WHEREAS, Angela Tempest, of Joy Beauty Salon, has submitted a request to the Council

of the City of Westlake, Ohio, for a Conditional Use Permit for the property at 25125 Detroit Road,

Suite 125, Westlake, Ohio (Permanent Parcel No. 213-24-311), for a salon use; and 
11 
 
WHEREAS, after receiving the current application, the application was sent to the 
12 
Planning Commission for its review, and the Planning Commission recommended ____________ 
13 
of the Conditional Use Permit with certain conditions; and 
14 
WHEREAS, this Council provided and held a Public Hearing on the application for the 
15 
Conditional Use Permit.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF

WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO:

Section 1: 
That this Council does hereby approve the application of Joy Beauty Salon 
19 
for a Conditional Use Permit for the property at 25125 Detroit Road, Suite 125, Westlake, Ohio 
20 
(Permanent Parcel No. 213-24-311), for a salon use, which said use is to be conditioned only within 
21 
the areas located within the address described in this Ordinance.

Section 2: 
That this Conditional Use Permit application is approved upon the 
23 
following terms and conditions:

Section 3: 
That the approval of this Conditional Use Permit shall become null and void

if the operation of the conditional use permit is contrary to law and/or the conditions of this

Ordinance and the Conditional Use Permit shall not be transferable to another location without a

new Conditional Use Permit being obtained but would be transferable at the location described in 
30 
Section 1 hereof to a new owner subject to all the terms and conditions thereof.

PART I  GENERAL INFORMATION 
 
Ordinance 2026-16 conditional use permit, Joy Beauty Salon (medical micropigmentation aka medical tattooing), 25125 
Detroit Rd. Suite 125, PP#21324311, Ward 1, ref. 2/19/26 
 
PART II  
PROJECT SUMMARY 
 
Applicant Angela Tempest of Joy Beauty Salon is requesting a conditional use permit for a “salon” use that 
includes medical tattooing, micropigmentation, and microblading, but does not permit artistic tattooing. The 
property is located in the Office Laboratory District, where this use is allowed as a conditional use under 
Section 1218.03(h)(17).  
 
In 2025, Ordinance 2025‑124 amended Section 1218.03(h)(17) to add “salon” as a permitted conditional use in 
the Office Laboratory District, which was done specifically to allow Joy Beauty Salon in this zone to offer 
micropigmentation services. This request represents the final step in establishing the use authorized through that 
amendment.  
 
Approval will add only one employee working within an existing room of the current salon. The change is not 
expected to create additional parking demand or affect other businesses within the development. The proposed 
hours of operation will remain unchanged at Monday through Friday from 10:00 a.m. to 7:00 p.m., Saturday from 
9:00 a.m. to 5:00 p.m., and closed on Sundays. 
 
PART III  
GUIDE PLAN/ ZONING 
 
Guide Plan – the Future Land Use map identifies this area as Office & Office Lab in support of this request. 
 
Zoning Code Requirements 
 
1227.03  STANDARDS FOR EVALUATING CONDITIONAL USE PERMITS.  
 
An application for a conditional use permit shall not be approved unless the following conditions and 
standards are complied with as set forth for the following districts: 
 
(b) Business and Industrial Districts (Excerpt of applicable standards) 
(3) 
The location, extent and intensity of the proposed use shall be such that its operation is not objectionable to nearby 
dwellings by reason of noise, smoke, dust, odors, fumes, vibrations or glare greater than is normal or as permitted by 
the performance standards of the district; 
(4) 
The proposed use shall form a harmonious part of the business, research, service and industrial district, taking into 
account, among other considerations, convenience of access and relationship of one use to another; 
(6) 
The hours of operation and concentration of vehicles in connection with proposed use shall not be more hazardous or 
dangerous than the normal traffic of the district. 
 
(c) Safeguards and Conditions. Safeguards and conditions may also be set forth in the permit in addition to the 
general standards set forth in subsection (a) and (b) herein. None are required.

1218.06   PERFORMANCE REGULATIONS (excerpt of applicable regulations). 
   (a)   Structures. 
(1) Enclosure. All permitted main and accessory uses and operations, except for off-street parking 
and loading facilities, shall be performed wholly within an enclosed building or buildings. 
Proposed use will take place entirely within the building.

DRAFT FINDINGS/MOTION 
Draft Findings of Fact 
 
1. The proposed CUP, needed to allow the medical micropigmentation use, qualifies as a conditional use in 
the Office Laboratory District under Section 1218.03(h)(17), consistent with the 2025 amendment 
(Ord. 2025‑124) and the Guide Plan designation of Office & Office Lab. 
2. All procedures will occur entirely within an existing enclosed salon space, with no change to hours of 
operation and no anticipated increase traffic or parking demand, meeting the conditional use standards for 
intensity and compatibility. 
3. The request completes the implementation of Ordinance 2025-124, adopted specifically to allow this 
service at this location, and the addition of one employee within an existing room maintains compatibility 
with surrounding uses and character of the district.
