1 CITY OF WESTLAKE, OHIO 2 ORDINANCE NO. 2026-40: 3 4 AN ORDINANCE AUTHORIZING THE MAYOR 5 TO ENTER INTO AN AMENDED SANITARY 6 SEWER/WATER CONNECTION AGREEMENT, 7 AND DECLARING AN EMERGENCY. 8 ______________________________________________________________________________ 9 10 WHEREAS, the Sanitation Committee of Council has recommended that the Mayor enter 11 into an amended Sewer/Water Connection Agreement with CupCo LLC for the property known 12 as 31660 Hilliard Boulevard; and 13 WHEREAS, Council desires to authorize the Mayor to enter into said amended agreement. 14 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 15 WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO: 16 Section 1: That the Mayor be and he is hereby authorized and directed to enter into an 17 amended agreement for a sanitary sewer/water connection with CupCo LLC for the property 18 located at 31660 Hilliard Boulevard, which amended agreement shall be kept on file in the 19 Departments of Finance and Engineering. 20 Section 2: That it is found and determined that all formal actions of this Council 21 concerning and relating to this legislation were adopted in an open meeting of this Council and 22 that all deliberations of this Council and of any of its committees that resulted in such formal action 23 were in meetings open to the public in compliance with all legal requirements including Section 24 10, Article XI of the Charter of the City of Westlake and Section 121.22 of the Ohio Revised Code. 25 Section 3: That this legislation is hereby declared to be an emergency measure 26 immediately necessary for the preservation of the public health, safety and welfare, and for the 27 further reason that it is immediately necessary to allow for sanitary sewer and water connection to 28 said property, and further provided it receives the affirmative vote of two-thirds of all members 29 elected to Council, it shall take effect and be in force immediately upon its passage and approval 30 by the Mayor. 31 32 33 34 35 CITY OF WESTLAKE, OHIO ORDINANCE NO. 2026-40 PAGE 2 36 Passed: ____________________________________ 37 David S.
