1 2 CITY OF WESTLAKE, OHIO 3 ORDINANCE NO. 2026-42: 4 5 6 AN ORDINANCE AUTHORIZING THE MAYOR 7 TO ENTER INTO A RENEWAL AGREEMENT 8 FOR THE ADMINISTRATION OF THE CITY OF 9 WESTLAKE GROUP HEALTH PLAN, AND 10 DECLARING AN EMERGENCY. 11 ______________________________________________________________________________ 12 13 WHEREAS, on March 1, 2013, the parties entered into a Master Administration Service 14 Agreement for the administration of the City’s group health plan by Simplifi Health Benefit 15 Management, LLC, as assigned to America’s Choice Healthplans, LLC, as amended; and 16 WHEREAS, the Mayor and Director of Finance have recommended that Council 17 authorize the Mayor to enter into a renewal agreement including all amendments, for 18 administration of the City’s group health plan. 19 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 20 WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO: 21 Section 1: That this Council does hereby authorize the Mayor to enter into a renewal 22 agreement, including all amendments, with America’s Choice Healthplans, LLC to administer the 23 City of Westlake Group Health plan, which said renewal agreement is on file with the Director of 24 Finance. 25 Section 2: That this Council finds that, pursuant to Article V, Section 5 (b) of the 26 Charter of the City of Westlake, this renewal agreement is exempted from competitive bidding 27 requirements as a personal services contract. 28 Section 3: That the amount to be paid to America’s Choice Healthplans, LLC for its 29 administration services and fee shall be for each covered employee per month and shall not exceed 30 the amounts set forth in the contract documents on file with the Director of Finance. 31 Section 4: That the term of said renewal agreement shall be from May 1, 2026 through 32 April 30, 2027. 33 34 CITY OF WESTLAKE, OHIO ORDINANCE NO. 2026-42 PAGE 2 Section 5: That the Director of Finance be and he hereby is authorized and directed to 35 pay the fees to America’s Choice Healthplans, LLC each month during the life of this agreement 36 upon receipt of invoice from America’s Choice Healthplans, LLC to be rendered during the current 37 month. 38 Section 6: That it is found and determined that all formal actions of this Council 39 concerning and relating to this legislation were adopted in an open meeting of this Council and that 40 all deliberations of this Council and of any of its committees that resulted in such formal action were 41 in meetings open to the public in compliance with all legal requirements including Section 10, Article 42 XI of the Charter of the City of Westlake and Section 121.22 of the Ohio Revised Code. 43 Section 7: That this legislation is hereby declared to be an emergency measure 44 immediately necessary for the preservation of the public health, safety and welfare, and for the 45 further reason that it is immediately necessary to provide continuity of health insurance benefits 46 to employees, and further provided it receives the affirmative vote of two-thirds of all members 47 elected to Council, it shall take effect and be in force immediately upon its passage and approval 48 by the Mayor. 49 50 Passed: ____________________________________ 51 David S.
