ORDINANCE NO. 2023 -95

AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF 
NORTH OLMSTED TO REZONE A PORTION OF SPLIT PARCEL 
233-26-063 FROM ONE FAMILY RESIDENCE TO B-3 GENERAL 
BUSINESS ZONING, AS AMENDED.  
 
 
WHEREAS, the City of North Olmsted acquired Parcel Nos. 233-26-063, 064, and 065, 
(commonly known as Forest Elementary School on Tudor Drive) from the North Olmsted Board 
of Education for the purpose of economic development; and 
 
 
WHEREAS, the Director of Economic and Community Development has negotiated with 
the owner of Weber Automotive, located at 28820 Lorain Road, a proposal to split a portion of 
Parcel 233-26-063, in order to enter into an agreement to split the parcel and sell the southerly 
portion of said real estate to Weber Automotive for the purposes of expansion of its business 
operations, subject to the approval of this Council and further subject to the Council’s approval 
of rezoning for same; and 
 
 
WHEREAS, the Director of Economic and Community Development further 
recommends, conditioned upon the Council’s approval of the said real estate purchase 
agreement, to rezone the split portion of Parcel 233-26-063 from its current B One Family 
Residence to B-3 General Business commercial zoning in order to accommodate the business 
expansion of Weber Automotive; and 
 
 
WHEREAS, following duly noticed public hearing pursuant to and in conformance with 
the provisions of Section 2(d) of Article VII of the Charter and Section 1127.02, the Planning 
and Design Commission, considered and voted to recommend (not recommend) approval of this 
Ordinance to change the Zone Map and rezone a portion of Parcel 233-26-063 on _____ day of 
______________, 2023; and    
 
 
WHEREAS, following publication of newspaper notice and notice to the record title 
holders of real property located within one thousand (1,000) feet of the property proposed to be 
rezoned, a public hearing was held, in conformance with the provisions of Section 14 of Article 
IV of the Charter and Section 1127.03 of the Zoning Code, on the ____ day of ___________, 
2023; 
 
 
WHEREAS, it is the desire of this Council to amend the Zoning Code and to specially 
rezone the split portion of Parcel 233-26-063, all as recommended by the Planning and Design 
Commission, in order to promote economic development and conditioned upon Council’s 
independent approval of a real estate purchase agreement with Weber Automotive.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 
NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: 
 
 
SECTION 1: That the Zone Map of North Olmsted is hereby amended, and, as amended, 
shall depict and state that the zoning for a total of .6615 .6629 acres, or 28,816 28,876 square feet 
commencing at the southern property line of PPN 233-26-063 shall be in part, zoned for B-3 
General Business Zoning district use.  A true and accurate copy of the Map depicting the parcels, is 
attached to this Ordinance as Exhibit “A.” 
 
SECTION 2: That the Clerk of Council be and she is hereby directed to cause notice of a 
Public Hearing hereon to be given pursuant to the provision of Section 14 of Article IV of the 
Charter of the City. 
 
SECTION 3: That the City Engineer be and he hereby is directed to amend the Zone Map 
of the City of North Olmsted so that when amended, the said Zone Map will disclose that the 
zoning classification of the said south portion of parcel of land described in Section 1 hereof has 
been changed from B One Family Residence to B-3 General Business, and that said parcels of land 
may be thereafter used only in accordance with the uses permitted and the regulations provided in 
the B-3 General Business district of the City pursuant to the applicable provisions of the Zoning 
Code of the City of North Olmsted as they may be from time to time amended. 
 
SECTION 4: That this Ordinance shall take effect and be in force from and after the 
earliest period allowed by law.
