PART I  GENERAL INFORMATION 
 
Dover Village Townhomes, Fee Simple Plat, Center Ridge & Hillsborough Pt., PP#21706033, Ward 6 
 
PART II  
PROJECT SUMMARY/ZONING 
 
The purpose of this request is to approve a plat for recording purposes that creates fee simple title lots for Dover 
Village Townhomes.  This allows the land under each townhouse unit to be a separate parcel with a fee simple 
title.  Due to financing challenges since 2008 this is necessary, as new homeowners cannot get financing or do so 
at a premium if condominium lots are created, where the land under the units is owned in common by the 
development.   
 
The approval of this request does not change how the property is developed, as it only changes the type of deed 
provided for units.  More specifically, it will not in any way change the site plan, setbacks, lot coverage, parking, 
landscaping, common areas, etc. that were approved by the Planning Commission and Council for this 
development.  It also does not negate the requirement that the homeowners association is responsible for owning 
and maintaining common areas. 
 
Section 1211.13 permits cluster units to have fee simple titles.  Since this plat is for recording purposes, it must be 
approved by the Planning Commission and Council in order to be accepted by Cuyahoga County.  Since the 
adoption of Ordinance 2019-134 establishing this process, all multi-family developments have had fee simple title 
plats approved. 
 
PART III  
DRAFT FINDINGS/MOTION 
Draft Findings of Fact 
 
1. The plat for Dover Village Townhomes is required to create fee simple title lots under each unit, ensuring 
homeowners can obtain conventional financing that is not available or is costlier under condominium 
ownership. 
2. Approval of the plat changes only the form of deed and does not alter the approved site plan, setbacks, lot 
coverage, parking, landscaping, or common areas, which remain subject to homeowners association 
ownership and maintenance under Section 1211.13 and Ordinance 2019‑134. 
 
Draft Motion1 
 
If the Planning Commission can make a recommendation, the following motion is advised: 
 
Based upon the findings of fact, I move to recommend approval of the Dover Village Townhomes Fee Simple
