1 CITY OF WESTLAKE, OHIO 2 ORDINANCE NO. 2026-2: 3 AN ORDINANCE AUTHORIZING THE 4 DIRECTOR OF FINANCE TO PAY TO THE 5 CITY OF CLEVELAND, DIVISION OF 6 WATER, THE CITY OF WESTLAKE'S 7 ANNUAL CHARGE FOR FIRE HYDRANT 8 USAGE, AND DECLARING AN EMERGENCY. 9 ______________________________________________________________________________ 10 11 WHEREAS, the City of Westlake has received an Invoice from the City of Cleveland for 12 the City of Westlake's annual charge for fire hydrant usage; and 13 WHEREAS, the Mayor has requested that this Council approve the expenditure and 14 authorize payment of the invoiced amount of Sixty-Nine Thousand Seven Hundred Fifty-Four 15 Dollars and Fifty-Two Cents ($69,754.52) for the use of two thousand five hundred ninety-six 16 (2,596) fire hydrants; and 17 WHEREAS, this Council desires to approve the amount invoiced and authorize the 18 payment thereof. 19 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 20 WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO: 21 Section 1: That this Council does hereby approve the Invoice of the City of Cleveland, 22 Division of Water, for the City of Westlake's charge for fire hydrant usage in the amount of Sixty- 23 Nine Thousand Seven Hundred Fifty-Four Dollars and Fifty-Two Cents ($69,754.52). 24 Section 2: That the Director of Finance be and he is hereby authorized and directed to 25 pay to the Cleveland Water Department, the amount of Sixty-Nine Thousand Seven Hundred Fifty- 26 Four Dollars and Fifty-Two Cents ($69,754.52), pursuant to the aforesaid Invoice. 27 Section 3: That it is found and determined that all formal actions of this Council 28 concerning and relating to this legislation were adopted in an open meeting of this Council and 29 that all deliberations of this Council and of any of its committees that resulted in such formal action 30 were in meetings open to the public in compliance with all legal requirements including Section 31 10, Article XI of the Charter of the City of Westlake and Section 121.22 of the Ohio Revised Code. 32 CITY OF WESTLAKE, OHIO ORDINANCE NO. 2026-2 PAGE 2 Section 4: That this legislation is hereby declared to be an emergency measure 33 immediately necessary for the preservation of the public health, safety and welfare, and for the 34 further reason that it is immediately necessary to provide for the safety of the citizens of Westlake 35 by prompt payment of hydrant usage fees, and further provided it receives the affirmative vote of 36 two-thirds of all members elected to Council, it shall take effect and be in force immediately upon 37 its passage and approval by the Mayor. 38 39 Passed: ____________________________________ 40 David S.
