1 CITY OF WESTLAKE, OHIO 2 ORDINANCE NO. 2026-39: 3 4 AN ORDINANCE AUTHORIZING THE MAYOR 5 TO ENTER INTO A STORM WATER DRAINAGE 6 SYSTEMS AGREEMENT WITH RL DOVER LLC, 7 AND DECLARING AN EMERGENCY. 8 ______________________________________________________________________________ 9 10 WHEREAS, RL Dover LLC has agreed to provide an Inspection and Maintenance of 11 Storm Water Drainage Systems with Best Management Practices Agreement for Dover Village 12 Townhomes on its property located at Permanent Parcel No. 217-06-033 to benefit the City of 13 Westlake; and 14 WHEREAS, the Mayor and Director of Engineering hereby recommend that Council 15 authorize the Mayor to accept said agreement. 16 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 17 WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO: 18 19 Section 1: That the Mayor be and he hereby is authorized and directed to enter into an 20 Inspection and Maintenance of Storm Water Drainage Systems with Best Management Practices 21 Agreement with RL Dover LLC, for Dover Village Townhomes located at Permanent Parcel No. 22 217-06-033, which Agreement shall be kept on file with the Director of Engineering, with such 23 changes as may be made by the Director of Law without changing the substance thereof. 24 25 Section 2: That it is found and determined that all formal actions of this Council 26 concerning and relating to this legislation were adopted in an open meeting of this Council and 27 that all deliberations of this Council and of any of its committees that resulted in such formal action 28 were in meetings open to the public in compliance with all legal requirements including Section 29 10, Article XI of the Charter of the City of Westlake and Section 121.22 of the Ohio Revised Code. 30 31 Section 3: That this legislation is hereby declared to be an emergency measure 32 immediately necessary for the preservation of public health, safety and welfare, and for the further 33 reason that it is immediately necessary to provide for a Storm Water Drainage System, and further 34 provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall 35 take effect and be in force immediately upon its passage and approval by the Mayor. 36 37 38 CITY OF WESTLAKE, OHIO ORDINANCE NO. 2026-39 PAGE 2 39 Passed: ____________________________________ 40 David S.
