MR. YATES: All right, guys, so I'm going to hit "record" so we can record this. All right. This is the Zoning Board of Appeals meeting; date, July 24th, 2025, and does everybody have an agenda if you need one? MR. FINDLAN: (Indicating). MR. YATES: Roll Call has already been taken, so I'm going to go ahead and just begin this meeting, so this meeting will look at -- we got an application for a variance to the minimum front yard setback requirements and the minimum right of way setback requirements for a front porch replacement at the property of 131 Groveland Street, okay. Kenneth Smith, the property owner of 131 Groveland Ave, has applied for a variance to the minimum front yard setback requirements and to the minimum right of way setback requirements for a proposed front porch addition at the property listed, so the applicant proposed the construction of a 7 foot long by 4 foot wide one-story front porch addition. This proposed addition will also be serviced by a porch roof. The proposed porch will encroach the current front yard property line and the current front yard right of way setback by MARLENE S. 4 foot, but there's a caveat here; this property's front yard line setback and front yard right of way setback do not correlate with code, so... In 2010 for the R-1 District Code change, they changed the setback to 60 foot from the middle of the street right of way, and you're supposed to have a 30 foot front yard. As his property exists today, he has a right of way setback of 39 feet, close to 40 -- closer to 40, and he has a front yard of 15 foot 6 without the porch. That's what requires us to do this -- to have -- have this (inaudible) held as a variance, meaning, that even though he's only butting out 4 foot, you know. The property to (inaudible) does not correlate with the current code, but is grandfathered in, so -- MR. CAMPBELL: Weren't we going to do something about changing this -- MR. YATES: Yes == MR. BRUCE LACZKO: The house sits 16 feet from the easement line, and all the other houses were built after zoning was -- was enacted. They're about 30 feet from the easement line -- MR. YATES: Yes. BRUCE LACZKO: -- so I'm not sure I don't -- I haven't seen exactly what a person wants to build -- MR. YATES: Uh huh. BRUCE LACZKO: -- but it would be a -- the way of obstruction to the corner, you know, seeing what -- you know, for people going right on Groveland or left on -- MR. BRUCE LACZKO: -- so... but I think -- I don't know exactly what this thing would look like, this construction MR. YATES: Uh huh. BRUCE LACZKO: Okay. So where does this go, here or there? ZITA SMITH: No. KENNETH SMITH: Here. BRUCE LACZKO: There? KENNETH SMITH: This is part here. That's part of them there. MR. YATES: Here you go. KENNETH SMITH: That's going to go on that side of it. BRUCE LACZKO: Built out -- oh, yeah, (inaudible) there? The proposal, you know, would bring out 13 minus, you know -- 16 minus whatever's built, you know, if -- if you're to really put it farther out of line with the curb. MR. KENNETH SMITH: Ah, I don't agree, but =-- BRUCE LACZKO: I think this is a subject of interest to the Historic Preservation Committee. I think it became one of the (inaudible). MR. YATES: It would be if it was labeled -- it would be if the house was on the National Registry. The house is not on the National Registry, so it does not require a Historic Preservation approval. (BRIEF PAUSE). MR. YATES: Any other questions? KENNETH SMITH: And the design that we are wanting to do would actually be brought in line with the era of the house. MR. YATES: Yes. KENNETH SMITH: We're going to be putting in an Italian age look. MR. YATES: The Smith's traced the house back to 1933. KENNETH SMITH: Jacob Hallauer. MR. BRUCE LACZKO: -- the validity of the City Zoning Ordinances. MR. YATES: You're right, and that's why October lst, we are having a zoning update. This Commission is going to meet with the Planning Commission, and we are going to update all these ordinance, including looking at those. BRUCE LACZKO: Or make this to the people incogitant, special exceptional zone, (chuckle). MR. YATES: No. We are probably going to change the ordinance, so... he is officially -- being that this house was built before this building code that governs that area was active, he is grandfathered in. looking to address that, so... we don't know why somebody came in in 2000 and had to change that code -- BRUCE LACZKO: Okay. MR. YATES: -- because he's not the only house that has that setback, no. If you look, there's houses all along that are listed R-1 around here that have the same setback problem. KENNETH SMITH: (Inaudible). UNIDENTIFIED: Yeah. MR. YATES: Yeah. KENNETH SMITH: Our whole neighborhood, nobody meets -- MR. YATES: Nobody. KENNETH SMITH: -- the code. MR. YATES: Yeah, yeah. The reason to have a variance, So... KENNETH SMITH: A lot of the houses in the area are the late 1800's to early 1900's, and none of them meet what the code says you're supposed to be -- none. MR. YATES: Right. KENNETH SMITH: We're all within -- MR. YATES: Yeah. KENNETH SMITH: -- some are closer, some are a little further back, but, you know, there's no uniformity to any of it. MR. YATES: Right, yeah. I know they're looking at this, but we're going to have a total zoning update because this zoning ordinance, among a lot other ones, side yard setbacks, ah, there's a lot of things that do not really function comfortably with normal residential use, you know. We have a 12 to 15 foot side yard setback or set up for accessory structures, but you're allowed to put your driveway right on the property line. Who wants to put their driveway on the property line and then have to make a, you know, a -- a left turn 15 foot and then come back up on their driveway? That's more of a, you know, controversial approval, if you ask me, in my opinion, than something like this -- MR. CAMPBELL: Uh huh. MR. YATES: -- so... all right.
