[2022-24 Toro Mowers.pdf] CITY OF NORTH OLMSTED RESOLUTION NO. 2022 - 24 By: Mayor Jones A RESOLUTION AUTHORIZING THE MAYOR TO PURCHASE TWO (2) NEW TORO GREENSMASTER TRIFLEX 3300 HYDRAULIC MOWERS FROM JERRY PATE TURF & IRRIGATION AT A COST OF $105,332.82 THROUGH THE STATE PURCHASE PROGRAM, AND FURTHER AUTHORIZING THE MAYOR TO EXECUTE ALL CONTRACT DOCUMENTS, AND DECLARING AN EMERGENCY. WHEREAS, the Springvale Golf Course Superintendent recommends that the City acquire two (2) new Toro 3300 Greensmaster Mowers from Jerry Pate Turf & Irrigation for use at Springvale Golf Course, quoted at cost of $105,332.82, as established by the State Purchase Program; and WHEREAS, it is the desire of this Council to authorize the Mayor to purchase said equipment through the State Purchase Program and to further authorize the Mayor to execute any contract documents required for such equipment. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and she is hereby authorized to purchase through the State Purchase Program, which was established by R.C. Section 125.04, and which the City is authorized to participate in pursuant to the City Charter and Resolution No. 87-6, two (2) new Toro 3300 Greensmaster Mowers from Jerry Pate Turf & Irrigation for use at Springvale Golf Course, at a cost quoted at $105,332.82, as established on the State Purchase Program, all of which is described in the Quotation on file. Further authoring an additional amount in excess of said quote in the event that said quote should expire prior to acceptance so long as any such increase is approved by the Mayor and further conditioned upon appropriation of sufficient funds by Council. The Mayor is hereby authorized to execute any contract documents with vendors and, as necessary, to effectuate the State Purchase Program. Any contract executed by the Mayor shall be in a form and substance consistent with the provisions of this Resolution and be approved by the Director of Law. SECTION 2: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare and for the further reason that this legislation must go into effect immediately so that the purchase orders can secure the quoted price and request delivery as soon as available; and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
