1 CITY OF WESTLAKE, OHIO 2 ORDINANCE NO. 2026-25: 3 AN ORDINANCE CONSIDERING 4 A CONDITIONAL USE PERMIT 5 FOR A PRE-SCHOOL. 6 ______________________________________________________________________________ 7 8 WHEREAS, Leon Sampat, Representative of Rise School, has submitted a request to the 9 Council of the City of Westlake, Ohio, for a Conditional Use Permit for the property at 1299 10 Columbia Road, Westlake, Ohio (Permanent Parcel No. 213-24-030) for a pre-school; and 11 WHEREAS, after receiving the current application, the application was sent to the 12 Planning Commission for its review, and the Planning Commission recommended 13 __________________ of the Conditional Use Permit with certain conditions; and 14 WHEREAS, this Council provided and held a Public Hearing on the application for the 15 Conditional Use Permit. 16 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 17 WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO: 18 Section 1: That this Council does hereby approve the application of Rise School for a 19 Conditional Use Permit for the property at 1299 Columbia Road, Westlake, Ohio (Permanent 20 Parcel No. 213-24-030) for a pre-school, which said use is to be conditioned only within the areas 21 located within the address described in this Ordinance. 22 Section 2: That this Conditional Use Permit application is approved upon the 23 following terms and conditions: 24 25 Section 3: That the approval of this Conditional Use Permit shall become null and void 26 if the operation of the conditional use permit is contrary to law and/or the conditions of this 27 Ordinance and the Conditional Use Permit shall not be transferable to another location without a 28 new Conditional Use Permit being obtained but would be transferable at the location described in 29 Section 1 hereof to a new owner subject to all the terms and conditions thereof. 30 Section 4: That it is found and determined that all formation actions of this Council 31 concerning and relating to this legislation were adopted in an open meeting of this Council and 32 that all deliberations of this Council and any of its committees that resulted in such formal action 33 CITY OF WESTLAKE, OHIO ORDINANCE NO. 2026-25 PAGE 2 were in meetings open to the public in compliance with all legal requirements including Section 34 10, Article XI of the Charter of the City of Westlake and Section 121.22 of the Ohio Revised Code. 35 Section 5: That this Ordinance shall take effect and be in force from and after the 36 earliest period allowed by law. 37 38 First Reading: _____________ 39 40 Referred to Planning Commission: __________________ 41 Report of Planning Commission on: _______________________ 42 The Planning Commission recommended to Council that this Ordinance be: 43 44 Approved: _____ Disapproved: _____ 45 46 Second Reading: _______________ 47 48 Public Hearing: ________________ 49 50 Passed: ____________________________________ 51 David S.
