Revised 7/1/26 RESOLUTION NO. R-12-26 A RESOLUTION TO ADVERTISE FOR BIDS FOR THE TRAXLER FAMILY ARBORETUM PEDESTRIAN BRIDGE PROJECT IN THE CITY OF AVON AND DECLARING AN EMERGENCY WHEREAS, on or about August 25, 2023, the City of Avon acquired approximately 37.5 acres of land (PPN# 04-00-011-102-123) from the Traxler Family Limited Partnership; and WHEREAS, Council passed Ord. No. 35-24 on March 25, 2024 to officially name this park the “Traxler Family Arboretum”; and WHEREAS, the City of Avon proposes to construct, operate, and maintain an arboretum with walking trails, seating, fencing, and restrooms on this property; and WHEREAS, the Administration continues to work with the Avon Tree Commission, City Arborist, the Avon City Schools, and other community organizations on the fulfillment of a shared community vision for the Traxler Family Arboretum to enhance Avon’s quality, character, livability, safety, and economic development potential; and WHEREAS, the City of Avon, with the assistance of its State Senator Nathan Manning and Ohio House Representative Gayle Manning, was successful in securing state grant funding that can be utilized for the replacement of a pedestrian bridge over French Creek via the State Capital Budget, with such grant funds being administered by the Ohio Department of Natural Resources; and WHEREAS, the City Engineer has identified a Design/Build project delivery scope package to replace the pedestrian bridge over French Creek in its previous location with a new bridge spanning approximately 70-feet, with the general look and style of the pedestrian bridge depicted in the attached Exhibit A, together with all appurtenances thereto; and WHEREAS, the Council finds that it is in the best interest of the health, safety and welfare of the Community that the city proceeds with advertising for public bids to complete the Traxler Family Arboretum Pedestrian Bridge Project. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVON, LORAIN COUNTY, OHIO: Section 1 - That the Clerk of Council is hereby authorized and directed to advertise for public bids for the completion of the work items described above at locations determined by the City Engineer. These improvements shall be made pursuant to plans and specifications developed by the City Engineer and Chagrin Valley Engineering, Ltd., which shall be on file and open for inspection at the Office of the Clerk of Council and incorporated herein by reference.

Resolution No. R-12-26 (Con’t.) Revised 7/1/26 2 Section 2 - That the City shall reserve the right to reject any and all bids. Section 3 - That it is found and determined that all formal actions of the Council of the City of Avon concerning and relating to the adoption of this Resolution were taken in an open meeting of the Council of the City of Avon and that all deliberations of this City's Council and any of its committees that resulted in those formal actions were in meetings open to the public, in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code. Section 4 - That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare of the citizens of the City of Avon, the immediate emergency being the necessity to advertise for bids for the Traxler Family Arboretum Pedestrian Bridge Project in order to facilitate substantial completion prior to the end of 2026 construction season; therefore, this resolution shall be in full force and effect immediately upon its passage and approval by the Mayor.
