1 CITY OF WESTLAKE, OHIO 2 ORDINANCE NO. 2026-5: 3 4 AN ORDINANCE AUTHORIZING THE 5 MAYOR TO ENTER INTO A SETTLEMENT 6 AGREEMENT AS TO CASE NO. 1:23-cv-00984, 7 AND DECLARING AN EMERGENCY. 8 ______________________________________________________________________________ 9 10 WHEREAS, this Council wishes to see a resolution of all claims in Case No. 1:23-cv- 11 00984 captioned William McKissack v. Ryan Jasinsky, et al. before the U.S. District Court, 12 Northern District of Ohio, Eastern Division. 13 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 14 WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO: 15 Section 1: That this Ordinance is passed exclusively for the purposes of the resolution 16 of Case No. 1:23-cv-00984 in the U.S. District Court captioned William McKissack v. Ryan 17 Jasinsky, et al. 18 Section 2: That this Council does hereby authorize the Mayor to execute the Settlement 19 Agreement in Case No. 1:23-cv-00984 captioned William McKissack v. Ryan Jasinsky, et al., 20 which shall be kept on file in the Finance Department, and further approves and authorizes the 21 Mayor and Director of Law to take all necessary steps to settle the litigation in Case No. 1:23-cv- 22 00984. 23 Section 3: That it is found and determined that all formal actions of this Council 24 concerning and relating to this legislation were adopted in an open meeting of this Council and 25 that all deliberations of this Council and any of its committees that resulted in such formal action 26 were in meetings open to the public in compliance with all legal requirements including Section 27 10, Article XI of the Charter of the City of Westlake and Section 121.22 of the Ohio Revised Code. 28 Section 4: That this legislation is hereby declared to be an emergency measure 29 immediately necessary for the preservation of the public health, safety and welfare, and for the 30 further reason that it is immediately necessary to provide for an amicable settlement between the 31 parties, and further provided it receives the affirmative vote of two-thirds of all members elected 32 CITY OF WESTLAKE, OHIO ORDINANCE NO. 2026-5 PAGE 2 to Council, it shall take effect and be in force immediately upon its passage and approval by the 33 Mayor. 34 Passed: ____________________________________ 35 David S.
