RESOLUTION NO. 26-43 INTRODUCED BY: Mr. Shahmir A RESOLUTION AUTHORIZING THE FINANCE DIRECTOR TO DISBURSE THE JOB GROWTH INCENTIVE PROGRAM AWARDS FOR TAX YEAR 2025 AND DECLARING AN EMERGENCY. WHEREAS, City Council enacted a Job Growth Incentive Program to promote the creation of jobs and the economic development of the City; and WHEREAS, the Community Development Director has tabulated a list of award recipients based on the income tax revenues of these businesses in Avon Lake for the Tax Year 2025. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF AVON LAKE, STATE OF OHIO: Section No. 1: That the Finance Director is hereby authorized to issue and disburse the Job Growth Incentive Program awards as determined by the Community Development Director. (Exhibit A) Section No. 2: That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this Resolution were taken in an open meeting of this Council, and that all deliberations of this Council and any of its committees, which resulted in such formal actions, were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code. WHEREAS, it has been recommended by the Human Resources Director and Human Resources Committee that a revised job description for the position of Assistant Fire Chief be adopted. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVON LAKE, STATE OF OHIO: Section No. 1: That the specifications, responsibilities, and duties applicable to the position of Assistant Fire Chief shall be as shown in the job description, a copy of which is attached hereto and made a part hereof. Section No. 2: That Ordinance No. 22-141 be repealed. Section No. 3: That it is found and determined that all formal actions of Council relating to the passage of this Ordinance were taken in an open meeting, and that all deliberations of Council and its committees resulting in such actions were conducted in meetings open to the public in compliance with all applicable legal requirements, including Section 121.22 of the Ohio Revised Code. City of Avon Lake, Ohio Classification Specification Assistant Fire Chief JOB FAMILY GRADE FLSA STATUS CLASSIFIED STATUS PCN Director E12 Exempt Classified CLASSIFICATION SUMMARY1 The Assistant Fire Chief manages department-wide operations, including policy development, budgeting, and setting priorities; supervises staff; resolves internal and public issues; collaborates with stakeholders; and serves as Acting Fire Chief in the absence of the Fire Chief. ESSENTIAL FUNCTIONS1 % OF TIME Plans and assigns work to subordinates; directs and evaluates work activities; coaches and trains subordinates; evaluates performance and recommends corrective action; reviews time off requests and payroll; and promotes and maintains ethical and professional standards of conduct. 20 Assesses adequacy of equipment, sufficiency of staffing, and condition and maintenance of hydrants and alternative water sources; recommends and implements improvements to the quality of services and acceptable ISO ratings. 20 Directs and oversees efficient and effective training; is responsible for the management of full-time and part-time personnel; and communicates information to appropriate personnel regarding policy and procedure changes. 20 Oversees the cause and origin of fires to ensure compliance with state regulatory reporting and documentation; manages crews at fires, rescues, hazardous material incidents, disasters, and other emergencies; and supervises the fire prevention and education program. 15 Establishes relationships and communicates with internal and external groups; participates in staff meetings, planning meetings, and meetings with elected officials; conducts presentations to promote public awareness and acceptance of divisional policies and procedures; attends community events; maintains cooperative working relationships with community organizations. 10 1 The essential duties, functions, responsibilities, and recommended Fair Labor Standards Act (FLSA) designation may vary based on the specific tasks assigned to the position.

ORDINANCE NO. 26-50 INTRODUCED BY: Mrs. Fenderbosch AN ORDINANCE AWARDING A CONTRACT FOR THE 2026 CRACK SEALING PROGRAM TO SPECIALIZED CONSTRUCTION, INC., AND DECLARING AN EMERGENCY. WHEREAS, in accordance with the direction of Council, the City Engineer has prepared plans and specifications for the 2026 Crack Sealing Program, which have been and are now on file in the Public Works Department; and WHEREAS, further in accordance with the direction of Council, the City Engineer has caused notice to be given as provided by law, inviting bids for construction of said improvements, bids having been received, opened, and tabulated as provided by law; and WHEREAS, Council, coming now to consider said bids, has determined that the bid submitted by Specialized Construction, Inc., of Cuyahoga Heights, Ohio, is the lowest and best responsive bid, after advertising in accordance with law, and is acceptable to this Council. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVON LAKE, STATE OF OHIO: Section No. 1: That the bid by Specialized Construction, Inc., of Cuyahoga Heights, Ohio, (hereafter referred to as “Contractor”) for the 2026 Crack Sealing Program for the City of Avon Lake, Ohio, in accordance with the plans and specifications, be, and the same is hereby awarded to said Contractor in accordance with said plans and specifications and bid received. The amount of said contract is for the Base Bid of $44,850, Add Alternate 1 of $10,000, Add Alternate 2 of $10,000, Add Alternate 3 of $8,250, and Add Alternate 4 of $6,750, for a total of $79,850. Section No. 2: That the Contractor shall furnish their good and sufficient performance bond in the amount of $79,850 to the satisfaction of the Mayor and approved as to form by the Law Director, conditioned to insure faithful performance of the contract thereby awarded and completion of the work free and clear of all claims and encumbrances. Section No. 3: That the Contractor shall deposit and keep in force and effect on file with said Finance Director memoranda of policies of insurance in the amounts and under the conditions set forth in the specifications of the contract documents. WHEREAS, the Public Works Department has developed a Sensible Salting Program designed to improve environmental stewardship, reduce deterioration of public roadways, and better manage rising operational expenses associated with winter roadway maintenance; and WHEREAS, the Sensible Salting Program applies to all public roadways within the municipal boundaries of the City of Avon Lake and encourages homeowners associations managing private streets to consider adopting similar practices; and WHEREAS, the Sensible Salting Program establishes an initial goal of reducing road salt usage by 20% during the 2026-2027 winter season while maintaining safe and passable roadways for motorists; and WHEREAS, the Sensible Salting Program includes strategies such as limited salting during overnight hours, targeted salting at intersections, hills, curves, bridges, and school zones, spot salting when practicable, employee training, equipment calibration, and continued evaluation of alternative deicing materials and methods; and WHEREAS, Council recognizes the environmental, operational, and financial benefits associated with sensible salting practices, including reduced damage to roadway infrastructure, decreased salt runoff into waterways, lower material and overtime costs, and reduced damage to landscaping adjacent to roadways; and WHEREAS, the Public Works Department has requested the support and cooperation of Council, City departments, and the public in implementing the Sensible Salting Program and educating residents regarding winter driving safety and roadway expectations during snow events. AVON LAKE PUBLIC WORKS DEPARTMENT SENSIBLE SALTING PROGRAM (May 2026) PURPOSE In an effort to improve environmental stewardship, to reduce deterioration to our public roadway network, and improve management of rising expenses, the Avon Lake Public Works Department has developed the following sensible salting program. SCOPE This program applies to all public roadways within the city limits of the City of Avon Lake. HOA’s that manage private streets are encouraged to review and adopt this program for their communities. GOAL An initial 20% reduction in salt usage during the 2026-2027 winter season, working toward additional salt reductions in the future. STRATEGIES In order to reach the stated goal of a 20% reduction in salt usage, the Avon Lake Public Works Department proposes the following: 1. Limited salting between the hours of 11:00 p.m. and 4:30 a.m. During periods of snowfall between the hours of 11:00 p.m. and 4:30 a.m., it is not feasible to salt main roads. Due to low traffic volumes, the salt is not effective and in some instances can create even worse conditions. Typically, if crews begin plowing and salting main roads and school zones at 4:30 a.m., they will be ice free for rush hour. Between the hours of 11:00 p.m. to 4:30 a.m., the goal of Public Works Department will be to provide a “passable roadway” which is defined as “a roadway surface that is free from drifts, snow ridges, and as much ice and snow pack as is practical and can be traveled safely at reasonable speeds.” Only intersections, hills, curves and bridges will be salted on main roads between these hours. 2. Salting during snow events. During periods of snowfall of 1” or more per hour, main roads will be plowed as frequently as possible but will only be salted at intersections, hills, curves, bridges and school zones. “Spot salting”, defined as “intermittent spreading of salt at 150 ft. intervals”, will also be utilized when practicable. 3. Limited salting on secondary roads. Secondary roads will be plowed as often as possible, but will not be salted except for 200 ft. at each intersection, and at hills, curves, bridges and school zones. Spot salting will be utilized on secondary roads when practicable. 4. Proper training of employees. The Avon Lake Public Works Department will ensure that snow removal crews are properly advised of these sensible salting practices and are instructed to follow the guidelines set forth herein.

2 5. Proper calibration of equipment. The Avon Lake Public Works Department will ensure that snow removal equipment is properly calibrated. 6. Investigation of alternative products. The Avon Lake Public Works Department will continue to investigate the benefits of and utilize alternative products such as brine, brine additives and other enhanced deicers. The benefits of these sensible salting practices include: • less damage to road surfaces resulting in savings on long-term road maintenance; • less salt entering the storm water system and ultimately reaching lakes and streams; • potential savings on departmental overtime; • savings on salt cost; and • less salt damage to landscaping along roadways. REQUESTED ASSISTANCE During snow events, comparison of road conditions between neighboring communities by the media and by residents can cause pressure to increase salt usage. In an effort to avoid this, it is imperative that the administration, police departments and members of council are aware of and in agreement with the sensible salting practices outlined above. The following assistance is requested: 1. The adoption of a Resolution regarding sensible salting program. 2. Effective communication to local media and city departments of the passage of any Resolution regarding sensible salting practices. 3. Public education about the planned reduction in salt usage, through community newsletters, publications, website, social media and the provision of information regarding safe driving practices on snowy roads.

3 Driving Safety Tips for Snow & Ice The best advice for driving in bad winter weather is not to drive at all, if you can avoid it. Don't go out until the snow plows have had a chance to do their work, and allow yourself extra time to reach your destination. If you must drive in snowy conditions, make sure your car is prepared, and that you know how to handle road conditions. It's helpful to practice winter driving techniques in a snowy, open parking lot, so you're familiar with how your car handles. Consult your owner's manual for tips specific to your vehicle. Driving safely on icy roads 1. Decrease your speed and leave yourself plenty of room to stop. You should allow at least three times more space than usual between you and the car in front of you. 2. Brake gently to avoid skidding. If your wheels start to lock up, ease off the brake. 3. Turn on your lights to increase your visibility to other motorists. 4. Keep your lights and windshield clean. 5. Use low gears to keep traction, especially on hills. 6. Don't use cruise control or overdrive on icy roads. 7. Be especially careful on bridges, overpasses and infrequently traveled roads, which will freeze first. Even at temperatures above freezing, if the conditions are wet, you might encounter ice in shady areas or on exposed roadways like bridges. 8. Don't pass snow plow trucks. The drivers have limited visibility, and you're likely to find the road in front of them worse than the road behind. 9. Don't assume your vehicle can handle all conditions. Even four-wheel and front-wheel drive vehicles can encounter trouble on winter roads. If your rear wheels skid... 1. Take your foot off the accelerator. 2. Steer in the direction you want the front wheels to go. If your rear wheels are sliding left, steer left. If they're sliding right, steer right. 3. If your rear wheels start sliding the other way as you recover, ease the steering wheel toward that side. You might have to steer left and right a few times to get your vehicle completely under control. 4. If you have standard brakes, pump them gently. 5. If you have anti-lock brakes (ABS), do not pump the brakes. Apply steady pressure to the brakes. You will feel the brakes pulse — this is normal. If your front wheels skid... 1. Take your foot off the gas and shift to neutral, but don't try to steer immediately.

4 2. As the wheels skid sideways, they will slow the vehicle and traction will return. As it does, steer in the direction you want to go. Then put the transmission in "drive" or release the clutch, and accelerate gently. If you get stuck... 1. Do not spin your wheels. This will only dig you in deeper. 2. Turn your wheels from side to side a few times to push snow out of the way. 3. Use a light touch on the gas, to ease your car out. 4. Use a shovel to clear snow away from the wheels and the underside of the car. 5. Pour sand, kitty litter, gravel or salt in the path of the wheels, to help get traction. 6. Try rocking the vehicle. (Check your owner's manual first — it can damage the transmission on some vehicles.) Shift from forward to reverse, and back again. Each time you're in gear, give a light touch on the gas until the vehicle gets going. WHEREAS, the City of Avon Lake has received and anticipates receiving, settlement proceeds related to PFAS class action litigation concerning per- and polyfluoroalkyl substances affecting public water systems; and WHEREAS, the Avon Lake Municipal Utilities Board and Administration desire to create a separate fund for the proper receipt, accounting, tracking, and expenditure of PFAS class action settlement proceeds; and WHEREAS, pursuant to Ohio Revised Code Sections 5705.09 and 5705.12, Avon Lake City Council may establish a special revenue or enterprise fund for the purpose of accounting for specific revenues and expenditures; and WHEREAS, the revenues deposited in the fund shall be used exclusively for eligible costs associated with PFAS remediation, treatment, monitoring, infrastructure improvements, regulatory compliance, operational costs, legal obligations, and other water quality protection measures related to PFAS contamination; and WHEREAS, Council finds, based upon the recommendation of the Avon Lake Municipal Utilities Board and Administration that the creation of the PFAS Class Action Lawsuit Settlement Fund No. 708 is in the best interests of the health, safety, and general welfare of the community.
