Ordinance 63-26 — Certified Copy

ORDINANCE NO. 63-26 AN ORDINANCE TO AWARD A BID FOR THE 2026 PAVEMENT RESURFACING PROGRAM AND DECLARING AN EMERGENCY WHEREAS, to address pavement maintenance conditions it is necessary to repair and re- pave Riegelsberger Road in its entirety and a portion of Nagel Road between Detroit Road and Cherry Street during the upcoming construction season to maintain safe travel conditions; and WHEREAS, the City Engineer has identified a 2026 Pavement Resurfacing Program which shall include the following: widening of the existing Riegelsberger Road asphalt roadway from the average width of 20-feet to 24-feet to be striped to accommodate 11-foot-wide travel lanes and 1-foot-wide asphalt berms along both sides of the roadway; resurfacing without widening the noted Nagel Road section; as well as the asphalt pavement planing; asphalt resurfacing with a 2-1/4 inch asphalt pavement; intersection improvements; partial & full depth pavement repairs; utility adjustments; curb ramp replacements; pavement striping; and appurtenances thereto; and WHEREAS, Avon City Council passed Resolution R-7-26 on April 13, 2026, which authorized the public bid of:said 2026 Pavement Resurfacing Program; and WHEREAS, the public bids were opened and read aloud at noon on May 14, 2026 at Avon City Hall, and the following bids were received: Contractor Bid Total Specialized Construction, Inc. $1,029,409.00 Ronyak Paving, Inc. $1,173,125.00 Geauga Highway Co. $1,187,334.00 Phillips Paving, LLC $1,192,410.00 Barbicas Paving, LLC $1,228,827.50 Karvo Companies, Inc. $1,260,217.10 Gerken Paving, Inc. $1,337,859.80 | WHEREAS, the Engineer’s Estimated cost for the project was set at $1,029,409.00. As such, the bid by specialized Construction, Inc. is approximately 0% below the Engineer’s Estimate. A copy of the bid tabulation is attached hereto within Exhibit “A”; and WHEREAS, the City Engineer has reviewed each of the Bids submitted and is recommending that the bids submitted by Specialized Construction, Inc. be considered the lowest and best bid for the 2026 Pavement Resurfacing Program, a bid review memorandum is attached hereto as part of Exhibit A; and WHEREAS, City Council finds that it is in the best interest of the health, safety, and welfare of the Community that the City go forward with the awarding of a construction contract based on the public bid for the 2026 Pavement Resurfacing Program, which was received on May 14, 2026.

Ordinance No. 63-26 (Con't) NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVON, COUNTY OF LORAIN AND STATE OF OHIO: Section 1 - That pursuant to public bids received on May 14, 2026 at Avon City Hall for the 2026 Pavement Resurfacing Program, (see Exhibit A attached hereto and incorporated herein), the bid submitted by Specialized Construction, Inc. in the amount of One Million Twenty Nine Thousand Four Hundred Nine Dollars and 00/100 Cents ($1,029,409.00) for the 2026 Pavement Resurfacing Program is declared to be the lowest and best bid. The Mayor is hereby authorized to execute a construction contract with that entity. The Finance Director is hereby authorized to make pavement in said amount from the 2026 Road Program Fund No. 425. _ In addition, the Finance Director is authorized to increase this appropriation by a responsible amount for engineering and legal fees associated with this project. Section 2 - That it is found and determined that all formal actions of the Council of the City of Avon concerning and relating to the adoption of this Resolution were taken in an open meeting of the Council of the City of Avon and that all deliberations of this City's Council and any of its committees that resulted in those formal actions were in meetings open to the public, in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code. Section 3 - That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety, and welfare of the citizens of the City of Avon, the immediate emergency being the necessity to undertake and substantially complete the 2026 Pavement Resurfacing Program prior to the end of the 2026 construction season; therefore, this Ordinance shall be in full force and effect immediately upon its passage and approval by the Mayor.
