[2026-6 Rezone Parcel 236-17-018.pdf] CITY OF NORTH OLMSTED ORDINANCE NO. 2026 - 6 BY: Mayor Jones AN ORDINANCE PROVIDING FOR THE AMENDMENT OF THE ZONE MAP OF THE CITY OF NORTH OLMSTED BY REZONING PERMANENT PARCEL NO. 236-17-018, FROM MIXED USE “A” DISTRICT TO GENERAL BUSINESS DISTRICT “B-3”. WHEREAS, the Schedule of Uses for Mixed Use District A, among other restrictions, permits “Restaurants without drive through facilities”. Table 1149.03-1. Schedule of Uses, Accommodations, Hospitality and Entertainment; and WHEREAS, the Schedule of Uses for General Business District “B-3”, among other restrictions, permits “Restaurants with drive through facilities”. Table 1139.03-1, Schedule of Uses, Accommodations, Hospitality and Entertainment; and WHEREAS, the Administration and Director of Economic and Community Development recommends that the Zone Map be amended to Rezone PPN 236-17-018 from Mixed Use District A to General Business District B-3 in order to accommodate a Restaurant with drive through facilities at the site of the former Lone Star Steakhouse on Country Club Blvd., east of Great Northern Blvd., which has been vacate for a substantial period of time; and WHEREAS, on the ____ day of _____________, 2026, by formal motion, the Planning and Design Commission recommended / did not recommend the adoption of this Ordinance, proposing to rezone the real property, as identified and fully described herein, from Mixed Use District A to General Business District B-3; and WHEREAS, following publication of newspaper notice and notice to the record title holders of real property located within one thousand (1,000) feet of the property proposed to be rezoned, a public hearing was held, in conformance with the provisions of Section 14 of Article IV of the Charter and Section 1127.03 of the Zoning Code, on the ____ day of ___________, 2026; WHEREAS, this Council, upon the recommendation and review of the Director of Economic and Community Development, finds that rezoning Permanent Parcel No. 236-17-018, from Mixed Use District A to General Business District B-3 will further, and bears a substantial relation to, the public health, safety, and welfare, and that said rezoning will promote orderly development of restaurant use with drive through facilities on this parcel of land. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: 2 SECTION 1: That the Zone Map of the City of North Olmsted is hereby amended, and, as amended, shall depict and state that the zoning of the following parcel of land located within the City, to-wit: Permanent Parcel No. 236-17-018. A true and accurate copy of the legal description for said parcel, as well as a map depicting the parcels, is attached to this Ordinance as, respectively, Exhibits “A” and “B.” SECTION 2: That the City Engineer be and he hereby is directed to amend the Zone Map of the City of North Olmsted so that when amended, the said Zone Map will disclose that the zoning classification of the land identified and described in Section 1 hereof has been changed from Mixed Use District A to General Business District B-3, and that said parcel of land may be thereafter used only in accordance with the uses permitted and the regulations provided in Chapter 1139, specifically categorized as B-3 pursuant to Section 1139.01(B) and as further regulated pursuant to the applicable provisions of the Zoning Code of the City of North Olmsted as they may be from time to time amended. SECTION 3: That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
