MINUTES OF A REGULAR COUNCIL MEETING October 6, 2025 – 7:30p.m. Council of the City of Berea, Ohio, met in regular session in the Council Chamber on October 6, 2025 and the meeting was called to order by President of Council Jim Maxwell at 7:30p.m. Present: Mary K. Brown, Erika Coble, Leon R. Dozier, Sr., Chris McManis, Lisa Weaver and Gene Zacharyasz. Absent: Rick Skoczen. Also present: Director of Public Service Tony Armagno, Director of Law and Public Safety Barb Jones, and Director of Economic Development Matt Madzy. The Pledge of Allegiance followed. This meeting was held in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code and Chapter 109 of the Codified Ordinances of the City of Berea. The certificate of compliance is on file in the Clerk’s office. Moved by Mrs. Brown, seconded by Mr. McManis, that the minutes from the September 15, 2025 Regular Council Meeting be approved. Vote on the motion was all ayes and no nays. The motion carried. MAYOR'S ADMINISTRATIVE REPORT AND COMMENTS Mayor Kleem was not present. REPORT AND COMMENTS BY THE OFFICERS OF THE ADMINISTRATION: Andrea Morris – Director of Finance: Mrs. Morris was not present. Barb Jones – Director of Law & Public Safety: Mrs. Jones had no report. Mary – motorized bikes memo to all members; Barb: user friendly chart on Police FB page that gives info; strict enforcement is occurring; knocking on doors and talking to Parents; Tony Armagno – Director of Public Service: Mr. Armagno -Edgewood resurfacing started last week - letters and notices out; mobilized on site last week; sewers and drains this wek; Longbrooke – paving finished 2 weeks ago – cable cos still relocating; making progress, just not as quickly as we would like; they are restoring disturbed treelawns that they disturbed; letters went out to all res to restore in the Spring from contractor; will fertilize and overseed as needed; concern is that with cable still having to put seed down, need to grow before they come back in; Mary: just Edgewood Tony: Longbrooke 2 REGULAR COUNCIL MEETING – October 6, 2025 Opened poolhouse bids last week – received 2 – reviewing them; awarded by next meeting; Jim: Merrimack – toward second to last cul de sac – sign placed when residents couldn’t park – sign still up; handicapped; Tony; recent walk through – they will remove the sign; Mary: tree project, quite a few that need to come down; Tony: grant funds – listen 7:38 Mary: one on Nobottom and Cross that needs to come down – treelawn tree; Erika: Dorland on list; removal Holly: cemetery – 8 there that need to come down; thought that they would come down; Tony: grant was only for treelawn trees; that is different project; we are keeping an eye on them; one already came down; pro-active on that; Marty Compton – Director of Recreation: Mr. Compton was not present. COMMENDATIONS: None PETITIONS: None AUDIENCE PARTICIPATION: Lina Workman, Cuyahoga County Board of Developmental Disabilities: came last year to reintroduce CCDD so this year, recognizing milestone – 20th anniversary of last levy; 2/3s of budget comes from a continuous levy passed in 2005; from birth-adulthood, support people with DD – support and empower; live, learn, work and play; last year over 178 people in Berea; served 15K across the County; 20% increase compared to 2005; over last 20 years – levy supported people through early intervention, thherapies, consultative services, housing and employment; donate to community libraries and recs to make physical spaces accessible to people of all abiiites; awarded rants – one to Berea Arts Fest in 2024; in addition to supportin -strive to be a resource for communities; how can we best serve Berea; thank Erika – one house on Fowles had meet and greet – and Erika worked with MH City Council got over 14 people and feedback was very positive – most were from Berea side; wonderful; positive and supportive; thanks for coordinating that; Erika: thank you to your group for hosting the meeting; Johnathan Montag Lady who spoke at Council: don’t want to give prop to Ryan – class action lawsuit against Ryan Homes; HVAC, foundation issues; roof leaks; electrical; water incursions; one thing that Ryan does is they don’t build a basement – they do a floating slab basement - not connected to walls at all; cuts down on cost – but lots of probs that go with it too; one thing that Ryan demands in that all probs go through their arbitrator; they also require buyers to sign non-disclosure agreement; people who have filed, denial is 40%, there have been structural issues not covered under warranties; 68% had at least 1 problem; attic issues; consumer surveys said buyers felt misled about warranty coverage; west field park division sued in Olmsted; Christina Bratsch – owns the hydrant; adapt to environment; not best option, but may be only option; reached out to a lot of businesses; north point as business district; trying to rezone; public safety – Thacker and Front; Thacker is horrible; called so many times; don’t get calls back; 3 REGULAR COUNCIL MEETING – October 6, 2025 COUNCIL COMMITTEE REPORTS AND ANNOUNCEMENTS: Court Committee – Chris McManis, Chair Mr. McManis Changes from employemnet, some AI changes, business operations Court Com meetig – update; collection of revenue; Berea Shade Tree Commission – Erika Coble and Gene Zacharyasz Good meeting – tree plantings; 200 are in neighborhood in between Nobottom and Barrett; discussed new rec tree list that will be published for people who are interested in choosing trees; good piece of info; also attended tree summit in RR – topic of summit was kinds of trees that Cities are looking to include in inventory; improving on native tree available that are adaptable to climate change; Mary: trees going in from grant; more canopy trees; mostly going toward park tree line Tony: they are treelawn trees; Woodvale Union Cemetery Board of Trustees – Jim Maxwell Joint Council – 10.22 7pm LEGISLATION – THIRD READING: RESOLUTION NO. 6-5: A RESOLUTION AUTHORIZING THE MAYOR TO MAKE APPLICATION FOR AND, IF AWARDED, TO ENTER INTO A COOPERATION AGREEMENT WITH THE COUNTY EXECUTIVE OF CUYAHOGA COUNTY, OHIO, AND THE DEPARTMENT OF DEVELOPMENT FOR A GRANT THROUGH THE 2026 COMMUNITY DEVELOPMENT SUPPLEMENTAL GRANT (CDSG) PROGRAM AND TO ADVERTISE FOR BIDS AND ENTER INTO ONE OR MORE CONTRACTS FOR THE PURPOSES SPECIFIED IN THE CDSG AGREEMENT, AND DECLARING AN EMERGENCY. ORDINANCE NO. 9-8: AN ORDINANCE REPEALING AND REPLACING CHAPTER 1331, RESIDENTIAL RENTAL PROPERTY PERMITS, OF THE CODIFIED ORDINANCES OF THE CITY OF BEREA TO INCLUDE REGISTRATION REQUIREMENTS AND PROCEDURES FOR BOTH LONG-TERM AND SHORT-TERM RESIDENTIAL RENTAL PROPERTIES. ORDINANCE NO. 9-9: AN ORDINANCE REPEALING AND REPLACING SECTION 311.06, REQUIREMENTS UPON SALE OF PROPERTY; DUTY OF SELLER AND ESCROW AGENT; BUYERS RIGHTS, OF CHAPTER 311, WATER SUPPLY, OF THE CODIFIED ORDINANCES OF THE CITY OF BEREA. 4 REGULAR COUNCIL MEETING – October 6, 2025 The Clerk read the title of the Ordinance. LEGISLATION – SECOND READING: ORDINANCE NO. 9-10: AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF BEREA BY REZONING VARIOUS PARCELS FROM UPTOWN (UT) DISTRICT TO MULTI- FAMILY RESIDENTIAL (MFR) DISTRICT. ORDINANCE NO. 9-11: AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH GD3 VENTURES I LLC, TO PROVIDE FOR THE DEVELOPMENT AND SALE OF REAL PROPERTIES OWNED BY THE CITY OF BEREA, WHICH ARE NO LONGER NEEDED FOR ANY MUNICIPAL PURPOSES, AND TO EXECUTE ANY AND ALL DOCUMENTS RELATED THERETO, AND DECLARING AN EMERGENCY. ORDINANCE NO. 10-2: AN ORDINANCE APPROVING, RATIFYING AND AFFIRMING THE 2024 ANNUAL REPORT, MINUTES AND ACTIONS OF THE CITY OF BEREA HOUSING REVIEW COUNCIL FOR ALL RESIDENTIAL COMMUNITY REINVESTMENT AREA REAL ESTATE TAX ABATEMENTS AND COMMERCIAL COMMUNITY REINVESTMENT AREA REAL ESTATE TAX ABATEMENTS ENTERED INTO UNDER THE PRE-1994 COMMUNITY REINVESTMENTAREA REGULATIONS IN THE CITY OF BEREA. ORDINANCE NO. 10-3: AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF BEREA TO ENTER INTO A CONTRACT WITH THE GENERAL HEALTH DISTRICT OF CUYAHOGA COUNTY, OHIO, PROVIDING FOR HEALTH SERVICES FOR THE CITY OF BEREA 5 REGULAR COUNCIL MEETING – October 6, 2025 FOR YEARS 2026 AND 2027. ORDINANCE NO. 10-4: AN ORDINANCE VACATING PORTIONS OF THE PUBLIC RIGHT OF WAY ON FRONT STREET AND LOU GROZA BOULEVARD, NO LONGER NEEDED FOR MUNICIPAL PURPOSES. OTHER BUSINESS: There being no further business before Council, it was moved by Mr. McManis, and seconded by Mr. Zacharyasz, that the Regular Council Meeting be adjourned. Vote on the motion 6 REGULAR COUNCIL MEETING – October 6, 2025 was all ayes and no nays.
