1 CITY OF WESTLAKE, OHIO 2 ORDINANCE NO. 2026-29: 3 4 AN ORDINANCE ACCEPTING VARIOUS BIDS AND 5 AUTHORIZING THE MAYOR TO ENTER INTO 6 VARIOUS CONTRACTS FOR THE PURCHASE OF 7 ASPHALT CONCRETE AND BITUMINOUS COLD 8 MIX, AND DECLARING AN EMERGENCY. 9 ______________________________________________________________________________ 10 11 WHEREAS, pursuant to authorization of Council, and the Charter and Ordinances of the 12 City of Westlake, and after advertisement in a newspaper of general circulation, the City received 13 four (4) bids for the purchase of various supplies needed by the Service Department, in accordance 14 with the specifications on file in the Office of the Director of Purchasing; and 15 WHEREAS, after a careful analysis of said bid proposals, the Mayor and Director of 16 Purchasing have recommended that Council accept the bid proposals as set forth in Section 1 17 herein for Asphalt Concrete and Bituminous Cold Mix; and 18 WHEREAS, this Council hereby finds and determines that the bid proposals are the lowest 19 and best bid proposals for the aforesaid purchases; and 20 WHEREAS, this Council hereby accepts the bid proposals set forth in Section 1 herein 21 and rejects all other proposals. 22 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 23 WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO: 24 Section 1: That this Council does hereby accept the following bids for the purchase of 25 asphalt concrete and bituminous cold mix as needed by the City for one (1) year for repairs to be 26 performed by the Service Department on various streets in the City of Westlake in the amounts as 27 set forth herein: 28 Item # Description Cost Per Ton Bidder 2.4.A "#448 Type I" ASPHALT CONCRETE $85.00 Stoneco, Inc. dba Allied Corporation 8920 Canyon Falls Blvd., Suite 120 Twinsburg, Ohio 44087 2.4.B "#448 Type II" ASPHALT CONCRETE $91.50 CITY OF WESTLAKE, OHIO ORDINANCE NO. 2026-29 PAGE 2 2.4.C BITUMINOUS COLD MIX "DELIVERED" $125.00 Unique Paving Materials Corp. 3993 East 93rd Street Cleveland, Ohio 44105 29 Section 2: That the Mayor be and he hereby is authorized and directed to enter into 30 contracts with the companies identified in Section 1 herein, which contracts shall be in accordance 31 with the contract documents on file in the office of the Director of Purchasing. 32 33 Section 3: That the Director of Finance be and he hereby is authorized and directed to 34 issue warrants of the City of Westlake made payable to the companies identified in Section 1 herein 35 when invoices are submitted and approved by the Mayor and the Director of Public Service. 36 Section 4: That it is found and determined that all formal actions of this Council 37 concerning and relating to this legislation were adopted in an open meeting of this Council and 38 that all deliberations of this Council and of any of its committees that resulted in such formal action 39 were in meetings open to the public in compliance with all legal requirements including Section 40 10, Article XI of the Charter of the City of Westlake and Section 121.22 of the Ohio Revised Code. 41 Section 5: That this legislation is hereby declared to be an emergency measure 42 immediately necessary for the preservation of the public health, safety and welfare, and for the 43 further reason that it is immediately necessary to continue the efficiency of the Service Department 44 as to street repairs, and further provided it receives the affirmative vote of two-thirds of all 45 members elected to Council, it shall take effect and be in force immediately upon its passage and 46 approval by the Mayor. 47 Passed: ____________________________ ________________________________ 48 David S.
