We’re pleased to submit this proposal for a requested change in the design and materials for the new trash
dumpster enclosure at the new headquarters facility for Achievement Centers for Children (ACC).
The originally proposed enclosure design was to be comprised of brick, with metal swinging doors on a steel frame.
Due to the high cost of this design, ACC is requesting a change to an enclosure that will be clad in cedar wood
planks. The enclosure doors will also be made of cedar wood.
This new dumpster enclosure will not be visible from any street or adjacent property and is proposed as an
upgrade to the building’s previous dumpster setting, where the containers were housed “out in the open”, adjacent
to the building’s loading dock.

PROJECT SUMMARY/ZONING
On September 8, 2025, the Planning Commission approved a site improvement plan for the Achievement Centers
for Children’s new headquarters, including a new drop-off driveway and canopy structure within the Office
Laboratory Zone. Because this area previously functioned as a loading dock and housed the facility’s dumpsters,
the approval also included a new brick dumpster enclosure with metal swinging doors on a metal frame, designed
in accordance with Zoning Code Section 1218.06 (i):
Trash Receptacles. All trash receptacles shall be located wholly within the main building or in an
approved enclosed structure. Exterior trash enclosures shall be six feet in height with masonry walls on
three sides with a solid gate or door on the fourth side. Enclosures shall be designed to be compatible in
design and material as the main building. Exterior enclosures shall be at least six feet from the main
building and provide a setback from property lines equal to the required loading area setback. Where
adjacent to residential districts, trash enclosures shall be further screened with a landscape buffer
approved by the Planning Commission.
The applicant, citing the high cost of the approved brick design, is now requesting a change to an 8’ tall cedar
wood plank-clad enclosure with matching cedar doors in a natural sealed finish. They note that the enclosure is
not visible from any street or adjacent property and would still represent an improvement over the historic
condition, in which dumpsters were simply placed at the loading dock without any enclosure or screening.
While it is likely that the City originally required masonry structures for their durability, low maintenance needs,
and overall appearance, the Planning Commission minutes from August 26, 1991, provide no explanation. Even
so, these factors can be addressed through careful design, appropriate material selection, and consistent
maintenance.
1220.05 PLANNING COMMISSION REVIEW AND MODIFICATION (summary)
The Planning Commission must evaluate development plans based on the spirit and intent of the Zoning Code, the
applicable standards and requirements, the location of the proposal, its effect on surrounding properties, and its
relationship to the Guide Plan. The Commission may adjust strict zoning requirements such as design criteria
when reviewing a proposal for compliance with the Zoning Code, using the performance standards in Section
1220.06 as a basis. When an applicant requests a reduction or modification to one standard, the Commission may
require increases or adjustments to other standards to balance the request.
1220.06 PERFORMANCE STANDARDS (excerpt of applicable standards)
Modifications to development plans in dimensioned and quantitative requirements for new development shall
incorporate the following performance standards:
(d)
Modifications may be considered due to unique conditions of the parcel, building, design, parcel size,
parcel location, topography, adjacent uses of proposed use of the parcel.
(e)
Modifications shall be designed to protect the desirable characteristics of both existing and planned
development as adjacent properties.
(f)
Modifications shall promote the desirable and beneficial use of the land and promote the economic
development of the City.

DRAFT FINDINGS/MOTION
Draft Findings of Fact
1. The originally approved plan included a brick dumpster enclosure consistent with Zoning Code Section
1218.06(i) and the applicant now seeks to substitute a cedar wood plank‑clad enclosure due to cost and
because it is not visible from public streets or adjacent properties.
2. The request must be evaluated under the modification criteria in Sections 1220.05 and 1220.06 and if the
Planning Commission recommends approval it is because they have found that those standards have been
met.
3. If the Planning Commission recommends approval a condition should require the installation of bollards
beside the wood posts on the gate side of the dumpster enclosure to prevent damage.
Draft Motion1
If the Planning Commission can make a recommendation, the following motion is advised:
Based upon the findings of fact, I move to recommend approval of the Achievement Centers for Children site
improvements with the following:
1. Modification for the dumpster enclosure and gate to be of cedar instead brick and metal previously
approved.
2. Condition bollards are installed next to the wood posts on the gate side of the dumpster enclosure.
