1 CITY OF WESTLAKE, OHIO 2 ORDINANCE NO. 2026-28: 3 4 AN ORDINANCE ACCEPTING VARIOUS BIDS AND 5 AUTHORIZING THE MAYOR TO ENTER INTO 6 VARIOUS CONTRACTS FOR THE PURCHASE OF 7 STONE, SAND, DIRT AND GRAVEL FOR VARIOUS 8 PROJECTS IN THE CITY OF WESTLAKE, AND 9 DECLARING AN EMERGENCY. 10 ___________________________________________________________________________ 11 12 WHEREAS, pursuant to an advertisement which appeared in a newspaper of general 13 circulation, the City received seven (7) bid proposals for the purchase of stone, sand, dirt and 14 gravel for various projects in the City of Westlake, pursuant to specifications on file in the office 15 of the Director of Purchasing; and 16 17 WHEREAS, after careful analysis of such bid proposals received, the Mayor and the 18 Director of Purchasing have recommended that Council accept the bid proposals as set forth in 19 Section 1 herein for the aforesaid stone, sand, dirt and gravel; and 20 WHEREAS, this Council hereby finds and determines that the bid proposals are the lowest 21 and best bid proposals for the aforesaid purchases; and 22 WHEREAS, this Council hereby accepts the bid proposals set forth in Section 1 herein 23 and rejects all other proposals. 24 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 25 WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO: 26 Section 1: That this Council does hereby accept the following bids for the purchase of 27 stone, sand, dirt and gravel as needed by the City for one (1) year for repairs to be performed on 28 various projects in the City of Westlake as set forth herein in the amounts set forth in the bid 29 proposals of each successful bidder: 30 Item # Category Bidder A2, A3, A5 Stone & Gravel Amrize Great Lakes, Inc. 2016 West 3rd Street Cleveland, Ohio 44113 A1, A4, A7 Stone & Gravel Area Aggregates, LLC 4755 South High Street Columbus, Ohio 43207 CITY OF WESTLAKE, OHIO ORDINANCE NO. 2026-28 PAGE 2 A6 Stone & Gravel Leach Excavating 7304 Glenside Lane Olmsted Township, Ohio 44138 B1-B6 Sand C1-C2 Dirt 31 Section 2: That the Mayor be and he hereby is authorized and directed to enter into 32 contracts with the companies identified in Section 1 herein, which contracts shall be in 33 accordance with the contract documents on file in the office of the Director of Purchasing. 34 Section 3: That the Director of Finance be and he hereby is authorized and directed to 35 issue warrants of the City of Westlake made payable to the companies identified in Section 1 herein 36 when invoices are submitted and approved by the Mayor. 37 Section 4: That it is found and determined that all formal actions of this Council 38 concerning and relating to this legislation were adopted in an open meeting of this Council and 39 that all deliberations of this Council and of any of its committees that resulted in such formal action 40 were in meetings open to the public in compliance with all legal requirements including Section 41 10, Article XI of the Charter of the City of Westlake and Section 121.22 of the Ohio Revised Code. 42 Section 5: That this legislation is hereby declared to be an emergency measure 43 immediately necessary for the preservation of the public health, safety and welfare, and for the 44 further reason that it is immediately necessary to continue the efficiency of the various City 45 Department’s repairs and projects, and further provided it receives the affirmative vote of two- 46 thirds of all members elected to Council, it shall take effect and be in force immediately upon its 47 passage and approval by the Mayor. 48 49 Passed: ____________________________ ________________________________ 50 David S.
