CITY OF NORTH OLMSTED 
ORDINANCE NO. 2022 - 14

AN ORDINANCE AMENDING SECTION 351.13 AND 351.14 
ENTITLED RESPECTIVELY, “SNOW STORM EMERGENCIES” 
AND “ANNOUNCING EMERGENCY; PARKING REGULATIONS” 
OF CHAPTER 351 OF THE TRAFFIC CODE OF THE CODIFIED 
ORDINANCES OF THE CITY OF NORTH OLMSTED, ENTITLED 
“PARKING GENERALLY”, IN ORDER TO ALLOW THE MAYOR TO 
DECLARE SNOW EMERGENCY PARKING BANS ON CITY 
STREETS, AND DECLARING AN EMERGENCY. 
  
WHEREAS, Section 351.13, “Snow Storm Emergencies” of Chapter 351 of the 
Codified ordinances of the City of North Olmsted provides the framework for the City to 
determine and declare an emergency parking ban due to snowfall; and  
 
WHEREAS, the Mayor and Director of Public Safety have reviewed Code 
Section 351.13 with the Chief of Police and recommend amendments in order to declare 
and impose a parking ban, if necessary, in anticipation of snowfall emergencies and 
based upon forecasted weather events; and  
 
WHEREAS, the notice provisions of Section 351.14 are antiquated and in need of 
updating; and  
 
WHEREAS, this Council wishes to amend the Code to enable the Mayor to 
declare an emergency parking ban based upon forecasted weather events in anticipation 
of the snowfall emergency conditions.      
 
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY 
OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: 
 
 
SECTION 1: That section 351.13 of the Traffic Code, shall be amended and as 
amended shall read in its entirety as follows, with amendments identified in bold, 
strikethrough and underlined text: 
 
351.13  SNOW STORM EMERGENCIES. 
    
(A) Whenever, during any period of twenty-four hours or less, snow falls in the 
City, more particularly on Lorain Road, Brookpark Road (Route 17), 
Butternut Ridge Road, Clague Road, Columbia Road, Dover Center Road, 
Barton Road (north and south), Fitch Road, Walter Road, Porter Road, 
Kennedy Ridge Road, Fleharty Road, McKenzie Road and Mastick Road 
and/or any other streets that are determined from time to time to require the 
enforcement of this section and Section 351.14, to a depth of two inches or 
more, an emergency is declared to exist in that such a heavy snow storm

constitutes a serious public hazard.  Such emergency shall continue until an 
announcement is made by the Director of Public Safety that snow plowing 
operations have been completed, which announcement shall be made in the 
same manner as outlined in Section 351.14.   
 
(B) In addition to the provisions of Section (A) herein, in the event that 
significant snowfall is forecasted, the Mayor is authorized to declare a 
Snow Emergency to exist commencing at a specified date and time in that 
such an impending heavy snow storm will constitute a serious public 
hazard.  With such declaration, the provisions set forth in Section 351.14 
shall be in effect.  Such emergency shall continue until an announcement 
is made by the Director of Public Safety that snow plowing operations 
have been completed, which announcement shall be made in the same 
manner as outlined in Section 351.14. 
 
 
351.14  ANNOUNCING EMERGENCY; PARKING REGULATIONS. 
 
Whenever such a snow emergency exists, the Director of Public Safety shall 
request the cooperation of the local press and radio and television stations and 
local media internet websites to announce the emergency and the time that 
emergency parking regulations will become effective, which time shall be no 
sooner than one hour after the first announcement., and such announcement by 
two local radio stations, two local television stations or in a daily newspaper 
of general circulation in the City shall constitute notice to the general public 
of the existence of the emergency.  The emergency shall also be announced on 
the City website.  However, the owners and operators of motor vehicles shall 
have full responsibility to determine existing weather conditions and to comply 
with the emergency parking regulations. 
 
During the period of the emergency, the Director of Public Safety may prohibit 
the parking of any vehicles upon any or all of the City streets.  During the 
emergency, no person shall park, cause to be parked, permit to be parked or 
permit to remain parked or to abandon or leave unattended, any vehicle of any 
kind or description upon the streets specified in Section 351.13.  However, 
vehicles may be parked for a period of not longer than three minutes for actual 
loading or unloading of passengers, or thirty minutes for actual loading or 
unloading of property, provided that no other ordinance restricting parking as to 
place or time is violated thereby. 
 
Any motor vehicle parked in violation of the prohibitions of this section may be 
impounded in accordance with the provisions of Section 303.08 at the cost and 
expense of the owner thereof, provided that in the event the Director of Public 
Safety authorizes additional emergency equipment to be used, the fees to be 
charged for towing and storage by authorized agents shall conform to the fees as 
assessed by the City for the same service.

SECTION 2:  That this Ordinance is hereby declared to be an emergency 
measure immediately necessary for the preservation of the public health, safety and 
welfare, and, additionally, it is necessary that this Ordinance go into effect immediately 
to ensure that the Safety and Service forces are prepared in advance of the next snow 
storm, and provided it receives the affirmative vote of two-thirds of all members of 
Council, then it shall take effect and be in force immediately upon its passage and 
approval by the Mayor.
