Management LLC, Major Subdivision Preliminary Plat Approval for Matthew’s Hollow Subdivision, located northeast of the Lear Road and Krebs Road intersection. ______________________________________________________________________ Since the Planning Commission’s last consideration of the Matthew’s Hollow Subdivision on January 6, 2026, staff and the City Engineer have continued correspondence with the applicant and their consultant regarding outstanding engineering review items. This correspondence is reflected in the email exchange attached for your reference. As clarified by the City Engineer, the remaining issue is not related to regulatory wetland jurisdiction, but rather whether the applicant has adequately addressed engineering review comments in accordance with Section 1214.05 (d), which requires that a preliminary plat demonstrate consistency with applicable engineering, drainage, and infrastructure requirements and that comments from reviewing agencies be sufficiently addressed before Planning Commission action. Specifically, the City Engineer has requested confirmation that the applicant’s consultant has reviewed the Preliminary Grading Plan dated December 29, 2025, and that conclusions regarding wetland impacts are based on that plan. The Engineer has indicated that this confirmation is necessary to complete the technical review of grading and stormwater assumptions underlying the proposed subdivision layout. As of the date of this memo, confirmation has not yet been provided, and engineering review therefore remains incomplete. Based on the information before the Commission this evening, including the outstanding engineering correspondence discussed, the Commission may now consider its options and entertain a motion. The sample motions provided below are for guidance only and do not imply a recommendation or predetermined outcome.

2 Motion 1 – Approval I move to recommend to the City Council that Case No. CPC-25-15, Shire Glen Green Management LLC, Major Subdivision Preliminary Plat for the Matthew’s Hollow Subdivision, be approved, finding that the proposed subdivision complies with applicable zoning and subdivision regulations and serves the public interest. Motion 2 – Approval with Condition I move to recommend to the City Council that Case No. CPC-25-15, Shire Glen Green Management LLC, Major Subdivision Preliminary Plat for the Matthew’s Hollow Subdivision, be approved subject to the condition that the applicant address the outstanding engineering review items and obtain final sign-off from the City Engineer prior to final plat approval. Motion 3 – Table I move to table consideration of Case No. CPC-25-15, Shire Glen Green Management LLC, Major Subdivision Preliminary Plat for the Matthew’s Hollow Subdivision, with the consent of the applicant, to allow additional time for the applicant to address outstanding engineering review items consistent with Section 1214 of the Codified Ordinances. These motions are intended to provide the Planning Commission with clear procedural options based on the current status of the record. Each option reflects the Commission’s discretion to determine whether sufficient information has been provided to support a recommendation to City Council at this time, or whether additional clarification is warranted to complete engineering review prior to further action. The updated plan includes a notation indicating that, due to the presence of potential aquatic resources on Sublots 2 and 3, no grading, filling, or site disturbance beyond what is shown on the plan may occur until applicable state and/or federal protocols are satisfied. The applicant has stated that the roadway, stormwater, and utility improvements depicted on the revised grading plan can be constructed without impacting potential wetland areas, and that any future disturbance outside the limits shown would be subject to additional regulatory review. Staff and the City Engineer view the inclusion of this notation and the intermediate grading plan as a meaningful clarification of the applicant’s intent and a step toward addressing previously raised engineering questions related to grading and stormwater assumptions. However, because this information was submitted after packet distribution and acknowledges the potential presence of aquatic resources on Sublots 2 and 3, staff continues to recommend that any Planning Commission approval be conditioned on receipt of documentation demonstrating compliance with applicable U.S. Army Corps of Engineers and Ohio EPA requirements, or documentation confirming that no such approvals are required, before final plat approval or any additional site disturbance. APPLICABLE REGULATORY AUTHORITY This review is conducted pursuant to the Avon Lake City Tree Ordinance, Chapter 1018, adopted by City Council and administered by the Urban Forester or designee in coordination with the Tree Commission, in accordance with §§1018.01–1018.99. All findings, recommendations, and conditions herein are enforceable under: • §1018.03 Urban Forester – Authority and Enforcement • §1018.09 Protection of Trees Near Construction Work • §1018.04 Planting of Trees, Shrubs, and Hedges; Permit Required • §1018.05 Replacement of Trees • §1018.031 Master Tree Plan • §1018.99 and §1065.99 Enforcement and Penalty ANSI A300 Tree Care Standards are incorporated by reference and are mandatory. II. SITE VEGETATION FINDINGS 1. Eastern Property Area (Sublots 2, 3, 4, 5, 6, 10, 11, 12, and 13) The eastern portion of the site exhibits fallow agricultural field conditions with no trees meeting the definition of a Protected Tree under §1018.02 (≥ 8 inches DBH or ≥ 20 inches aggregate DBH for multi-stem trees). 2. Northern Property Area – Former Vineyard (Sublots 1, 7, 8, and 9) Historical imagery confirms former vineyard use. The area is undergoing natural

Tree Size, Health, and Viability Assessment While some trees are approaching or marginally meet the Protected Tree DBH threshold (≥ 8 inches DBH), the stand is: o Species-limited (ash-dominated), o Structurally compromised by vine entanglement, o Lacking long-term viability due to Emerald Ash Borer susceptibility. o No trees were identified as needing protection Conclusion: The trees do not warrant preservation designation under §1018.02 and §1018.09 based on health, species risk, and development feasibility. 4. Mature Tree Presence No mature or high-value trees were identified that require preservation, protection fencing, or inclusion in a Tree Preservation Plan at the Preliminary Plan stage. III. TREE PRESERVATION & CONSTRUCTION PROTECTION REQUIREMENTS 5. Tree Preservation Plan (TPP) Determination Because no Protected Trees are proposed for preservation, a full Tree Preservation Plan is not required at this stage. However, if field verification during Improvement Plan review identifies trees ≥ 8 inches DBH proposed to remain, a Tree Preservation Plan shall be required pursuant to §1018.02 and §1018.09. 6. Mandatory Protection Standards if Protected Trees Are Identified Any Protected Tree retained on site shall comply with §1018.09, including: o Critical Root Zone (CRZ): Radius = 1.5 feet per 1 inch DBH (§1018.02). o Protective Barrier Placement: Barrier shall be placed at the greater of: ▪ 10 feet, ▪ the dripline, ▪ or circumference of trunk in inches measured at DBH (§1018.09(c)). o Barrier Specifications:

Construction Limitations (Non-Negotiable) Within protected areas: o No equipment parking, material storage, grading, trenching, fueling, or chemical storage (§1018.09(i)–(k)). o All building material, dirt or other debris shall be kept outside the tree lawn to protect the critical root zone of the tree(s) (§1018.09 (d)). o Root cutting > 2 inches diameter prohibited without Urban Forester approval (§1018.09(f)–(h)). o All pruning must be supervised by an ISA Certified Arborist following ANSI A300 (§1018.09(n)). Tree Commission Determination Based on current site conditions and compliance with Chapter 1018, the Preliminary Plan presents no conflicts with tree preservation requirements. Final compliance shall be verified at the Improvement Plan and construction phases. EVALUATING TREE COMMISSIONERS FINDINGS OF FACT AND CONCLUSIONS Tree Protection, Preservation, and Street Tree Compliance Preliminary Plan: Matthew’s Hollow Subdivision Finding 1 — Applicability of Tree Ordinance The Evaluating Tree Commissioners find that the proposed Matthew’s Hollow Subdivision is subject to the requirements of Chapter 1018, City Tree Ordinance, including §§1018.01 through 1018.99, which govern tree protection, preservation, planting, removal, and enforcement on public property and, where applicable, private property impacted by development activity. Conclusion: Chapter 1018 is the controlling authority for review of tree-related impacts associated with the Preliminary Plan. Finding 2 — Existing Vegetation and Protected Tree Threshold

EVALUATING TREE COMMMISSIONERS REVIEW MATTHEW’S HOLLOW SUBDIVISION Preliminary Plan CPC-25-15 02/01/2026 Page 4 of 6 The Evaluating Tree Commissioners find that based on historic aerial photos that the subject property consists primarily of fallow agricultural fields and early successional vegetation resulting from former vineyard use. No trees of sufficient health and viability meeting the definition of Protected Trees under §1018.02 (trees ≥ eight (8) inches DBH or multi-stem trees with an aggregate DBH ≥ twenty (20) inches) have been identified for preservation at the Preliminary Plan stage. Conclusion: The Preliminary Plan does not trigger mandatory tree preservation requirements under Chapter 1018 at this stage of review. Finding 3 — Suitability of Existing Trees for Preservation The Evaluating Tree Commissioners find that existing trees on the site are dominated by early successional Fraxinus species, are structurally compromised by vine entanglement, and exhibit limited long-term viability due to species risk factors. Pursuant to §1018.02, trees less than eight (8) inches DBH may only be granted protected status if determined to be of high value by the Urban Forester, which determination has not been made for this site. Conclusion: The Commission finds no basis under Chapter 1018 to require preservation of existing on-site trees. Finding 4 — Tree Preservation Plan Requirement The Evaluating Tree Commissioners find that §1018.02 and §1018.09 require submission of a Tree Preservation Plan only when protected trees are proposed to be retained or may be impacted by construction activity. Based on current site conditions and the Preliminary Plan layout, no protected trees are proposed for retention. Conclusion: A Tree Preservation Plan is not required at the Preliminary Plan stage; however, such a plan may be required at the Improvement Plan stage if protected trees are identified. Finding 5 — Authority of the Urban Forester The Evaluating Tree Commissioners find that §1018.03 grants the Urban Forester or designee authority to regulate, inspect, condition, and enforce all tree-related activities within public places and tree lawns, including the authority to impose conditions on permits and halt construction activities for noncompliance. Conclusion: All Improvement Plans and construction activities remain subject to review, inspection, and enforcement by the Urban Forester or designee. Finding 6 — Public Street Tree and Public Tree Lawn Regulation The Evaluating Tree Commissioners find that all Public Streets with Public Tree Lawn trees constitute Public Trees under §1018.02 and must conform to the Master Tree Plan pursuant to §1018.031. The ordinance establishes minimum spacing, utility clearance, and

Conclusion: Final Public Street tree sizes, spacing, and locations shall be determined by the Urban Forester or Designee and Tree Commission at the Improvement Plan stage. Tree Species shall not be selected until the City Tree Inventory and City Master Plan is complete. Finding 7 — Replacement and Mitigation Obligations The Evaluating Tree Commissioners find that §1018.05 requires replacement of any public trees removed as part of construction activity, with replacement species designated by the Master Tree Plan unless otherwise specified by ordinance. Conclusion: Any unavoidable removal of public trees require permit approval and full replacement in accordance with Chapter 1018. Finding 8 — Construction Protection Standards The Evaluating Tree Commissioners find that §1018.09 establishes mandatory tree protection, fencing requirements, inspection authority, and enforcement mechanisms. Conclusion: Should protected trees be identified during later phases, all construction activity must comply with §1018.09 without exception. Finding 9 — Enforcement and Penalties The Evaluating Tree Commissioners find that violations of Chapter 1018 are subject to enforcement under §§1018.99 and 1065.99, including fines, mitigation fees, and separate penalties for continuing violations. Conclusion: Compliance with Chapter 1018 is a continuing condition of development approval. Overall Conclusion The Evaluating Tree Commissioners find that, based on the record before it and subject to conditions imposed, the Preliminary Plan for the Matthew’s Hollow Subdivision meets the requirements of Chapter 1018, City Tree Ordinance, and does not result in unlawful removal, damage, or impairment of protected public trees. STAFF The Evaluating Tree Commissioners request that the Community Development Department acknowledges this review and proceeds with Preliminary Plan consideration, subject to continued compliance with Chapter 1018 and review by the Urban Forester or Designee throughout the ZBA/ Planning Commission and construction stages.

1214.05 Major Subdivision (5) Step 5 - Review and decision on the preliminary plat by City Council. A. The City Council shall review the preliminary plat application at its next regularly scheduled meeting, or at a special meeting, following the receipt of recommendation from the Planning Commission B. In making its decision, the City Council shall approve, approve with conditions, or deny the preliminary plat. The City Council may also continue the meeting if questions regarding the plat are not satisfactorily addressed by the applicant. C. The City Council shall make a decision within 60 days of the filing of the preliminary plat (Step 2) unless the City Council and subdivider agree to an extension of this time frame. If the City Council fails to act within the 60 days or there is no agreement for an extension of time, the application for a preliminary plat will be considered approved. D. If the City Council denies the preliminary plat, the applicant shall not move forward in the review process until a preliminary plat is approved by the City Council. E. In the event the City Council denies the preliminary plat or approves with conditions, the Code Administrator, on behalf of the City Council shall provide the subdivider with a statement in writing setting forth the reasons for the denial or the conditions of approval. F. Approval of the preliminary plat by the City Council does not constitute approval of the subdivision, but is merely an authorization to proceed with the preparation of the final plat and improvement plans. 1238.07 Subdivision Design Standards (c) Topography, floodplain areas, wetlands and natural areas. (1) Natural amenities (including views, mature trees, creeks, riparian corridors, rock outcrops, and similar features) shall be preserved and incorporated into proposed development to the greatest extent feasible. (g) Debris and waste. No cut trees, diseased trees, timber, debris, earth, rocks, stones, soil, junk, rubbish or other waste materials of any kind shall be buried in any land, or left or deposited on any lot or street at the time of the issuance of a zoning permit. No items and materials as described in the preceding sentence shall be left or deposited in any area of the subdivision at the time of dedication of public improvements.

(i) Street trees and Street Tree Fund. (1) Trees planted within a street right-of-way shall conform to the city master tree plan. Prior to construction a planting plan shall be approved by the Urban Forester. (2) All new subdivisions shall be required to contribute to the Street Tree Fund for the installation of trees in public rights-of-way. The fee shall be payable as a cash amount calculated by the Urban Forester and shall be paid prior to Final Plat approval. The fund shall be used by the city to install tree lawn trees within public rights-of-way of new subdivisions. The fund shall not apply to private streets. The cost for said fee shall be as set forth in Chapter 208 of this code of ordinances.

WHEREAS, the Environmental Committee and the Environmental Affairs Advisory Board have recommended amending Code of Ordinances Chapter 284, Sections 284.01, 284.02, 284.03, and 288.04; Chapter 288, Section 288.04; and Chapter 220, Section 220.05; and WHEREAS, Council, coming now to consider said recommendation, approves it in full. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVON LAKE, STATE OF OHIO: Section No. 1: That Code of Ordinances Chapter 284 is hereby amended as follows: CHAPTER 284: ENVIRONMENTAL AFFAIRS ADVISORY BOARD § 284.01 ESTABLISHMENT AND PURPOSE. There is hereby established an advisory board to be known as the Environmental Affairs Advisory Board with its purposes to include the following: (a) To study and advise courses of action which the Environmental Committee of Council may take to formulate and promote general and broad codes of land, air and water management for the city; and (b) To study and investigate other environmentally related concerns and issues of importance to Council and residents of the city and to report its findings and make appropriate recommendations to residents of the city and Council, as needed. § 284.02 MEMBERSHIP;TERM; COMPENSATION; AND REMOVAL. (a) Membership. The Environmental Affairs Advisory Board shall consist of 14 members, comprised of the following: (1) Up to six members shall be employees or representatives of industrial concerns located within the city who shall be selected because of their knowledge, technical capability or interest in matters relating to air and/or water management and for their ability to

The industrial members need not be residents of the city and shall be appointed by Council. (2) The other members who for the previous two years have been registered, qualified electors of the city and who are not employees of industrial concerns located in the city, shall be appointed by Council. (3) One ex officio, non-voting member shall be the Public Works Director. (4) One ex officio, non-voting member shall be the Chairperson of the Environmental Committee; and (5) One ex officio member shall be a member of the Tree Commission. (b) Term. The appointed resident members of the Environmental Affairs Advisory Board shall each serve three years with staggered terms, a third of which shall be appointed each year. Each member is eligible for reappointment without limitation on the number of consecutive appointments. (1) Beginning in 2026, the Chairperson shall serve for three years, and the Vice- Chairperson shall serve for two years, then every appointment thereafter, shall serve for three years. (2) Vacancies on the Environmental Affairs Advisory Board shall be filled for the remainder of the unexpired term in the same manner that the position was originally filled. (3) The Chairperson will notify the Clerk of Council when a vacancy exists. (4) Any vacancy shall be filled within 60 days, unless extenuating circumstances require a longer period. (c ) Compensation. Members of the Environmental Affairs Advisory Board shall serve without compensation. With prior approval of the assigned Department Director, according to the city procurement policies, any expense incurred by the Commission or the members thereof in the performance of their duties shall be paid from the city treasury. (d) Removal. Any Environmental Affairs Advisory Board member who misses three consecutive meetings, or more than 50% of the regular meetings on an annual basis, may be removed from the Board by a majority vote of the other Board members. § 284.03 POWERS AND DUTIES. The Environmental Affairs Advisory Board shall seek, as its general goals: (a) To create and foster a positive, responsible, cooperative and continuous effort among businesses and residents of the city; (b) To educate Council and residents of the city on important environmental issues;

(a) The Environmental Affairs Advisory Board shall elect by a majority vote its own Chairperson to make its own rules and regulations and keep a record of its proceedings. (b) The Environmental Affairs Advisory Board shall meet on a quarterly basis, or more frequently as requested by its Chairperson. Minutes of Board meetings shall be forwarded to the Mayor and members of Council and filed with the Clerk of Council. Section No. 2: That Code of Ordinances Chapter 288 is hereby amended as follows: CHAPTER 288: TREE COMMISSION § 288.04 MEETINGS; ORGANIZATION. (a) The Tree Commission shall hold an organizational meeting at its first regular meeting date of the year, and the meeting schedule for the year will be the first order of business. There shall be a minimum of six meetings per year. Work sessions or special meetings may be called at the discretion of the Commission Chairperson. (b) The Tree Commission shall elect by a majority vote its own officers, make its own rules and regulations and keep a record of its proceedings. A handbook shall be kept in the Clerk of Council’s office as a permanent record. In the absence of any rule regarding the matter of business, the Commission shall be governed by Robert’s Rules of Order. (c) The Tree Commission shall appoint one of its members to serve as an ex officio member of the Parks and Recreation Commission and one member to serve as an ex officio member of the Environmental Affairs Advisory Board. (d) A majority of the members shall be a quorum for the transaction of business. All plans, findings, advice, reports and recommendations made by the Tree Commission shall be in writing and shall designate by name those members of the Commission approving the same, failing to concur therein or abstaining therefrom. Those who fail to concur or who abstain shall have the right, as a part of such report, to state their reasons for refusing to approve or to concur. Minutes of meetings shall be filed in the Urban Forester’s office and forwarded to the Mayor and the Clerk of Council.

ORDINANCE NO. 26-9 INTRODUCED BY: Mr. Kos AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A MULTI- JURISDICTIONAL AGREEMENT FOR THE EASTERN LORAIN COUNTY EMERGENCY RESPONSE TEAM (“ELCERT”) COMPRISED OF THE CITY OF AVON, CITY OF AVON LAKE, CITY OF NORTH RIDGEVILLE, AND WESTSHORE ENFORCEMENT BUREAU (“WEB”). WHEREAS, the City of Avon Lake and the Cities of Avon and North Ridgeville entered into a multi-jurisdictional agreement for the Eastern Lorain County Emergency Response Team (ELCERT) pursuant to Ordinance No. 22-163, which passed on November 28, 2022, to effectively respond to serious criminal occurrences; and WHEREAS, said multi-jurisdictional agreements are authorized pursuant to Ohio Revised Code Sections 737.04 and 1545.131 as well as by previously enacted legislation authorizing mutual aid between law enforcement agencies within Lorain County; and WHEREAS, in order to provide mutual aid consisting of Special Weapons And Tactics (SWAT) services within the respective jurisdictions of the parties, it is the desire of the parties to this agreement to provide for and join in providing for mutual assistance and the interchange of their respective personnel and equipment; and WHEREAS, Council, after reviewing the proposed agreement, finds it necessary and desirable to enter into the multi-jurisdictional agreement between ELCERT comprised of the City of Avon, City of Avon Lake, City of North Ridgeville, and Westshore Enforcement Bureau (“WEB”) to provide for the interchange and use of personnel and equipment of member departments to further the health, safety, and welfare of the citizens of each community. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVON LAKE, STATE OF OHIO: Section No. 1: That Council hereby approves, accepts and authorizes the Mayor, or the Chief of Police as his designee, to enter into the multi-jurisdictional agreement between ELCERT and WEB to provide mutual police aid and assistance through the interchange and use of personnel and equipment of each members’ respective department, a copy of said contract being attached hereto and incorporated herein by reference. EXHIBIT A to Ordinance No. 26-9 1 AGREEMENT BETWEEN THE CITIES OF AVON LAKE, AVON, NORTH RIDGEVILLE, THE EASTERN LORAIN COUNTY EMERGENCY RESPONSE TEAM AND THE WESTSHORE ENFORCEMENT BUREAU FOR THE INTERCHANGE OF SWAT SERVICES. This agreement is made and entered into this _____ day of _______________, 2026 (the “effective date) by and between the legislative authorities of the cities of Avon Lake, Avon, North Ridgeville and the Westshore Enforcement Bureau under the authority of section 737.04 of the Ohio Revised Code. In addition, to the extent that the governing bodies of any of those municipal corporations have established or establish known as the Eastern Lorain County Emergency Response Team (ELCERT) under the authority of Chapter 167 of the Revised Code, this agreement is also between WEB and the municipalities named in this agreement. Copies of the authorizing legislation, ordinances or resolutions are attached hereto and expressly incorporated herein. WHEREAS, in order to provide mutual aid consisting of SWAT services within the respective jurisdictions of the parties, it is the desire of the parties to this agreement to provide for and join in providing for mutual assistance and the interchange of their respective personnel and equipment; and WHEREAS, the parties to this agreement desire to provide the additional police protection under such terms as are agreed upon in this agreement; and WHEREAS, each of the representative of the parties to this agreement is authorized to execute this agreement under the proper legislative authority of their respective Councils; NOW, THEREFORE, the parties to this agreement, each in consideration of the mutual promises and obligations in this agreement, agree as follows: 1. Each of the parties agrees to respond to an emergency and provide SWAT unit services within the other party’s municipal corporation, when requested by the Chief of Police, Mayor, Safety Service Director or that other party. The responding party agrees to provide SWAT unit services and police equipment at those times and places requested. The extent of such response by the responding party shall be determined solely by the Chief of Police, Mayor, Safety Service Director or the responding party with the sufficient equipment and personnel consistent with the proper protection of the responding party’s own constituents. 2. When a person is authorized by this agreement calls for assistance, he or she shall describe the specific emergency or activity requiring participation by another party to this agreement. That person shall also give explicit directions to the location where such assistance is required, and shall, whenever possible,

A party to this agreement shall not charge for the services provided or cost of equipment provided in this agreement. As provided in Section 737.04 of the Revised Code, Chapter 2744 of the Revised Code, insofar as it applies to the operations of police departments, shall apply to the parties of this agreement and to the police department members when they are rendering service outside their own subdivisions under this agreement and when they are enroute to rendering service outside their own subdivisions, and when they are enroute from rendering service outside their own subdivisions. 5. As provided in Section 737.04 of the Ohio Revised Code, Police Department members acting outside their subdivisions in which they are employed, when acting under this agreement, shall be entitled to participate in any indemnity fund established by their employer to the same extent as while acting within the employing subdivision. Those members shall be entitled to all the rights and benefits of Chapter 4123 of the Revised Code to the same extent as while performing service within the subdivision. The pension or indemnity fund of the municipal corporation of the requesting party shall not be liable for any benefits of the municipal corporation of the responding party. 6. As is customary in the incident command system, the incident City’s Police Chief, Department Designee, senior officer or officer in charge will retain command and control of the incident and all resources assigned to the incident. The units of and equipment provided by the responding City’s Police Department will remain under the command and control of the responding Police Department, but the responding Police Department shall report to the Incident City’s officer in charge and operate within the Command System. 7. This agreement shall be in full force and effect between the parties from the date inserted above provided however, any one of the parties may terminate itself as a party to this agreement and withdraw from it by providing written notice by its mayor, or his/her designee, to the mayors of the other parties. In that event , this agreement shall terminate 30 days after the written notice is received by the other parties. 8. WHEREAS, the Avon Lake Fire Department provides critical emergency medical services to the residents of the City of Avon Lake; and WHEREAS, Community West Foundation, in partnership with Cleveland Clinic Fairview Hospital, has awarded a grant in the amount of Forty-Five Thousand Eight Hundred Eighty-Five Dollars ($45,885) to the Avon Lake Fire Department; and WHEREAS, the grant funds are designated for the purchase of two LUCAS Mechanical CPR Devices, which provide continuous, high-quality chest compressions during cardiac arrest and enhance patient care and responder safety; and WHEREAS, acceptance of this grant will allow the City to obtain advanced lifesaving equipment without the use of City tax revenues; and WHEREAS, Council finds that acceptance of this grant is in the best interest of the health, safety, and welfare of the residents of Avon Lake.
