1 CITY OF WESTLAKE, OHIO 2 ORDINANCE NO. 2026-36: 3 4 AN ORDINANCE ACCEPTING THE 5 REMNANT DEFENDANTS SETTLEMENT 6 WITH VARIOUS OPIOID DISTRIBUTORS, 7 AND DECLARING AN EMERGENCY. 8 ______________________________________________________________________________ 9 10 WHEREAS, opioid distributors, Associated Pharmacies, Inc. (and American Associated 11 Pharmacies), J M Smith Corporation, Louisiana Wholesale Drug Company, Inc., Morris and 12 Dickson Co., North Carolina Mutual Wholesale Drug Company, Inc. and United Natural Foods, 13 Inc. (including its subsidiaries SuperValu and Advantage Logistics) (“Six Remnant Defendants”), 14 have proposed a joint settlement (“Remnant Defendants Settlement”) to the State of Ohio and its 15 political subdivisions pertaining to the Distributors’ share of the distribution of opioids that was a 16 significant cause of the national opioid crisis that lead to mass addiction and overdose deaths that 17 affected both the State of Ohio and the City of Westlake; and 18 WHEREAS, Council desires to authorize the Law Director to accept the Remnants 19 Defendants Settlement and execute all necessary legal documents. 20 21 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 22 WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO: 23 24 Section 1: Council hereby accepts the Remnants Defendants Settlement and authorizes 25 the Law Director to execute all necessary legal documents in accordance with the terms of the 26 Remnants Defendants Settlement Agreement and procedures. 27 28 Section 2: That it is found and determined that all formal actions of this Council 29 concerning and relating to this legislation were adopted in an open meeting of this Council and 30 that all deliberations of this Council and of any of its committees that resulted in such formal action 31 were in meetings open to the public in compliance with all legal requirements including Section 32 10, Article XI of the Charter of the City of Westlake and Section 121.22 of the Ohio Revised Code. 33 34 Section 3: That this legislation is hereby declared to be an emergency measure 35 immediately necessary for the preservation of the public health, safety and welfare, and for the 36 further reason that it is immediately necessary to ensure prompt pursuit of funds to assist in abating 37 the opioid epidemic in Ohio, and further provided it receives the affirmative vote of two-thirds of 38
