The first topic was Resolution 2025-45, which would adopt a Gender Freedom Policy for the City of Lakewood in response to ongoing attacks to transgender rights at the state and national levels. We welcomed Dara Adkison Executive Director for Trans Ohio), Elizabeth Katavich (Lead Advocacy Coordinator, LGBT Community Center of Greater Cleveland), and Sean McCann (Policy Strategist, ACLU of Ohio) to provide feedback on the proposed legislation. The legislation was substituted in committee with a revised version that included edits from the Law Department and community partners. A few additional edits were made on the floor in response to the committee discussion. The substituted legislation was referred favorably back to full Council for adoption. The second topic on the agenda was a series of three resolutions to appoint community members to openings on the City’s boards and commissions including Planning Commission, Tree Advisory Board, and the newly established Complete and Active Streets Education & Advisory Board. Councilmembers moved to enter Executive Session for the purpose of considering the appointment of a public official. The Committee of the Whole met again on September 29, 2025, to interview six candidates to fill the upcoming vacancy on the Planning Commission. The interviews were held in the East Conference room and were open to the public. Each interview lasted 15-20 minutes, during which time council members asked questions to better understand the qualifications and unique skillset of each candidate. After the interviews were over, councilmembers voted to enter Executive Session for the purpose of considering the appointment of a public official. I expect that Council will act on Resolution 2025-40 to make an appointment to the Planning Commission at the General Meeting on October 6th. S. RESOLUTION 2025- 45 BY: KEPPLE, STREBIG A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least two thirds of the members of Council, or otherwise to take effect and be in force after the earliest period allowed by law, adopting the City of Lakewood Gender Freedom Policy in response to attacks on transgender rights at the state and national levels. WHEREAS, the transgender, nonbinary, and LGBTQIA+ ( Lesbian, Gay, Bisexual, Transgender, Queer, Intersex, and Asexual) community in Lakewood and nationally are being attacked by the Trump Administration's recent executive actions, including: x The Trump Administration’s executive order on January 20, 2025 stating that the U.S. government will now recognize only two sexes-- male and female-- and define sex as “ an individual’s immutable biological classification as either male or female,” and erasing gender as a meaningful identifier in official policies and documents; x The Trump Administration’ s executive order on January 28, 2025, attempting to withhold funding for healthcare entities who provide gender-affirming medical treatments for children and teenagers under the age of 19 and discrediting relevant scientific literature on gender-affirming care; x The US Office of Personnel Management’s memo dated January 29th, 2025 instructing all federal agencies to remove all programs, grants, website pages, guidance and more that promote gender ideology” and attempting to ending legal recognition of transgender people by removing references to gender on all forms that previously requested this information; WHEREAS, in January 2024, the Ohio General Assembly voted to override Governor Mike DeWine’s veto against Ohio House Bill 68 (“ H.B. 68”), a bill that bans transgender, non- binary, and gender-expansive minors from receiving gender-affirming health care; and WHEREAS, transgender immigrants, refugees, and asylees face additional gender-based persecution due to their immigration status; and WHEREAS, the Human Rights Campaign reported in 2023 that, 85% of all victims of fatal violence against transgender and gender diverse people identified since 2013 are members of the BIPOC ( Black, Indigenous, and People of Color) communities with almost two-thirds ( 61.8%) of victims have been black trans women; and WHEREAS, a survey of transgender Americans by the National Center for Transgender Equality and the National Gay and Lesbian Task Force reveals that 18 percent of respondents were unemployed. 34 percent of respondents reported experiencing poverty, and 30 percent had experienced homelessness in their lifetimes. Further, 11 percent of respondents who previously had held a job reported being fired, forced to resign, or laid off because of their gender identity or expression; and WHEREAS, gender- affirming health care is evidence- based and broadly supported by major medical associations, including the American Medical Association, the American Academy of Pediatrics, the American Academy of Child and Adolescent Psychiatry, the American QWURGXFHG 6XEVWLWXWHG LQ FRPPLWWHH 002

Psychiatric Association, the American Psychological Association, the American Counseling Association, the Endocrine Society, the American College of Obstetricians and Gynecologists, the American Urological Association, the American Society for Reproductive Medicine, and the Children’s Hospital Association; and WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, this Council by a vote of at least two thirds of its members determines that this resolution is an emergency measure and that it shall take effect immediately, and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments, in that the lives and wellbeing of transgender individuals is at stake; now, therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. The City of Lakewood hereby makes a commitment to enshrining and upholding transgender rights, equal protections and safety for transgender and gender diverse community members. Section 2. The City of Lakewood recognizes the importance of gender- affirming healthcare as a matter of health, privacy, and equality and to ensure, to the greatest extent permitted by law, that those rights are upheld for all residents and visitors within the City of Lakewood and therefore adopts the City of Lakewood Gender Freedom Policy (“Policy”) attached as Exhibit “A”. Section 3. The Policy shall not be amended or rescinded without separate action of Council. Section 4. The City will distribute the Policy to all employees upon enactment of this Resolution and will distribute the Policy to new employees within 30 days of their start date. Section 5. This resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health, safety, and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in the preamble to this resolution, and provided it receives the affirmative vote of at least two thirds of the members of Council, this resolution shall take effect and be in force immediately upon its adoption by the Council and approval by the Mayor, or otherwise it shall take effect and be in force after the earliest period allowed by law. Bullock III Angelina Hamilton Steiner Ward Council Kyle Baker, Ward 1, Vice President Bryan Evans, Ward 2 Cindy Strebig, Ward 3 Cindy Marx, Ward 4 City of Lakewood Administrative Policy regarding Gender Freedom In light of the numerous federal and state attempts to target and restrict the rights and dignity of transgender people, and due to the threat of criminalizing certain forms of gender related expression, the City of Lakewood (“ City) finds it necessary to establish a policy regarding the use of public funds or resources in the investigation and the prosecution of individuals for their personal choices regarding health care and expression. Under Ohio’s Home Rule Authority, the City has the authority to prioritize the utilization of resources and exercise prosecutorial discretion. Lakewood is the most densely populated municipality in Ohio and experiences crime like any other densely populated inner ring suburbs. Therefore, Lakewood will not prioritize the use of its scarce resources, including, but not limited to, time spent by employees, officers, contractors, or subcontractors while on duty, or the use of city property, for detaining, surveilling, interviewing, or investigating persons seeking, receiving, facilitating, or providing gender-affirming care, including but not limited to gender affirmation surgery or gender hormone therapy and legal guardians seeking gender-affirming care on behalf of dependents. Further, the City will not prioritize the use of city funds or resources for cooperating with or providing information to any individual, in or out-of-state agency or department, or federal agency or department regarding the provision of gender-affirming healthcare including gender-affirming mental healthcare performed in Lakewood and the State of Ohio. Further, the City recognizes that legislation that has previously been introduced in the Ohio General Assembly would restrict and criminalize “performers or entertainers who exhibit a gender identity that is different from the performer’ s or entertainer’s gender assigned at birth.” Therefore, it is the City’s policy that investigations of individuals, organizations, and businesses performing or hosting drag performances or entertainment which would not otherwise fall under the City’ s enforcement of Obscenity law, were gender identity or expression not explicitly targeted; and, investigations of individuals, organizations, and healthcare providers in Lakewood facilitating gender-affirming care as supported by major medical associations i and facilitation of other policies and laws aimed to harm transgender and gender diverse people to be the lowest possible priority, to help ensure transgender and gender diverse people have access to healthcare, housing, education, employment, and self-expression without fear of discrimination. Any report or other record created and held by the City, which contains medical information regarding gender-affirming healthcare will be considered confidential health information and not subject to release, except with the consent of the individual as required by the health insurance Portability and Accountability Act (“HIPAA”). Employees who may regularly gather such information from the public will be trained to protect confidential health information and to not collect unnecessary health information related to gender-affirming care. Finally, Lakewood also has the authority to determine the types of employee benefits that it currently offers employees to ensure their health and wellness, respecting their private healthcare decisions. RESOLUTION NO. 2025-40 BY: KEPPLE A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least two thirds of the members of Council, or otherwise to take effect and be in force after the earliest period allowed by law, appointing to the Planning Commission for the five-year term beginning January 1, 2026 and ending December 31, 2030. WHEREAS, the end of a term has caused a vacancy on the Planning Commission beginning January 1, 2026, in a seat occupied by a Council appointee, thus requiring an appointment to the commission; and WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, this Council by a vote of at least two thirds of its members determines that this resolution is an emergency measure and that it shall take effect immediately, and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments, in that these positions should be filled immediately to ensure the commission is at full capacity to perform its work; now, therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. Council appoints to the Planning Commission for the five-year term beginning January 1, 2026 and ending December 31, 2030. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were passed in open meetings of this Council and that all deliberations of this Council and any of its committees that resulted in such actions were in meetings open to the public and in compliance with legal requirements. Section 3. This resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health, safety and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in the preamble to this ordinance, and provided it receives the affirmative vote of at least two thirds of the members of Council, this resolution shall take effect and be in force immediately upon its adoption by the Council and approval by the Mayor, or otherwise it shall take effect and be in force after the earliest period allowed by law. ORDINANCE NO. 26-2025 BY: KEPPLE AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least two thirds of the members of Council, or otherwise to take effect and be in force at the earliest period allowed by law, to approve the editing and inclusion of certain ordinances as parts of the various component codes of the Codified Ordinances and to provide for the publication of such new matter. WHEREAS, various ordinances of a general and permanent nature have been adopted by Council but not yet included in the Codified Ordinances of the City; and WHEREAS, given the above, now is an appropriate time to contract with the City’s codifier, American Legal Publishing, to produce a revised and updated version of the Codified Ordinances of the City; and WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, this Council by a vote of at least two thirds of its members determines that this ordinance is an emergency measure and that it shall take effect immediately, and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments, in that the publication and distribution of this latest update to the Lakewood Codified Ordinances is an essential resource and reference for government operations; now, therefore BE IT ORDAINED BY CITY OF LAKEWOOD, OHIO: Section 1. Representative Edward Roybal (Los Angeles) introduced legislation that was ultimately signed into law by President Johnson in 1968. This legislation honored a weeklong celebration in September. Ultimately the weeklong celebration was expanded under President Reagan in 1988 when it became a month-long celebration. Hispanic Heritage Month is a time to honor, support, reflect, celebrate, uplift and empower the Hispanic and Latino community. It is a time to educate ourselves and the greater community about the many contributions that Hispanics have made to better society and this country. From labor, to the arts and sciences, to business and entertainment, Hispanics have made and improved life for us all and have joined with other cultures and ethnicities in solidarity in movements across this country. RESOLUTION 2025-49 BY: HAMLITON STEINER, KEPPLE A RESOLUTION to join with states, municipalities, and other jurisdictions around the country to designate September 15 – October 15, 2025 as Hispanic Heritage Month in the City of Lakewood, Ohio by celebrating Hispanic culture and paying tribute to the contributions of Hispanic Americans. WHEREAS, Hispanic Heritage Week was signed into law in 1968 and expanded to Hispanic Heritage Month in 1988; and, WHEREAS, the Hispanic presence in North America spans centuries, predating the founding of what is now recognized as the United States; and, WHEREAS, according to the 2020 US Census one in every four children in the United States is of Hispanic or Latino origin and the total Hispanic-Latino population in Ohio has more than doubled since 2000; and, WHEREAS, Cuyahoga County has the largest Hispanic-Latino population in the state; and, WHEREAS, recent federal policies and administrative actions have disproportionately affected Hispanic and Latino families, particularly in areas of immigration, workforce participation, and access to social supports; and, WHEREAS, Hispanic and Latino communities have been subject to rhetoric that fosters division and contributes to an increase in discrimination and hate crimes; and, WHEREAS, economic and workforce instability, including the displacement of public sector employees, has created challenges that fall heavily on Hispanic and Latino workers and their families; and, WHEREAS, Hispanic and Latino essential workers carried a significant burden during the COVID-19 pandemic and continue to face inequities in health, housing, and economic security; and, WHEREAS, Hispanic and Latino communities have played a pivotal role in shaping the diversity and prosperity of Lakewood and the United Sates, contributing to fields such as the arts, music, literature, sports, business and the culinary landscape; and, WHEREAS, Hispanic Heritage Month provides an opportunity not only to celebrate cultural contributions but also to reaffirm the City of Lakewood’s commitment to equity, inclusion, and protection from discrimination for all residents; now therefore, 009

RESOLUTION 2025-50 BY: STREBIG A Resolution to honor lifelong Lakewood resident Helen Boland on the occasion on her 90th birthday. WHEREAS, Helen Boland was born in Cleveland, Ohio on September 16, 1935, and moved with her family to Harlon Avenue where she spent her formative years; and, WHEREAS, after meeting and marrying her husband, Helen Boland and her husband purchased their own family home on Harlon Avenue, where they raised six children; and, WHEREAS, while simultaneously tending to the needs of her large family, Helen Boland immersed herself in Lakewood political, civic, and community life; and, WHEREAS, unafraid to speak her mind, even in an era that discouraged women from doing so, Helen Boland took the courageous step to run for local office in the 1970s, a decision that undoubtedly influenced the public discourse and local decision-making; and, WHEREAS, a quiet trailblazer, Helen Boland never let society’ s expectations define or limit her. Despite the opinions or expectations of others, she coached her son’ s youth sports team and pursued a career, actions that were viewed by some as radical at the time; and, WHEREAS, Ms. Boland’s notable commitment to her family, community, and life-long learning establishes an important roadmap and legacy for others to follow and build upon in the years ahead; now therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. RESOLUTION NO. 2025-51 BY: KEPPLE A RESOLUTION to join with the Epilepsy Association of Cleveland, other Northeast Ohio communities, and the families and friends of those effected by Sudden Unexplained Death in Epilepsy ( SUDEP) to declare October 2025 as SUDEP Awareness Month in The City of Lakewood. WHEREAS, SUDEP refers to the sudden, unexpected death of a person with epilepsy, who is otherwise healthy, and where no other cause of death has been identified. Neither SUDEP’s causes nor its risk factors are well-understood by the medical community; and, WHEREAS, according to the Centers for Disease Control and Prevention, SUDEP is the leading cause of death in people with epilepsy, cutting short the lives of an estimated 1 in 1,000 people with epilepsy per year; and WHEREAS, the public, including doctors, those living with epilepsy, and those who care for someone with epilepsy, are oftentimes unaware of the SUDEP’s threat and the handful of precautions that can mitigate its risk; and, WHEREAS, in 2022 the Lakewood community lost one of its young and vibrant residents, the late Brenna Brossard, to SUDEP at the age of 25, for whom we mourn; and, WHEREAS, this October we stand with the Brossard family to honor the memory of Brenna and to call for increased awareness, education, and conversation with healthcare professionals to lessen the impact of SUDEP in our community; now therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. Article 5.7: Annually, after consultation with the mayor and the heads of affected city departments, the director of finance shall prepare and submit to the mayor and council a recommended five- year financial plan for the city's capital needs.It has historically been council’s practiceto articulate council budget priorities to the administration for incorporation into the budget and capital planning. This can be difficult to do once the proposed budget has already been prepared and carefully balancedby the finance department, so council has worked over the past few yearsto be prepared to share these priorities earlierin the process.Therefore, Council held two retreats earlier this yearto identify legislative and budget priorities. The giveaway commenced on September 17th, with all 200 trees being claimed within 48 hours. Once again, the TAEB collaborated with the Arbor Day Foundation to curate a mix of trees appropriate for our region, this time concentrating on smaller ornamental species that have been popular with the community. Those who claimed trees will pick them up on October 11th. Board members have been coordinating with staff at Cove Community Center and myself to create intergenerational programming in its outdoor spaces. With 168 different plant species on the property, the Cove campus is a test case for a mini-arboretum concept that could translate well to other city parks. Signage identifying tree types is in the works, as are other educational and programming initiatives on the campus. The Lakewood Garden Club intends to make a contribution toward a memorial gift entranceway to this new mini-arboretum. In other public city spaces, the TAEB is working with the city forestry department to place signage identifying trees at Lakewood Park, and are working with the Lakewood Public Library to update the Story Walks at Madison and Kauffman Park with tree-related books. Several TAEB members attended this year’s Cuyahoga Tree Summit in Rocky River, where they learned about tree and plant supply chain issues in Northeast Ohio. Board members are also working on a grant application with the Healthy Lakewood Foundation to continue their good work throughout the community, and the TAEB will also have a presence at this year’s Welcome to Lakewood event. The board also looks forward to visiting council this fall to discuss all of this year’s accomplishments. Chocolate Walk tickets went on sale on September 27th, with the event expected to sell out quickly, as usual. The organization has recently entered into a partnership with Winterhurst to market all the shops and restaurants in Downtown to people visiting the arena. This collaboration is intended to drive visitors from elsewhere to Lakewood establishments, as Winterhurst enjoys robust visitation from people throughout Northeast Ohio and beyond. This marketing push will soon be bolstered by a part-time marketing/ social media coordinator. Finally, DLBA is preparing to invest in a strategic plan that will guide the organization through the next 3-5 years. I suggested a Code Review Committee to look further into the city code and make recommendations for updates and changes. They are considering this suggestion. Subject to the terms and conditions contained in this Agreement and its exhibits, the Board will provide to the City and, as applicable, to all persons receiving the direct services provided for herein, the Services that are set forth and described in the Scope of Work (SOW) attached as Exhibit A, which Exhibit is incorporated herein. Unless otherwise agreed by the Parties in writing, all transactions for Services through Board will be provided in accordance with the provisions of Ohio law and/or this Agreement, including any revisions of the same, as both Parties may from time to time execute to document the addition, revision, or enhancement of Services. Standard of Performance of Services. The Board will devote such time and will use its best efforts as necessary to perform the Services in a professional manner that: (i) is consistent with the standards of its industry and in a good and workmanlike manner, and (ii) utilizes the care, skill, and diligence normally applied by other similar boards of health in the performance of services similar to the Services. The City shall provide suitable space for the Board employees who make regular visits to the City on a daily or weekly basis. PAYMENT. Compensation. Compensation is based on the ten (10) year census population estimate for the City and a per capita rate established by the Board. The per capita rate is the same rate applied to all Villages, Townships in the general health district as well as for all cities that enter into a Public Health Services Agreement with the Board. The most recent ten (10) year census for population in the City dated September 2021, is 50,942 residents. The current per capita rate established by the Board is $8.96 per capita for calendar year 2026 and $10.04 per capita for calendar year 2027. The total amount due based on the per capita rate will be Four hundred and fifty-six thousand four hundred and forty dollars ($456,440.00) for calendar year 2026 and be Five hundred and eleven thousand, four hundred and fifty- eight dollars ($511,458.00) for calendar year 2027. The Board reserves the right to change its per capita rate, as considered on an annual basis, based on current economic conditions and public health needs. In the event that the Board votes to make a change in the per capita rate, said change shall be limited to annual rates effective on January | for the following calendar year. The Board shall provide notice of the change in the per capita rate for the coming calendar year on or before October 3 1st of the current calendar year, In consideration for the health services described in Exhibit A, which will be provided by the Board to and within the City, the City shall pay to the Board the total annual sum Four hundred and fifty-six thousand four hundred and forty dollars ($456,440.00) for calendar year 2026 and the total annual sum of Five hundred and eleven thousand, four hundred and fifty-eight dollars ($511,458.00) for calendar year 2027. 4, RECORDS. (a) (b) (c) The Board shall maintain copies of all records created or received by the Board in the performance of the work under this Agreement as required by Ohio’s public records law. Any records created or received as a part of this Agreement shall be made available to the City upon request subject to exceptions listed below. Any non-private health information in confidential records or information in the records created by the Board or that come into the possession of the Board under this Agreement shall, if provided to the City, be kept confidential by the City. The Board is prohibited by State and Federal law from sharing protected health information and said records will not be shared with the City unless there is compliance with the proper method for release of said information. 5. NO ASSIGNMENT, TRANSFER, OR SUBAGREEMENT. In performing the services specified under the terms of this Agreement, the Board shall not assign, transfer, or delegate any of the work or services, nor subcontract the work out to any other entity, nor shall any subcontractor commence performance of any part of the work or services included in this Agreement, unless such subcontracting is specified in this Agreement or its Exhibits, or unless prior written consent is provided by the City. 6. INDEPENDENT AGREEMENT. (a) (b) The Board hereby acknowledges that it is an independent contractor and neither it nor its employees or agents are employees of the City. The Board shall be responsible for the payment or withholding of any federal, state or local taxes, including, but not limited to, income, unemployment, and workers’ compensation for its employees, and the City will not provide, or contribute to any plan which provides for benefits, including but not limited to unemployment insurance, workers’ compensation, retirement benefits, liability insurance or health insurance. All individuals employed by the Board provide personal services to the City are not public employees of the City under Ohio state law. No agency, employment, joint venture or partnership has been or will be created between the parties pursuant to the terms and conditions of this Agreement. Inasmuch as the City is interested in the Board’s end product, the City does not control the manner in which the Board performs this Agreement. 7, NOTICES. APPLICABLE LAW AND VENUE Any and all matters of dispute between the Parties to this Agreement whether arising from the Agreement itself or arising from alleged extra contractual facts prior to, during, or subsequent to the Agreement, including without limitation, fraud, misrepresentation, negligence, or any other alleged tort or violation of the Agreement, will be governed by, construed, and enforced in accordance with the Laws of the State of Ohio, without regard to the conflict of laws or the legal theory upon which such matter is asserted. 7, SEVERABILITY. If any provision hereof shall be determined to be invalid or unenforceable, such determination shall not affect the validity of the other provisions of this Agreement. Moreover, any provisions that should survive the expiration or termination will survive the expiration or termination of this Agreement. 8 AMENDMENT This Agreement shall not be modified except by the express written consent by both parties hereto. 9, WAIVER. Waiver by either party or the failure by either party to claim a breach of any provision of this Agreement shall not be deemed to constitute a waiver or estoppel with respect to any subsequent breach of any provision hereof. 10. FORCE MAJEURE. Neither party shall be liable for any delay or failure to perform any duty or obligation it may have pursuant to this Agreement where such delay or failure has been occasioned by any act of God, fire, strike, inevitable accident, war or any cause outside the party's reasonable control. 11. COUNTERPARTS This Agreement may be executed in several counterparts, each of which shall be deemed to be an original copy, and all of which together shall constitute one Agreement binding on all parties hereto, notwithstanding that all the parties shal! not have signed the same counterpart. ENTIRE AGREEMENT, This Agreement constitutes the entire agreement of the parties with respect to its subject matter, and supersedes all prior and contemporaneous agreements, representations or understandings, whether written or oral, as to the same. WHEREAS, the property owners need to construct the proposed shore structure in Lake Erie at Lakewood, Cuyahoga County, Ohio; and WHEREAS, as part of the application to lease submerged lands, the parties involved must submit to the Ohio Department of Natural Resources a resolution from Lakewood City Council approving the proposed use of the submerged land; and WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, this Council by a vote of at least two thirds of its members determines that this resolution is an emergency measure and that it shall take effect immediately, and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments in that this submerged lands lease is necessary for the improvements to be made; now, therefore BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. The City of Lakewood finds and determines that territory being proposed for the proposed shore structure, which is further described in the application for a submerged lands lease, is not necessary or required for the construction, maintenance or operation by the municipal corporation of breakwaters, piers, docks, wharves, bulkheads, connecting waterways, water terminals, facilities and improvements, and marginal highways in the aid of navigation and water commerce, and the land uses specified in the application comply with regulation of permissible land use as determined by the city. Section 2. The Clerk of Council is hereby authorized and directed to certify a copy of this resolution to the Ohio Department of Natural Resources. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this Resolution were passed in open meetings of this Council and that all deliberations of this Council and any of its committees that resulted in such actions were in meetings open to the public and in compliance with legal requirements. 068

This resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health, safety and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in the preamble to this ordinance, and provided it receives the affirmative vote of at least two thirds of the members of Council, this resolution shall take effect and be in force immediately upon its adoption by the Council and approval by the Mayor, or otherwise it shall take effect and be in force after the earliest period allowed by law. RESOLUTION NO. BY: A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least two thirds of the members of Council, or otherwise to take effect and be in force after the earliest period allowed by law, approving the use of submerged lands for property located at 1039 Forest Cliff Drive, Lakewood, Ohio PPN 311-13-074 ( a legal description of which is attached hereto as Exhibit “A”), in order to permit the owners the opportunity to construct the proposed shore structure.
