Cor,ne AN ORDINANCE AUTIIORIZING THE CONSULTING ENGINEER TO PREPARE AN APPLICATION TO PARTICIPATE IN THE YEÄR 2015 OHIO PUBLIC woRKS COMMISSION (OPWC) STATE CaPITAL IMPROVEMENTS PROGRAM FOR FINANCIAL ASSISTANCE ON TIIE SMITH ROAD SANITARY RELIEF SEWER PROJECT- PHASE 4 AND DECLARING AN EMERGENCY WIItrIREAS, the City of Brook Park desires to seek financial assistance frorn the State Issue I Infrastructure Bond Program for the funding of the Smith Road Sanitary Relief Sewer Project; WHEREAS, the existing sanitary sewers along Smith Road, south of Holland Road are undersized and pose a potential liealth hazard to the public, and WHEREAS, the City of Brook Park is planning to make capital improvements to the sanitary sewers within the City and tie into the 24-inch stubbed sanitary sewer under Srnith Road al the Holland Road intersection. NOW, THEREFORE BE IT ORDAINED by the Council of the City of Brook Park, State of Ohio, that: SECTION l: The Consulting Engineer is hereby authorized to prepare a Capital Improvements Report and Ohio Public Works Commission (OPWC) Application for Financial Assistance, for the Smith Road Sanitary Relief Sewer Project - Phase 4. The Consulting Engineer shall be paid a lump sum fee of$4,200.00. SECTION 2: The money needed to complete the afo¡esaid transaction shall be paid from funds theretofo¡e appropriated or to be appropriated for said purpose. SECTION 3: It is found and determincd that all formal actions of this Council conceming and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees that ¡esulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Codc.
SE_ÇTIAN 4: This Ordinance is hereby declared to be an emorgency rneasure necessary for the imrnediate preservation of the public peace, health, safety of said City, therefore, this Ordinance shall take effect and bc in force immediately from and after its passage aud approval by the Mayor.
