1 CITY OF WESTLAKE, OHIO 2 ORDINANCE NO. 2026-14: 3 4 AN ORDINANCE AUTHORIZING THE MAYOR 5 TO ENTER INTO A CONTRACT WITH JOHNSON- 6 LAUX CONSTRUCTION OHIO, LLC FOR THE 7 RECREATION CENTER NATATORIUM 8 RENOVATION PROJECT THROUGH GORDIAN’S 9 COUNCIL OF GOVERNMENTS COOPERATIVE 10 PURCHASING PROGRAM, AND DECLARING AN 11 EMERGENCY. 12 ______________________________________________________________________________ 13 14 WHEREAS, the Home Rule powers of the Ohio Constitution grant power to the City to 15 participate in joint purchasing programs; and 16 WHEREAS, Gordian is a national program that assists local agencies in reducing the costs 17 of purchased goods and services through their competitively solicited contracts; and 18 WHEREAS, this Council, by Ordinance No. 2026-1, has previously authorized the City 19 to continue to participate in various governmental cooperative programs; and 20 WHEREAS, the Mayor and the Director of Engineering have advised this Council that the 21 City can enter into a contract with Johnson-Laux Construction Ohio, LLC for the Recreation 22 Center Natatorium Renovation Project through Gordian’s Council of Governments Cooperative 23 Purchasing Program. 24 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 25 WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO: 26 Section 1: That the Mayor be and he is hereby authorized and directed to enter into a 27 contract with Johnson-Laux Construction Ohio, LLC for the Recreation Center Renovation 28 Project, which contract shall be kept on file in the Departments of Engineering and Finance in a 29 form as approved by the Director of Law, as follows: 30 CITY OF WESTLAKE, OHIO ORDINANCE NO. 2026-14 PAGE 2 31 32 Section 2: That the Director of Finance is hereby authorized and directed to issue 33 warrants of the City of Westlake to Johnson-Laux Construction Ohio, LLC in an amount not to 34 exceed One Million Seven Hundred Thirty-Two Thousand Seven Hundred Ninety Dollars and 35 Zero Cents ($1,732,790.00), when approved by the Mayor and the Director of Engineering. 36 Section 3: That it is found and determined that all formal actions of this Council 37 concerning and relating to this legislation were adopted in an open meeting of this Council and 38 that all deliberations of this Council and of any of its committees that resulted in such formal action 39 were in meetings open to the public in compliance with all legal requirements including Section 40 10, Article XI of the Charter of the City of Westlake and Section 121.22 of the Ohio Revised Code. 41 Section 4: That this legislation is hereby declared to be an emergency measure 42 immediately necessary for the preservation of the public health, safety and welfare, and for the 43 further reason that it is immediately necessary to begin the Recreation Center Natatorium 44 Renovation Project for the safe and efficient functioning of City facilities, and further provided it 45 receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect 46 and be in force immediately upon its passage and approval by the Mayor. 47 48 Passed: ____________________________________ 49 David S.
