WHEREAS, upon review, the Director of Economic and Community Development recommends this Council consider amendments to Section 1139.03 in order to condition and limit the establishment of specified uses, to wit Thrift Stores, as a Conditional Use in the B-3 Zoning District, subject to the Conditional Use restrictions proposed in 1118.13(G); and WHEREAS, the City of North Olmsted is evaluating, by and through its 2025 Comprehensive Master Plan, expected to be introduced for review in July, 2024, and expects to establish, as Goal 2 “Advancing Prosperity” that the City’s zoning code should “Create a Business Mix Matrix” by the establishment of a “more diverse and desirable mix” by the restriction of saturated retail uses; and WHEREAS, the City of North Olmsted shall review, by and through its 2025 Comprehensive Master Plan, expected to be introduced for review in July 2024, in Chapter 2, “Evaluation of Current Conditions” the identification of Used Merchandise Stores among 2017 Industry Groups, and which found substantial excess of same in the Leakage/Surplus Analysis and Market Demand Analysis, and which support changes in the City’s zoning code to restrict and limit such retail uses, which have continued to proliferate since 2017; and WHEREAS, following publication of newspaper notice in conformance with the provisions of Section 14 of Article IV of the Charter and Section 1127.03 of the Zoning Code, a public hearing was held on the _________ of ______, 2024; and WHEREAS, after careful consideration, the Planning and Design Commission of the City, on the ____ day of __________, 2024, by formal motion, recommended that this Ordinance amending Section 1139.03 of the Zoning Code, presently entitled “Schedule of Uses” be (approved) (disapproved); and WHEREAS, it is the desire of this Council to amend Planning and Zoning Code Section 1139.03, as recommended by the Planning and Design Commission, in order to identify “Thrift Stores” as a Conditional Use in the B-3 Zoning Districts as set forth in the Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: 2 SECTION 1: That Section 1139.03 of the Zoning Code of the City of North which reads in its entirety as attached in Exhibit A, shall be amended and, as amended shall read in entirety as attached in Exhibit B. SECTION 2: Any other Ordinance, or part of Ordinance, which is inconsistent or in conflict with any of the provisions of this Ordinance is, to the extent of any such inconsistency or conflict, hereby repealed. SECTION 3: That this Ordinance shall take effect and be in force from and after the earliest period allowed by law as specified in the Charter of the City of North Olmsted.
