Legislation First Reading: Ordinance No. 26-30, AN ORDINANCE AMENDING CODE OF ORDINANCES SECTION 220.01(e)(1) AND DECLARING AN EMERGENCY. →Sponsor: G. ORDINANCE NO. 26-30 INTRODUCED BY: Mr. Smith AN ORDINANCE AMENDING CODE OF ORDINANCES SECTION 220.01(e)(1) AND DECLARING AN EMERGENCY. WHEREAS, Council President has recommended amending Code of Ordinances Section 220.01(e)(1); and WHEREAS, Council, coming now to consider said recommendation, approves it in full. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVON LAKE, STATE OF OHIO: Section No. 1: That Code of Ordinances Section 220.01(e)(1) is hereby amended as follows: (e) Executive sessions. (1) At the request of the Mayor or any member of Council, and upon an affirmative majority roll call vote of at least four members, members of Council may meet in executive session immediately before, during or immediately following any regular meeting, collective committee meeting, special meeting or work session of Council, with or without the presence of any party or parties deemed necessary, for any purpose permitted by the laws of the state as were enacted and as are in full force and effect on the date this section becomes effective. (2) Persons who are not members of Council may only attend if invited by a member of Council. Information discussed at executive sessions shall not be disclosed without consent of Council. Section No. 2: That it is found and determined that all formal actions of Council relating to the adoption of this Ordinance were taken in an open meeting, and that all deliberations of Council and its committees resulting in such actions were conducted in meetings open to the public in compliance with all applicable legal requirements, including Section 121.22 of the Ohio Revised Code. Section No. 3: That this Ordinance is hereby declared to be an emergency measure, the emergency being the immediate need to amend Council rules, thus for the health, safety, and welfare of the public. Therefore, this Ordinance shall be in full force and effect from and immediately after passage and approval by the Mayor.
