·city OF BROOK PARK, OHIO ORDINANCE NO. ______ _ INTRODUCED BY: MAYOR ORCUTT AN ORDINANCE AUTHORIZING THE DIRECTOR OF FINANCE TO ALLOW FOR PAYMENT OF EXPENDITURES FROM THE ECONOMIC DEVELOPMENT FUND 243 FOR EXPENSES RELATED TO THE lUJNTINGTON BANK FIELD AND MIXED~USE PROJECT CONSULTATIONS, REVIEWS, INSPECTIONS, AND TESTING SERVICES, AND DECLARING AN EMERGENCY WHEREAS, thei-e are tuimerous public and private infrastructure improvements being proposed for the Huntin.gton Bank Field and Mixed-Use Project (Project) that will promote economic opportunity within the City of Brook Park (City); and WHEREAS, the City has/will receive fu11dsfro:tn the ProjectDeveloper(s} and/ or Contractox(s). Said fu11ds can be used to reimbW:se the City for the l:ees and expenses related to the engineering consultations, reviews, inspections and testing services of proposed public and private infrastructure improvements being made as they relate to the Project;a11d _ -- __ WHEREAS, the Director of Finance requests that the monies be deposited into the Economic Development Fund, 243 for administration of_ the funds received or to be received from the Project Developer(s) and/ or Contractor(s). • • NOW THEREFORE, BE IT ORDAINED by the Council ofthe City of Brook Park, State; of Ohio, that: SECTION 1. SECTION 2. Expenditures include, but are ~1ot limited to, services provided by the Coi:-i:sulting City Engineer for t::owiultations, teviews, inspections; and testing as they relate to the Project and as directed by the City. SECTION 3. Expe11ditures may also include services that are to be detel'iilined and,are appropriate as they relate to the Project and are deemed to be in the bestinterest of the City and the Project; SECTION 4: It is £01~nd and deter.inined that all formal actions of this Cotlilcil concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, including Sectio11121.22 of the Ohio Revised Code. The City providing of Brook Park a job creation seeks to incentive incentivize this package totaling NOW THEREFORE BE IT RESOLVED, by the Council of the City of Brook Park, State of Ohio that: SECTION 1: The Council of the City of Brook Park, hereby formally approves of the incentives offered in Exhibit "A" and authorizes the Finance Director or their designee to issue the funding payments based on the outlined criteria until the total funds issued equals $100,000. SECTION 2: The money needed for the aforementioned incentives shall be paid from Fund 243 Economic Development Fund. SECTION 3: It is found and determined that all formal actions of this Council concerning and relating to this Resolution were adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees that resulted in such formal actions were in meetings open to the public in compliance with all legal requirements, including section 121.22 of the ofRrcl~E~I
