1 CITY OF WESTLAKE, OHIO 2 ORDINANCE NO. 2026-38: 3 REDLINED 4 AN ORDINANCE AMENDING SECTION 2 OF 5 ORDINANCE NO. 2025-21 AS TO A CONTRACT 6 WITH SET IN STONE FOR THE 2025 SIDEWALK 7 REPAIR PROGRAM FOR THE CITY OF 8 WESTLAKE, AND DECLARING AN EMERGENCY. 9 ______________________________________________________________________________ 10 11 WHEREAS, pursuant to Ordinance No. 2025-21, Council accepted the bid and authorized 12 the Mayor to enter into a contract with Set in Stone for the 2025 Sidewalk Repair Program; and 13 WHEREAS, the Mayor and Director of Engineering recommend Section 2 of Ordinance 14 No. 2025-21 be amended to provide additional funds for completion of the project. 15 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 16 WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO: 17 Section 1: That Section 2 of Ordinance No. 2025-21 be and the same is hereby 18 amended and as amended shall read as follows: 19 “Section 2: That the Director of Finance is hereby authorized and directed 20 to issue warrants of the City of Westlake to Set in Stone in an amount not to exceed 21 One Two Million Six Seven Hundred Eighty-Seven Thousand Three Hundred 22 Dollars and Zero Cents ($1,687,300.002,700,000.00) when approved by the Mayor 23 and the Director of Engineering.” 24 Section 2: That it is found and determined that all formal actions of this Council 25 concerning and relating to this legislation were adopted in an open meeting of this Council and 26 that all deliberations of this Council and of any of its committees that resulted in such formal action 27 were in meetings open to the public in compliance with all legal requirements including Section 28 10, Article XI of the Charter of the City of Westlake and Section 121.22 of the Ohio Revised Code. 29 Section 3: That this legislation is hereby declared to be an emergency measure 30 immediately necessary for the preservation of the public health, safety and welfare, and for the 31 further reason that it is immediately necessary to complete the 2025 Sidewalk Repair Program, 32 and further provided it receives the affirmative vote of two-thirds of all members elected to 33
