CITY OF WESTLAKE, OHIO 1 ORDINANCE NO. 2026-13: 2 3 AN ORDINANCE AUTHORIZING THE MAYOR 4 TO PURCHASE FITNESS EQUIPMENT FOR 5 THE DEPARTMENT OF RECREATION, AND 6 DECLARING AN EMERGENCY. 7 ______________________________________________________________________________ 8 9 WHEREAS, this Council, by Ordinance No. 2026-1, has previously authorized the City 10 to continue to participate in various governmental cooperative programs, including Sourcewell 11 Cooperative Purchasing Program; and 12 13 WHEREAS, the Director of Purchasing has advised this Council that the City can 14 purchase Precor fitness equipment, needed by the Department of Recreation, through the 15 Sourcewell Cooperative Purchasing Program, Contract No. 052324-PCR, from Health & Fitness 16 Equipment Centers (with possible Trade-in). 17 18 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 19 WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO: 20 21 Section 1: That the Mayor be and he hereby is authorized to purchase Precor fitness 22 equipment, through the Sourcewell Cooperative Purchasing Program, Contract No. 052324-PCR, 23 needed by the Department of Recreation from Health & Fitness Equipment Centers (with possible 24 Trade-in): 25 26 Qty. Description Co-op Cost 3 2 3 2 Precor TRM 895 Treadmills Precor Breakaway STM 897 Treadmills Precor RBK Recumbent Bikes Precor UBK 885 Upright Bikes (Including 5-year labor boost protection plan at no additional cost) Sourcewell $113,305.68 Offered Trade-in: 5 Treadmills, 3 Recumbent Bikes & 2 Upright Bikes ($1,500.00)

CITY OF WESTLAKE, OHIO ORDINANCE NO. 2026-13 PAGE 2 Section 2: That the Director of Finance be and he hereby is authorized and directed to 27 issue warrants of the City of Westlake for said fitness equipment to the supplier listed in Section 28 1 above in an amount not to exceed the sum of One Hundred Thirteen Thousand Five Hundred 29 Dollars and Zero Cents ($113,500.00). 30 31 Section 3: That it is found and determined that all formal actions of this Council 32 concerning and relating to this legislation were adopted in an open meeting of this Council and 33 that all deliberations of this Council and of any of its committees that resulted in such formal action 34 were in meetings open to the public in compliance with all legal requirements including Section 35 10, Article XI of the Charter of the City of Westlake and Section 121.22 of the Ohio Revised Code. 36 Section 4: That this legislation is hereby declared to be an emergency measure 37 immediately necessary for the preservation of the public health, safety and welfare, and for the 38 further reason that it is immediately necessary to continue the efficiency of the Department of 39 Recreation, and further provided it receives the affirmative vote of two-thirds of all members 40 elected to Council, it shall take effect and be in force immediately upon its passage and approval 41 by the Mayor. 42 43 Passed: ____________________________________ 44 David S.
