139.01 ESTABLISHMENT.

Pursuant to the authority of the Charter, Article V Section 1, there is hereby established
the Department of Public Safety. The staffing of the Department of Public Safety is hereby
established and is reflected in the organizational chart for the Department of Public Safety
contained in Section 139.99(a), which is incorporated herein as if fully rewritten.

139.02 DIRECTOR OF PUBLIC SAFETY.
The Department of Public Safety shall be headed by the Director of Public Safety.

(a) Appointment, Term, Removal and Qualifications. The Director shall be a full-time
employee appointed by the Mayor, which appointment and term shall be governed by
Charter Art. III, §5(a). The Director of Public Safety may also serve as the Director of Public
Service, if so appointed by the Mayor. The Mayor may remove the Director with the
concurrence of two-thirds (2/3) of the members of Council eligible to vote.

(b) Duties. The Director of Public Safety shall have charge of the Department of Public
Safety. The Director shall make all the necessary rules and regulations for the governance
of the Department and the divisions thereof. She or he shall be charged with the duty of
enforcing all police, fire, safety, health and sanitary regulations that may be prescribed by
ordinances of the City or, when applicable, the general laws of Ohio. The Director of Public
Safety shall be the head of the Division of Fire, the Division of Police and the Division of
Building.

139.03 ADMINISTRATIVE SECRETARY TO THE DIRECTOR OF PUBLIC SAFETY.

There is hereby created the position of Administrative Secretary to the Director of Public
Safety, which shall be appointed by and be answerable to the Director of Public Safety. The
Administrative Secretary shall be the secretary to the Director, and shall provide clerical
and secretarial services to the Director. The Administrative Secretary shall also provide

such other services and perform such other duties consistent with the position as may be
required by the Director.

139.04 DIVISION OF POLICE.

There is hereby established a Division of Police within the Department of Public Safety.
The Division of Police shall be headed by the Chief of Police.

(a) Duties. The Chief of Police shall be responsible for the organization and supervision
of the Division of Police. Included within the supervisory authority of the Chief of Police
shall be sworn police officers of all ranks within the Division of Police, Central Emergency
Dispatchers, Correction Officers, Secretaries, Auxiliary Officers and School Crossing Guards.
The Chief of Police shall also perform all duties and exercise all authority granted to Chiefs
of Police in the North Olmsted Codified Ordinances, the Ohio Revised Code and the Ohio
Administrative Code.

(b) Employees. The staffing of the Division of Police is hereby established and is
reflected in the organizational chart for the Department of Public Safety contained in
Section 139.99(b), which, as it pertains to this division only, is incorporated herein as if
fully rewritten. The Mayor shall establish the compensation of all employees of the Division
within the salary ranges established by City Council, to the extent that such compensation
is not otherwise established by contract, or federal, state, or local law.

(c) Petty Cash Fund. There is hereby established a petty cash fund in the amount of four
hundred dollars ($400.00) to be used for limited expenditures, including but not limited to
prisoner meals, under the supervision of the Chief of Police, and in accordance with
procedures established by the Finance Department.

139.05 DIVISION OF FIRE.

There is hereby established a Division of Fire within the Department of Public Safety. The
Division of Fire shall be headed by the Chief of Fire.

(a) Duties. The Chief of Fire shall be responsible for the organization and supervision of
the Division of Fire. Included within the supervisory authority of the Chief of Fire shall be
firefighters of all ranks, whether part-time or full time, and Secretaries. The Chief of Fire
shall also perform all duties and exercise al] authority granted to Chiefs of Fire in the North
Olmsted Codified Ordinances, the Ohio Revised Code and the Ohio Administrative Code.

(b) Employees. The staffing of the Division of Fire is hereby established and is reflected
in the organizational chart for the Department of Public Safety contained in Section
139.99(c), which, as it pertains to this Division only, is incorporated herein as if fully
rewritten. The Mayor shall establish the compensation of all employees of the Division
within the salary ranges established by City Council, to the extent that such compensation
is not otherwise established by contract, or federal, state or local law.

139.06 DIVISION OF BUILDING.

There is hereby established a Division of Building within the Department of Public Safety.
The Division of Building shall be headed by a Building Commissioner who shall be

responsible for its organization and supervision. The Building Commissioner shall be
appointed by and be answerable to the Director of Public Safety. The qualifications for the
Building Commissioner shall be those as established in rules and regulations enacted and
amended from time to time by the State of Ohio, Board of Building Standards, as they relate
to certification of local Building Departments and Building Officials.

(a) Duties. The duties of the Building Commissioner shall include the supervision of all
personnel of the Division of Building, the issuance of all building permits, the enforcement
of all building and zoning regulations and the execution of all duties and authority granted
to Building Commissioners / Chief Building Officials by the North Olmsted Codified
Ordinances, the Ohio Revised Code and the Ohio Administrative Code. The Director of
Public Safety may from time to time require the Building Commissioner to perform
additional duties consistent with the position.

(b) Employees. The staffing of the Division of Building is hereby established and is
reflected in the organizational chart for the Department of Public Safety contained in
Section 139.99(d), which, as it pertains to this Division only, is incorporated herein as if
fully rewritten. The Mayor shall establish the compensation of all employees of the Division
within the salary ranges established by City Council, to the extent that such compensation
is not otherwise established by contract, or federal, state or local law.

139.99 COMPOSITION AND ORGANIZATION OF THE DEPARTMENT OF PUBLIC SAFETY.

The positions set forth herein shall constitute the staff and organization of the
Department of Public Safety, together with all Divisions thereunder. They are as follows:
139.99(a), 139.99(b), 139.99(c) and 139.99(d).

There is hereby created a Division of Juvenile Diversion within the Department of
Public Safety. The Division shall be headed by a Juvenile Diversion Coordinator. The
position shall in the discretion of the Mayor be either part-time or full-time. The
Coordinator shall be appointed by and be answerable to Director of Public Safety.

(a) Duties. The Juvenile Diversion Coordinator shall have charge of and shall
supervise the employees, operations and programs of the Division of Juvenile
Diversion. The Juvenile Diversion Coordinator shall act as liaison with the Police
Department and courts relative to juvenile justice prevention services and diversion,
including the Juvenile Traffic Intervention Program ("JTIP"). The Coordinator shall
perform such other duties as required and directed by the Director of Public Safety
and additionally as set forth in the job description on file within the Office of
Director of Human Resources.

(b) Employees. The staffing of the Division of Juvenile Diversion is hereby
established and is reflected in the organizational chart for the Department of Public
Safety contained in Section 139.99(e), which, as it pertains to this Division only, is
incorporated herein as if fully rewritten.

AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 139 OF 
THE ADMINISTRATIVE CODE ENTITLED “DEPARTMENT OF PUBLIC 
SAFETY” IN ORDER TO ESTABLISH THE DIVISION OF JUVENILE 
DIVERSION WITHIN THE DEPARTMENT AT 139.07, AND DECLARING 
AN EMERGENCY. 
 
 
WHEREAS, this Council via Ordinance previously established the organization of the 
Department of Public Safety, including Organizational Charts, for the purpose of, among other 
things, organizing and / or stating the divisions and employee complement within the Department 
of Public Safety; and  
 
 
WHEREAS, Mayor Dailey Jones believes that maximum efficiency and operations can be 
achieved by reallocating the Division of Juvenile Diversion from the Department of Recreation 
and Public Engagement to the Department of Safety; and  
 
WHEREAS, Ordinance 2025-78, which was enacted by Council to accomplish the 
relocation of Juvenile Diversion into the Department of Public Safety inadvertently omitted 
required exhibits; and   
 
WHEREAS, it is the desire of this Council to implement the organizational changes 
recommended by Mayor Dailey Jones as set forth herein.  
 
 
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 
NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: 
 
 
SECTION 1:  That Chapter 139 “Department of Public Safety” which presently reads as 
set forth on the attached and incorporated Exhibit A, shall be amended and as amended shall read 
in its entirety as set forth on the attached and incorporated Exhibit B.  
 
SECTION 2:  That any ordinance, or part of ordinance, in conflict or inconsistent with this 
Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or 
inconsistent provisions of any Ordinance shall be corrected at re-codification. 
 
SECTION 3:  That this Ordinance is hereby declared to be an emergency measure 
immediately necessary for the preservation of the public health, safety and welfare, and, 
additionally, it is necessary that this Ordinance go into effect immediately to ensure the continued, 
effective operations within the Department of Public Safety, and provided it receives the 
affirmative vote of two-thirds of all members of Council, then it shall take effect and be in force 
immediately upon its passage and approval by the Mayor.
