FOR THE CONSTRUCTION OF SEWER AND WATERLINE IMPROVEMENTS ON STANFORD AVENUE AND DECLARING AN EMERGENCY WHEREAS, the District One Public Works Integrating Committee of Cuyahoga County (“DOPWIC”) awarded the City of Fairview Park (“City”) a grant and loan for the Stanford Sewer, Water and Pavement Replacement Project (the “Project”); and WHEREAS, City Council approved the Project with Resolution 23-23 on November 7, 2023; and WHEREAS, City Council approved the Mayor signing the agreement with DOPWIC with Ordinance 24-36 on June 3, 2024; and WHEREAS, City Council approved Wallace Pancher Group/Mannik and Smith Group Inc. (“City Engineer”) to prepare plans and specifications and to provide construction administration of the Project with Ordinance 24-42 on June 17, 2024; and WHEREAS, the Project has an engineer’s estimated cost of three million six hundred thousand dollars ($3,600,000). The City advertised for bids for the Project on June 20, 2025, and June 27, 2025; and WHEREAS, the City received seven (7) bids for the Project on July 14, 2025, and Terrace Construction Co., Inc was the most responsive and responsible bidder with a total bid of three million five hundred seventy-one thousand one hundred sixty-eight dollars and ninety cents ($3,571,168.90); and WHEREAS, the City would like to award Terrace Construction Co. Inc, the award for the construction of the Project. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FAIRVIEW PARK, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1. That the Terrace Construction Co., Inc. is hereby authorized and directed to begin construction for the Stanford Sewer, Water and Pavement Replacement Project (“Project”).

Terrace Construction Co., Inc. shall be paid for the said services in an amount not to exceed three million five hundred seventy-one thousand one hundred sixty-eight dollars and ninety cents ($3,571,168.90), to be paid from the Sanitary Sewer Fund (Fund 510) and the Waterline Fund (Fund 550). SECTION 3. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. SECTION 4. That this Ordinance is hereby declared to be an emergency measure necessary for the preservation of the public peace, health, safety and welfare; and for the further reason that allows the construction of the Project in a timely manner, and provided it receives the affirmative vote of a majority plus one of the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor, otherwise from and after the earliest period allowed by law. DATE: July 30, 2025 The Administration of the City of Fairview Park (“City”) requests the passage of the following ordinance as an emergency with the first and final reading on August 4, 2025, with emergency enactment. AN ORDINANCE AUTHORIZING THE CITY OF FAIRVIEW PARK TO ENTER INTO CONTRACT WITH TERRACE CONSTRUCTION CO., INC. FOR THE CONSTRUCTION OF SEWER AND WATERLINE IMPROVEMENTS ON STANFORD AVENUE AND DECLARING AN EMERGENCY The Administration applied for the State Capital Improvement Program (“SCIP”) from the District One Public Works Integrating Committee of Cuyahoga County and the Ohio Public Works Commission (“OPWC”). Resolution No. 23-23 was passed on November 6, 2023, in support of the SCIP grant application. The Stanford Waterline and Sewer Improvement Project (“Project”) will focus on the replacement of the sanitary sewers and connections, the replacement of the storm sewer and storm connections, water main and full depth pavement replacement including curb, curb drains, driveway aprons and sidewalk, located on Stanford Avenue between West 210 Street and West 204 Street. The City’s application consisted of a grant request for five hundred fifty-two thousand and one hundred eight dollars ($552,108.00), and a loan request for three million nine hundred seventy-five thousand one hundred seventy-eight dollars ($3,975,178.00) with a local match of nine hundred ninety-three thousand seventy-four dollars ($993,794.00) from the City. The Project has an engineer’s estimated cost of three million six hundred thousand dollars ($3,600,000). The City advertised for bids for the Project on June 20, 2025, and June 27, 2025. The City received seven (7) bids for the Project on July 14, 2025, and Terrace Construction Co., Inc. was most responsive and responsible bidder with a bid total of three million five hundred seventy-one thousand one hundred sixty-eight dollars and ninety cents ($3,571,168.90).

Resolution 25-__ | Page 1 CITY OF FAIRVIEW PARK RESOLUTION NO.: 25- ORIGINATED BY: JENNIFER PAE, FINANCE DIRECTOR/HR MANAGER REQUESTED BY: MAYOR BILL SCHNEIDER SPONSORED BY: COUNCILWOMAN KING and COUNCILWOMAN WERING A RESOLUTION REPEALING RESOLUTION 25-12 AMENDED AND REPLACING IT HEREIN TO SUBMIT TO THE VOTERS THE QUESTION OF A RENEWAL OF A TAX FOR THE BENEFIT OF THE CITY OF FAIRVIEW PARK FOR THE PURPOSE OF PROVIDING AND MAINTAINING FIRE APPARATUS, BUILDINGS, PAYMENT OF FIREFIGHTERS SALARIES, EMPLOYER'S CONTRIBUTION REQUIRED UNDER SECTION 742.34 OF THE REVISED CODE, PURCHASING AMBULANCE EQUIPMENT, FOR PROVIDING AMBULANCE, PARAMEDIC OR OTHER EMERGENCY MEDICAL SERVICES AT A RATE NOT EXCEEDING 1 MILL FOR EACH ONE DOLLAR OF VALUATION, WHICH AMOUNTS TO TEN CENTS FOR EACH ONE HUNDRED DOLLARS OF VALUATION, FOR FIVE YEARS, COMMENCING IN 2026, FIRST DUE IN CALENDAR YEAR 2027 AND DECLARING AN EMERGENCY WHEREAS, Resolution 96-19 declared the necessity of a one (1) mill levy for current expenses for the operation of the City's Fire Department for a period of five (5) years, which was renewed by Resolution 06-05, Amended, for another five years, which was then renewed by Resolution 11-15, for another five years; which was then renewed by Resolution 15-26, for another five years; which was then renewed by Resolution 20-16, for another five years; and WHEREAS, after voter approval of said levy, the proceeds of such levy have, since its inception in 1996 and renewal in 2006, 2011, 2015, and 2021 been used to pay, among other things, current expenses, including providing and maintaining fire apparatus and other fire equipment and appliances; buildings and sites therefor; sources of water supply and materials therefor; for the establishment and maintenance of lines of fire alarm communications, for the payment of salaries and benefits for firefighting, emergency medical service, administrative, and communications personnel, and employer's contributions required under Section 742.34 of the Revised Code, purchasing ambulance equipment, for providing ambulance, paramedic or other emergency medical services, and the payment of other related costs; and WHEREAS, the Fire Levy originally authorized by Resolution 96-19 and passed November 5, 1996, renewed by Resolution 06-05, Amended, and passed May 2, 2006, renewed again by Resolution 11-15, and passed November 8, 2011, renewed again by Resolution 15- 26, and passed March 15, 2016, and renewed again by Resolution 20-16 and passed on May 4, 2021 will expire on December 31, 2025; and WHEREAS, Council finds it necessary to renew the one (1) mill levy in accordance with Sections 5705.19(1) and 742.34 of the Ohio Revised Code and the Charter of the City of Fairview Park in order to maintain the revenue without interruption.
Resolution 25-__ | Page 2 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FAIRVIEW PARK, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1. That Resolution 25-12 Amended passed on July 2, 2025 and approved on July 3, 2025, is hereby repealed in its entirety and replaced as set forth herein. SECTION 2. That it is hereby found, determined and declared that the amount of taxes which may be raised by the City of Fairview Park ('City") by levies at the maximum rates within the ten mill limitation set forth in Ohio Revised Code Section 5705.02 and the Charter tax limitation on the current tax list and requirements of this City will be insufficient to meet the needs of the Fire Department when the one (1) mill levy approved pursuant to Resolution 20-16 expires on December 31, 2025, and it is necessary to renew said one (1) mill for each one-dollar ($1.00) of taxable value levy for the purpose of providing and maintaining fire apparatus, buildings, payment of firefighters salaries, employer's contribution required under Section 742.34 of the Revised Code, purchasing ambulance equipment, for providing ambulance, paramedic or other emergency medical services for a period of five years, which the County Fiscal Officer has ce1iified at the Estimated Cost of Thirteen Dollars ($13.00) for each $100,000 of the County Fiscal Officer's appraised value and the County Fiscal Officer estimates it will collect Three Hundred Twenty-Nine Thousand Dollars ($329,000.00) Three Hundred Twenty-Eight Thousand Six Hundred Sixty-Eight Dollars ($328,668.00) annually. SECTION 3. That the question of renewing the current one (1) mill levy upon the tax list and duplicate for five (5) years, beginning with the 2026 tax list and duplicate and with the first distribution of the proceeds of said levy to this City in the calendar year 2027, for the purpose set forth in section 2 hereof under provisions of Article VIII, of the Charter of the City of Fairview Park, entitled "Finance," Section 9 entitled "Submission of Extra Levy" shall be submitted to the electors of the City of Fairview Park at the general election to be held therein on the 4th day of November 2025, as authorized by law, and said election shall be held at the regular places of voting in said City as established by the Board of Elections of Cuyahoga County, Ohio, or otherwise, within the times provided by law and shall be conducted, canvassed and certified in the manner prescribed by law. SECTION 4. That the form of ballot to be cast at such election on the question of such tax levy shall be as follows: PROPOSED TAX LEVY (RENEWAL) CITY OF FAIRVIEW PARK A majority affirmative vote is necessary for passage. A renewal of a tax for the benefit of the City of Fairview Park for the purpose of providing and maintaining fire apparatus and other fire equipment and appliances; buildings and sites therefor; sources of water supply and materials therefor; for the establishment and maintenance of lines of fire alarm communications; for payment of salaries and benefits for firefighting, emergency medical service, administrative, and communications personnel and employer's

Certificate of Estimated Property Tax Revenue DTE 140R Rev. 04/25 Use this form when a taxing authority certifies a millage rate R.C. $705.01, 5708.08 and requests the revenue produced by that rate. The county auditor of Cuyahoga County, Ohio, does hereby certify the following: 1.0n July? 2025 the taxing authority of the City of Fairview Park (political subdivision name) certified a copy of its resolution or ordinance adopted July 1 2025 requesting the county auditor to certify the current taxable value of the subdivision and the amount of revenue that would be produced by {1-000 | mills, to levy a tax outside the 10-mill limitation for Fire& EMS purposes pursuant to Revised Code § 4234 & 9709-19), be placed on the ballot at the November4 2025 election. The property tax revenue that will be produced by the stated millage, assuming the taxable value of the subdivision remains constant throughout the life of the levy, is calculated to be $ 328,668 3. For purposes of this certification, “subdivision” includes any agency, board, commission or other authority authorized to request a taxing authority to submit a tax levy on its behalf. See R.C. 5705.01({A) & (C). 3. “Levy type” includes the following: (1) additional, (2) renewal, (3) renewal with an increase, (4) renewal with a decrease, (5) replacement, (6) replacement with an increase and (7) replacement with a decrease levies. 4. In completing Lines 1 and 4 of this form, mills should be identified in whole numbers or fractions thereof, i.e., 5 mills or 5.25 mills, rather than as a fraction of a dollar, i.e., $0.005. This expression is consistent with the prior practice of identifying mills in whole numbers or fractions thereof per $1 of valuation. on “The county auditor’s appraised value” means the true value in money of real property. R.C. 5705.01(P). For any levy or portion of a levy, an estimate of the levy’s annual collections, rounded to the nearest dollar, which shall be calculated assuming that the amount of the tax list of the taxing authority remains throughout the life of the levy the same as the amount of the tax list most recently certified by the county auditor under R.C. 319.28(A). A need for a new resolution is due to the passage of Ohio House Bill 496 of the 135th General Assembly that was passed in April 2025, signed into law June 30, 2025, and veto overridden on July 21, 2025. The law modifies information the county auditor must certify in the process of submitting a property tax levy to voters. The law applies to elections held after July 18, 2025. HB 496 requires the county auditor (fiscal officer) when providing their tax estimates to round the estimated annual revenue the levy would generate to the nearest $1 instead of the nearest $1,000. As a result, the fire renewal tax levy resolution (Res. 24-15 Amended) the City submitted for the November 4, 2025 ballot did not conform to these new requirements. This new resolution provides the dollar amount generated by the levy to the nearest dollar, per the new requirement. Due to the fact that this legislation must be file with Cuyahoga County Board of Elections by Wednesday, August 6, the administration respectfully requests passage on Monday, August 4, 2025. cc: Bill Schneider, Mayor A. ADVISORY 2025-03 July 18, 2025 To: All County Boards of Elections Board Members, Directors, and Deputy Directors Re: House Bill 496 Changes to Tax Levy Law BACKGROUND This Advisory is to alert boards of elections to changes in the administration of elections resulting from the passage of House Bill 496 (“H.B. 496”) of the 135th General Assembly. More specifically, H.B. 496 modifies information a county auditor must certify in the process of submitting a property tax levy to voters, including information appearing on election notices and ballot language. This law applies to elections held after July 18, 2025.1 SUMMARY First, Ohio law requires a county auditor to round estimated revenue to the nearest $1 rather than the nearest $1,000 when certifying to a taxing authority the estimated annual collections of a proposed levy.2 Second, the law requires the estimate, as well as an estimate of tax rates for bond and fixed-sum levies to be calculated based on property valuations appearing on the most recently finalized tax list, instead of the valuations on the current year tax list or an estimated amount calculated by the county auditor.3 Finally, the law requires county auditors to certify the residential/agricultural effective rate of renewed or extended levies based on the last known rate, as opposed to an estimated effective rate that assumes the levy is approved.4 Relevant portions of the Questions and Issues Handbook as well as Templates 101, 104, 121, 124, 214, 215, 311, 911 and 918 have been updated to reflect these changes.
