1 CITY OF WESTLAKE, OHIO 2 ORDINANCE NO. 2026-21: 3 4 AN ORDINANCE AUTHORIZING THE MAYOR TO 5 ENTER INTO AN ELECTRIC AGGREGATION 6 CONTRACT WITH DYNEGY ENERGY SERVICES 7 (EAST) LLC DBA DYNEGY ENERGY SERVICES, 8 LLC FOR THE SUPPLY OF ELECTRIC SERVICES 9 TO THE INHABITANTS OF THE CITY OF 10 WESTLAKE, AND DECLARING AN EMERGENCY. 11 ______________________________________________________________________________ 12 13 WHEREAS, on November 5, 2002, the Electors of the City of Westlake voted to approve 14 the City’s authority to aggregate for the provision of competitive retail electric service; and 15 WHEREAS, the City’s contract with Energy Harbor expires in May 2026; and 16 WHEREAS, the Mayor and Director of Purchasing, in conjunction with the City’s 17 representative, Strategic Aggregation Consultants, recommend that a new aggregation contract be 18 entered into with Dynegy Energy Services (East) LLC dba Dynegy Energy Services, LLC for the 19 supply of electric services to the inhabitants of the City of Westlake. 20 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 21 WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO: 22 Section 1: That the Mayor be and he is hereby authorized and directed to enter into a 23 contract with Dynegy Energy Services (East) LLC dba Dynegy Energy Services, LLC for the 24 supply of electric services to the inhabitants of the City of Westlake as set forth in the contract 25 which shall be kept on file in the Departments of Finance and Purchasing. 26 Section 2: That it is found and determined that all formal actions of this Council 27 concerning and relating to this legislation were adopted in an open meeting of this Council and 28 that all deliberations of this Council and of any of its committees that resulted in such formal action 29 were in meetings open to the public in compliance with all legal requirements including Section 30 10, Article XI of the Charter of the City of Westlake and Section 121.22 of the Ohio Revised Code. 31 Section 3: That this legislation is hereby declared to be an emergency measure 32 immediately necessary for the preservation of the public health, safety and welfare, and for the 33 further reason that it is immediately necessary to establish a new program for competitive utility 34 CITY OF WESTLAKE, OHIO ORDINANCE NO. 2026-21 PAGE 2 services prior to May, 2026, and further provided it receives the affirmative vote of two-thirds of 35 all members elected to Council, it shall take effect and be in force immediately upon its passage 36 and approval by the Mayor. 37 38 Passed: ____________________________________ 39 David S.
