A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A
RENEWED
MEMORANDUM
OF
UNDERSTANDING
WITH
CUYAHOGA SOIL AND WATER CONSERVATION DISTRICT TO
PROVIDE ASSISTANCE TO THE CITY OF NORTH OLMSTED
WITH THE PUBLIC EDUCATION AND PUBLIC PARTICIPATION
MEASURES FOR ITS MUNICIPAL STORM WATER PERMIT
(MS4), AND DECLARING AN EMERGENCY
WHEREAS, the City has previously entered into a Memorandum of
Understanding (“MOU”) with the Cuyahoga Soil and Water Conservation District to
provide Public Intervention / Public Education; and
WHEREAS, the previous MOU is expiring; and
WHEREAS, public intervention / public education are required under the City’s
Municipal Storm Water Program MS4 permit; and
WHEREAS, the City requires the professional services of the Cuyahoga Soil and
Water Conservation District to effectively and efficiently administer the required public
intervention and public education requirements necessary under the City’s MS4 permit;
and
WHEREAS, this Council desires to enter into a renewed Memorandum of
Understanding with the Cuyahoga Soil and Water Conservation District to provide
assistance to the City with the public education and public participation measures for its
MS4 permit.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO:
SECTION 1: That the Mayor be and is hereby authorized to enter into a renewed
Memorandum of Understanding with the Cuyahoga Soil and Water Conservation District
to provide assistance to the City with the public education and public participation
measures for its MS4 Permit, a copy of which is attached hereto as Exhibit "A" and
incorporated herein by reference, which is in all respects hereby approved.
SECTION 2: That this Resolution is hereby declared to be an emergency
measure immediately necessary for the preservation of the public health, safety and

welfare, and for the reason that it is necessary that this Resolution go into effect
immediately so as to continue the provision of service without interruption and to be able
to participate in intervention and education activities; and further provided it receives the
affirmative vote of two-thirds of all members of Council, it shall take effect and be in
force immediately upon its passage and approval by the Mayor.
