ORDINANCE NO. 2025 - 35

AN ORDINANCE AMENDING AND RESTATING SECTION 159.04 OF 
CHAPTER 159 (ARTS COMMISSION) OF THE CODIFIED ORDINANCES 
OF THE CITY OF NORTH OLMSTED IN ORDER TO PROVIDE REVIEW 
STANDARDS FOR CREATION OF MURALS ON PRIVATE COMMERCIAL 
PROPERTY, AS AMENDED. 
 
WHEREAS, Chapter 159 provides for the Arts Commission, including its Duties in 
Section 159.04; and  
 
WHEREAS, the Arts Commission proposes and the Director of Economic and 
Community Development recommends that the Commission’s duties be expanded by Council to 
provide for the creation of decorative murals on commercial private property; and 
 
WHEREAS, it is the desire of Council to enable the Arts Commission to review and 
approve murals on commercial private property by the amendment of Section 159.04.       
  
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 
NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: 
 
 
SECTION 1: That Section 159.04 of Chapter 159 (Arts Commission) of the Codified 
Ordinances, which currently reads as follows: 
 
159.04 DUTIES. 
It shall be the duty of the Arts Commission to develop a plan for the promotion of the arts 
and cultural events in the City and to make recommendations to the administration and City 
Council on the implementation of arts programs and community events. 
    
 
(a)   The Commission shall support and conduct events and entertainment which 
celebrate the City of North Olmsted, identifying potential and necessary resources to ensure 
programs and events are conducted in a manner that is enjoyable, safe and environmentally 
sustainable. 
    
 
(b)   The Commission shall approve all art purchased, commissioned, or accepted as a 
gift by the City, as well as all art proposed for placement anywhere within the public right-of-
way or on property owned or leased by the City. Commission approval is also necessary before 
any art subject to their approval can be in any way altered or removed. 
    
 
(c)   The Commission shall support and assist City departments and divisions in the 
organization of community events and facilitate communications amongst organizers, media and 
participants. 
   
 
(d)   The Commission shall develop programs and events within the City that will support 
the community and its businesses and that will bring the City and surrounding communities

boldface type and removed language stricken:

(e) The Commission shall review and approve of the creation and installation of 
murals or banners on private commercial property pursuant to standards established by 
Section 159.05 and subject to sign limitations established in Chapter 1163. 
  
 
SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with 
this Ordinance, is, to the extent of any such conflict or inconsistency, repealed.  Conflicting or 
inconsistent provisions of any Ordinance shall be corrected at re-codification.      
 
SECTION 3: That this Ordinance shall take effect and be in force from and after the 
earliest period allowed by law.
