ORDINANCE NO. 26-62 INTRODUCED BY: Mr. Shahmir AN ORDINANCE REPEALING ORDINANCE NO. 103-2012, ORDINANCE NO. 191-2017, AND ORDINANCE NO. 21-141, WHICH ESTABLISHED, REAUTHORIZED, AND AMENDED THE CITY'S JOB GROWTH INCENTIVE PROGRAM, AND DECLARING AN EMERGENCY. WHEREAS, the City established a Job Growth Incentive Program through Ordinance No. 103-2012 to encourage job creation, capital investment, and economic development within the City; and WHEREAS, the City subsequently reauthorized the program through Ordinance No. 191-2017 and modified the program through Ordinance No. 21-141; and WHEREAS, Council has determined that the existing Job Growth Incentive Program should be repealed to allow for the development and consideration of a new economic development incentive program that better aligns with the City's current economic development objectives, provides greater fiscal predictability, and offers increased flexibility in supporting business attraction, retention, redevelopment, and investment within the City; and WHEREAS, Council finds it to be in the best interest of the City to repeal the existing program while a replacement program is finalized and considered for adoption. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVON LAKE, STATE OF OHIO: Section No. 1: Ordinance No. 103-2012, Ordinance No. 191-2017, and Ordinance No. 21-141 are hereby repealed in their entirety. Section No. 2: Effective upon the effective date of this Ordinance, the Job Growth Incentive Program is terminated. Any unexpended and unobligated appropriations, together with any monies budgeted, reserved, designated, or otherwise allocated for the Job Growth Incentive Program, including future budget funding intended for such program, shall be transferred by the Finance Director, as permitted by law, to Economic Development Fund No. 226. Monies in the fund shall be used solely for economic development purposes as authorized by Council. Section No. 3: That it is found and determined that all formal actions of Council relating to the passage of this Ordinance were taken in an open meeting, and that all deliberations of Council and its committees resulting in such actions were conducted in meetings open to the public in compliance with all applicable legal requirements, including Section 121.22 of the Ohio Revised Code. ORDINANCE NO. 26-62 Page | 2 Section No. 4: This Ordinance is declared to be an emergency measure, the emergency being the immediate preservation of the public peace, health, safety, and welfare of the City in order to facilitate the transition to a revised economic development incentive program that more effectively serves the City's current economic development goals. Therefore, this Ordinance shall take effect immediately upon its passage and approval by the Mayor.
