CITY OF BROOKLYN, OHIO RESOLUTION NO: 2025 -3 ; INTRODUCED BY: Mayor Van Kirk , Coy!¢, Ceicherts, Mosley, Avrowsles, Tansy, Grodek, Preey AUTHORIZING THE REINSTATEMENT OF THE SENIOR GRASS CUTTING PROGRAM AS A PILOT PROGRAM FOR 2025, ESTABLISHING REQUIREMENTS AND FEES THEREFOR, AND DECLARING AN EMERGENCY WHEREAS, the City of Brooklyn desires to reinstate the service whereby the City causes senior citizens’ and disable citizens’ grass to be cut, as the program is beneficial to the elderly and disabled and protective of their health; and WHEREAS, the senior grass cutting program, reinstated as part of a pilot program, will allow Council and the Administration to evaluate the effectiveness of such a program before any permanent legislation might be created; and WHEREAS, the Council finds, determines and declares that this resolution is promulgated under the general police power of the City under the Ohio Constitution, for the preservation of the public peace, health, safety and general welfare and that it is in the best interests of the City, its inhabitants and visitors; and WHEREAS, in light of the fact that the City must promulgate the registration forms necessary to implement the 2025 senior grass cutting pilot program on a timely basis, this resolution is declared an emergency; - NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CliY OF BROOKLYN, COUNTY OF CUYAHOGA AND STATE OF OHIO: Section 1. That the Mayor is hereby authorized to establish and implement, as a pilot program for the calendar year 2025, a senior grass cutting program according to the following regulations: A. Any property receiving services under the program must be located in the City of Brooklyn and must be a single-family dwelling. B. The registrant and any occupants of any property receiving services under the program at all times must either be an owner, or have a familial relationship with the owner, or be the beneficiary of a trust whose trustee owns the property. C. The registrant and all occupants of any property receiving services under the program must be either (i) not less than 65 years of age as of May 1, 2025; or (ii) an individual with a disability that significantly limits the registrant’s ability to do work-related activities, such as lifting, standing, walking, sitting or remembering for the last 12 months. D. On forms promulgated by the Mayor, the registrant, on behalf of himself or herself and all owners and occupants, must release the City and its servants, agents and employees from any liability arising from the services provided on the registrant’s property. E. Registrants otherwise qualified for the program must also not exceed the following gross annual income limits based on the number of persons living in the household: one person, $37,650.00; two persons, $51,100.00; three persons, $64,500.00. F. Registrants shall pay a fee of $100.00 with their applications, and an additional $25.00 late fee in the event any application is submitted after March 31, 2025. Payment shall be made at the Senior Center. G. Services under the program shall be provided from the week of May 12 through the week of August 19, 2025. H. The Mayor is authorized to promulgate other rules and regulations to be made a part of the program not inconsistent herewith, and approved registrants shall follow all such rules, failing which services may no longer be provided and without refund or credit. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this resolution were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code. Section 3. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble, and provided it receives the affirmative vote of two-thirds (2/3) of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise, it shall take effect and be in force from and after the earliest period allowed by law.
