[2024-119 Bid Demo Dangerous Bldg.pdf] CITY OF NORTH OLMSTED RESOLUTION NO. 2024 - 119 BY: Mayor Jones A RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SAFETY TO SOLICIT STATEMENTS OF QUALIFICATIONS (“S.O.Q.”) FOR INDIVIDUALS QUALIFIED TO DEMOLISH AND REMOVE DANGEROUS BUILDINGS LOCATED WITHIN THE CITY OF NORTH OLMSTED DETERMINED TO BE A PUBLIC NUISANCE, AND FURTHER AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH THE INDIVIDUAL SELECTED IN THE R.F.Q. PROCESS AND APPROVED BY THE BOARD OF CONTROL, AND DECLARING AN EMERGENCY. WHEREAS, over the past several years the City of North Olmsted has experienced multiple structure fires resulting in a total loss of the structures and, further, the complete loss of the Pinball Shoppe due to a roof collapse; and WHEREAS, on each occasion the Building Commissioner issued appropriate orders condemning the building and ordering demolition to protect the public health, safety and welfare; and WHEREAS, in each instance of loss due to fire, the City has received from the insurance carrier, pursuant to R.C. 3929.86, funds “to be used solely as security against the total cost of removing, repairing, or securing incurred by the municipal corporation or township pursuant to section 715.261 or 505.86 of the Revised Code” and WHEREAS, on several occasions, demolition of condemned, dangerous structures has been unreasonably delayed up to months due to negotiations between contractors, home owners and other lien claimants; and WHEREAS, delays in demolition resulted in noxious odors, unsightly conditions and, in one instance, individuals ignoring the Building Commissioner’s Order and entering into the condemned, dangerous building; and WHEREAS, it is the desire of the Administration to pre-qualify contractors to demolish dangerous buildings condemned due to fire or other sudden, catastrophic loss via the R.F.Q. process. Such pre-qualification would permit the City to move quickly when necessary to safeguard the public health, safety and welfare by demolishing such buildings, when other efforts fail to abate the condition within the required period of time. Upon the occurrence of a qualifying event and an order to demolish a dangerous building, the City would seek quotes from the pre-qualified vendors and proceed with the contractor’s quote deemed best under the circumstances as approved by the Board of Control; and WHEREAS, it is the desire of this Council to authorize the Mayor to proceed with the R.F.Q. process to pre-qualify contractors to demolish dangerous buildings condemned due to fire or other sudden, catastrophic loss. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Director of Public Safety be and she is hereby authorized to solicit S.O.Q.s via the R.F.Q. process to pre-qualify contractors to be utilized to demolish and remove dangerous buildings located in the City of North Olmsted, based upon demolition Orders issued by the Building Commissioner, in order to protect the health, safety and general welfare of the citizens. SECTION 2: That the Mayor be and he is hereby authorized to enter an agreement with a pre-qualified demolition contractor, as recommended by the Director of Public Safety following the receipt of quotes and approval by the Board of Control, to provide for and proceed with the razing of any dangerous building in the City of North Olmsted. SECTION 3: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that it is necessary that this legislation be effective immediately so that the public nuisance can be abated by the City expeditiously, and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
