CITY OF BROOKLYN, OHIO RESOLUTION NO. 2025-20 INTRODUCED BY: Mayor Van Kirk, Borowski, Tanski, Grodek, Pucci, Coyle, Celcherts, Mosley A RESOLUTION ASSESSING UNPAID COSTS OF ABATING NUISANCE AND HAZARD VIOLATIONS OF SECTION 521.14 OF THE CODIFIED ORDINANCES OF THE CITY OF BROOKLYN, OHIO, AND DECLARING AN EMERGENCY WHEREAS, Section 521.14 of the Codified Ordinances of the City of Brooklyn, Ohio requires all property owners to maintain their lots and keep them free from any noxious weeds, common weeds and grass; and WHEREAS, Section 521.14(a) outlines the procedures that the city must follow in the event that any property is not properly maintained; and WHEREAS, the city has properly followed all procedures in Section 521.14 and has determined that certain property owners have failed to comply with Section 521.14(a) and (b); and WHEREAS, the city has expended manpower and resources to bring certain properties into compliance and has followed all procedures to issue invoices to the various property owners for payment of the cost of such maintenance performed by the city, which invoices have remained unpaid; and WHEREAS, Section 521.14(c) outlines the procedure the City shall follow with respect to recovery of the fees expended by the City. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CI1Y OF BROOKLYN, COUN1Y OF CUYAHOGA AND STATE OF OHIO: Section 1. That for the purpose of recovering the costs and expenses incurred by the City in abating nuisances, by repairing exterior building violations on each parcel of land, there is hereby levied and assessed upon the following described properties (Exhibit A), situated in the City of Brooklyn. A copy of these assessments is attached hereto as Exhibit A and incorporated as of fully rewritten. Section 2. That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this Resolution were adopted in an open meeting of this Council, and that all deliberations of the Brooklyn City Council and any of its committees and/or boards that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 3. That this Resolution is hereby declared to be an emergency measure dealing with the daily operation of the city; and provided it receives the affirmative vote of two-thirds (2/3) of all members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise, it shall take effect and be in force from and after the earliest period allowed by law.
