MINUTES OF A REGULAR COUNCIL MEETING February 2, 2026 – 7:30p.m. Council of the City of Berea, Ohio, met in regular session in the Council Chamber on February 2, 2026 and the meeting was called to order by President of Council Jim Maxwell at 7:30p.m. Present: Erika Coble, Michael A. Kurtz, Chris McManis, Vance Redding, Rick Skoczen, Lisa Weaver and Gene Zacharyasz. Also present: Mayor Cyril M. Kleem, Director of Public Service Tony Armagno and Director of Law and Public Safety Barb Jones. The Pledge of Allegiance followed. This meeting was held in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code and Chapter 109 of the Codified Ordinances of the City of Berea. The certificate of compliance is on file in the Clerk’s office. Moved by Mr. McManis, seconded by Mr. Zacharyasz, that the minutes from the January 26, 2026 Special Council Meeting be approved. Vote on the motion was all ayes and no nays. The motion carried. MAYOR'S ADMINISTRATIVE REPORT AND COMMENTS Mayor Kleem had no report. REPORT AND COMMENTS BY THE OFFICERS OF THE ADMINISTRATION: Andrea Morris – Director of Finance: Mrs. Morris was not present. Barb Jones – Director of Law & Public Safety: Mrs. Jones had no report. Tony Armagno – Director of Public Service: Mr. Armagno announced that the pavement markings project will be awarded soon. Marty Compton – Director of Recreation: Mr. Compton was not present. COMMENDATIONS: None PETITIONS: None AUDIENCE PARTICIPATION: None COUNCIL COMMITTEE REPORTS AND ANNOUNCEMENTS: None 2 REGULAR COUNCIL MEETING – February 2, 2026 LEGISLATION – THIRD READING: ORDINANCE NO. 1-2: AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE TO ENTER INTO AN AGREEMENT WITH CUYAHOGA SOIL AND WATER CONSERVATION DISTRICT TO PROVIDE TECHNICAL ASSISTANCE IN IMPLEMENTING SOIL AND WATER CONSERVATION MEASURES, AND DECLARING AN EMERGENCY. The Clerk read the title of the Ordinance. Moved by Mr. McManis, seconded by Mr. Redding, that Ordinance No. 1-2 be adopted. Vote on the motion was ayes: Coble, Kurtz, McManis, Redding, Skoczen, Weaver and Zacharyasz. Nays: None. The motion carried. ORDINANCE NO. 1-3: AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO ENTER INTO A LISTING AGREEMENT WITH A PROFESSIONAL REALTOR FOR THE MARKETING AND SALE OF 280 KEMPTON DRIVE, AND TO SUBSEQUENTLY, AND UPON THE APPROVAL OF BOARD OF CONTROL, ENTER INTO A STANDARD RESIDENTIAL PURCHASE AGREEMENT FOR THE SALE OF 280 KEMPTON DRIVE, WHICH IS NO LONGER NEEDED FOR MUNICIPAL PURPOSES, TO THE PERSON OR ENTITY SUBMITTING THE HIGHEST AND BEST OFFER, AND TO EXECUTE ALL DOCUMENTS RELATED TO THE SALES, AND DECLARING AN EMERGENCY. The Clerk read the title of the Ordinance. Mrs. Jones informed Council that the interior of the house does need some work, particularly the removal of an unlawful apartment that is attached to the garage. Mayor Kleem added that while the work may cost around $30,000, the house will sell for far more than that. Moved by Mr. Skoczen, seconded by Mr. McManis, that Ordinance No. 1-3 be adopted. Vote on the motion was ayes: Coble, Kurtz, McManis, Redding, Skoczen, Weaver and Zacharyasz. Nays: None. The motion carried. LEGISLATION – SECOND READING: NONE LEGISLATION – FIRST READING: RESOLUTION NO. 2-1: A RESOLUTION CONFIRMING THE APPOINTMENT OF JOSHUA MALONE TO THE MUNICIPAL PLANNING COMMISSION, AND DECLARING AN EMERGENCY. The Clerk read the title of the Resolution. Mayor Kleem, Mr. Skoczen and Mr. McManis all expressed support for Mr. Malone, a young, talented, intelligent and conscientious Berea resident and engineer, who can commit to the 5 year term and who will add a certain and beneficial expertise to the group. Moved by Mr. Zacharyasz, seconded by Mr. McManis, that Resolution No. 2-1 be approved. Vote on the motion was ayes: Coble, Kurtz, McManis, Redding, Skoczen, Weaver and Zacharyasz. Nays: None. The motion carried. 3 REGULAR COUNCIL MEETING – February 2, 2026 ORDINANCE NO. 2-2: AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE TO ENTER INTO A CONTRACT WITH THE CUYAHOGA COUNTY DEPARTMENT OF PUBLIC WORKS TO PROVIDE CERTAIN SERVICES RELATIVE TO THE CITY SEWERS, AS DETERMINED FROM TIME-TO-TIME, TO FURTHER ADVANCE THE CITY’S SANITARY AND STORM SEWER MAINTENANCE PROGRAM, APPROPRIATING THE FUNDS THEREFORE, AND DECLARING AN EMERGENCY. The Clerk read the title of the Ordinance. Mr. Armagno explained that this is the annual agreement with the County that accepts assistance from the Department of Public Works with regard to sewer maintenance and other services. Proposed Ordinance No. 2-2 stands on first reading. ORDINANCE NO. 2-3: AN ORDINANCE ENACTING NEW CHAPTER 139, RECORDS COMMISSION, OF THE CODIFIED ORDINANCES OF THE CITY OF BEREA FOR THE EXPRESS PURPOSE OF EXERCISING HOME RULE AUTHORITY OVER THE COMPOSITION, FUNCTIONS, NOTICE, RETENTION AND DISPOSAL OF RECORDS, AND OTHER RULES FOR THE RETENTION AND DISPOSAL OF RECORDS. The Clerk read the title of the Ordinance. Mrs. Jones explained that the Records Commission is a function of State Law, but subject to home rule. The Records Commission, unlike other City Commissions, was never included in Chapter 139 of the Codified Ordinances. This Ordinance would add the Commission to Chapter 139 and, in the even that the State came in with a heavy hand, adoption establishes that the legislative authority of the City has expressed the intent to utilize home rule. Mrs. Jones added that the Commission meets twice a year to review the retention schedule and properly submit records for disposal. Proposed Ordinance No. 2-3 stands on first reading. REPORT AND COMMENTS BY THE PRESIDENT OF COUNCIL Mr. Maxwell had no report. REPORT AND COMMENTS BY THE MEMBERS OF COUNCIL Mr. McManis commented on a resident call that pertained to his service as a representative to the Southwest Healthcare System Board of Directors. Mr. Redding had no report. Mr. Skoczen referenced the upcoming budget discussions that will occur as Council prepares to adopt the 2026 final budget. He noted that he will reach out to Mrs. Morris for any pertinent information, and lean on the Court Committee in case any concerns are expressed by the Judge or Cleak DeMio. 4 REGULAR COUNCIL MEETING – February 2, 2026 Mrs. Weaver had no report. Mr. Zacharyasz had no report. Mrs. Coble thanked the City’s Business Outreach Department for introducing her to the owners of some businesses in the downtown area: Danilly Designs, Parkway Barber and Thrifting Tree. Mr. Kurtz thanked Norma Kleem and the entire Kleem family for their phenomenal blanket making event, adding that his kids enjoyed it and his daughter won the candy prize! CORRESPONDENCE The January 23, 2026 – January 27, 2026 Correspondence is available in the Clerk’s office. OTHER BUSINESS: Mrs. Esson reminded Council Members to file their financial disclosure by May 15, 2026, and thanked the Kurtz Family, particularly his daughter, Natalie, for the delicious Girl Scout Cookies that they gifted to all Council Members and City Directors. Moved by Mr. Skoczen, seconded by Mr. McManis, that the February 9, 2026 Work Session be cancelled. Vote on the motion was all ayes and no nays. The motion carried. There being no further business before Council, it was moved by Mr. Zacharyasz, and seconded by Mr. Kurtz, that the Regular Council Meeting be adjourned. Vote on the motion was all ayes and no nays.
