1 CITY OF WESTLAKE, OHIO 2 ORDINANCE NO. 2026-30: 3 4 5 AN ORDINANCE ACCEPTING A BID AND 6 AUTHORIZING THE MAYOR TO ENTER INTO 7 A CONTRACT WITH BUILDERS CONCRETE 8 SUPPLY FOR THE PURCHASE OF CONCRETE 9 AND RELATED MATERIALS, AND 10 DECLARING AN EMERGENCY. 11 ___________________________________________________________________________ 12 13 WHEREAS, pursuant to authorization of Council, and the Charter and Ordinances of the 14 City of Westlake, and after advertisement in a newspaper of general circulation, the City received 15 four (4) bids for the purchase of concrete and related materials, in accordance with the 16 specifications on file in the Office of the Director of Purchasing; and 17 WHEREAS, after a careful analysis of said bid proposals, the Mayor and Director of 18 Purchasing have recommended the award of said Contract to Builders Concrete Supply; and 19 WHEREAS, the Council hereby finds and determines that the bid proposal is the lowest 20 and best bid proposal for the aforesaid purchases; and 21 WHEREAS, this Council hereby accepts the bid set forth in Section 1 herein and rejects 22 all other proposals. 23 24 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 25 WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO: 26 Section 1: That this Council does hereby accept the bid of Builders Concrete Supply 27 for the purchase of concrete and related materials as needed by the City for one (1) year for repairs 28 to be performed by the Service Department on various streets and sidewalks in the City of 29 Westlake in accordance with the bid specifications on file in the Department of Purchasing. 30 Section 2: That the Director of Finance be and he hereby is authorized and directed to 31 issue warrants of the City of Westlake made payable to Builders Concrete Supply when invoices 32 are submitted and approved by the Mayor and the Director of Public Service. 33 34

CITY OF WESTLAKE, OHIO ORDINANCE NO. 2026-30 PAGE 2 35 Section 3: That it is found and determined that all formal actions of this Council 36 concerning and relating to this legislation were adopted in an open meeting of this Council and 37 that all deliberations of this Council and of any of its committees that resulted in such formal action 38 were in meetings open to the public in compliance with all legal requirements including Section 39 10, Article XI of the Charter of the City of Westlake and Section 121.22 of the Ohio Revised Code. 40 Section 4: That this legislation is hereby declared to be an emergency measure 41 immediately necessary for the preservation of the public health, safety and welfare, and for the 42 further reason that it is immediately necessary to continue the efficiency of the Service Department 43 as to necessary repairs and projects, and further provided it receives the affirmative vote of two- 44 thirds of all members elected to Council, it shall take effect and be in force immediately upon its 45 passage and approval by the Mayor. 46 47 48 Passed: ____________________________ ________________________________ 49 David S.
