Subject: Application for Conditional Use Permit (CUP) - Conversion to Assisted Living
Facility for property located at 27601 Westchester Parkway, Westlake, OH 44145
Dear Members of the Westlake Planning Department,
Please accept this letter and the enclosed application materials for a Conditional Use Permit
(CUP) regarding the property located at 27601 Westchester Parkway, Westlake, OH 44145.
We are seeking approval to convert the existing structure from a vacant former skilled
nursing facility to a modern Assisted Living Facility containing 100 suites.
The property located at 27601 Westchester Parkway
is currently zoned under R-MF-40.
Historically, the structure functioned as a licensed skilled nursing facility.
Its operational
status changed significantly when, on November 11,2023, the Ohio Department of Health
revoked its license, leading to the property becoming vacant. Following this vacancy, the
property underwent foreclosure by the Lender, was subsequently placed into Receivership,
and was ultimately acquired by the current owner in February 2025. The current owner now
proposes a full renovation and repurposing of the building to operate as a dedicated Assisted
Living Facility offering 100 suites, thereby serving the residential and care needs of the
Westlake community.
We believe the proposed conversion to an Assisted Living Facility aligns with the character
and needs of the surrounding community. Enclosed for your review and consideration are
the following documents:

Architectural Floor Plans detailing the proposed 100-suite Assisted Living Facility
conversion.
We are prepared to present our plans to the Planning Commission and are available to

WHEREAS, Bentzion Friedman, of Westbrook Nursing, LLC, has submitted a request to
9
the Council of the City of Westlake, Ohio, for a Conditional Use Permit for the property at 27601
10
Westchester Parkway, Westlake, Ohio (Permanent Parcel Nos. 212-04-002 and 212-04-048), for
11
a senior service use; and
12
WHEREAS, after receiving the current application, the application was sent to the
13
Planning Commission for its review, and the Planning Commission recommended ____________
14
of the Conditional Use Permit with certain conditions; and
15
WHEREAS, this Council provided and held a Public Hearing on the application for the
16
Conditional Use Permit.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
18
WESTLAKE, COUNTY OF CUYAHOGA AND STATE OF OHIO:

Section 1:
That this Council does hereby approve the application of Westbrook
20
Nursing, LLC for a Conditional Use Permit for the property at 27601 Westchester Parkway,
21
Westlake, Ohio (Permanent Parcel Nos. 212-04-002 and 212-04-048), for a senior service use,
22
which said use is to be conditioned only within the areas located within the address described in
23
this Ordinance.

Section 2:
That this Conditional Use Permit application is approved upon the
25
following terms and conditions:

Section 3:
That the approval of this Conditional Use Permit shall become null and void
29
if the operation of the conditional use permit is contrary to law and/or the conditions of this
30
Ordinance and the Conditional Use Permit shall not be transferable to another location without a
31
new Conditional Use Permit being obtained but would be transferable at the location described in
32
Section 1 hereof to a new owner subject to all the terms and conditions thereof.

Section 4:
That it is found and determined that all formation actions of this Council

concerning and relating to this legislation were adopted in an open meeting of this Council and

that all deliberations of this Council and any of its committees that resulted in such formal action

were in meetings open to the public in compliance with all legal requirements including Section

10, Article XI of the Charter of the City of Westlake and Section 121.22 of the Ohio Revised Code.

Section 5:
That this Ordinance shall take effect and be in force from and after the

earliest period allowed by law.
