The Regular Council Meeting was called to order by President of Council Vito Dipierro presiding: COUNCIL MEMBERS PRESENT: ALLAN DIVIS KEVIN C. Stated, hearing none, the minutes will stand approved as printed. 2 COMMUNICATIONS, PETITIONS AND CLAIMS Chief Deputy Clerk Lisa Beeble read the following variance into the record: THE PARMA BOARD OF ZONING APPEALS met on Tuesday, June 10, 2025 at 6:30 pm and PROPOSED TO VARY, subject to the provisions of amended Ordinance Section 1127.13 (confirmation or rejection by Council within forty days of receipt of this notice) FOR THE APPLICANT Neff & Associates – Jeffrey Plautz, 6405 York Road, Parma Heights, Ohio, 44130; for: CMK – Daniel Komorowski, 5288-5294 State Road PPN: 443-29-040, 035, 034. The applicant is requesting a use variance to the City of Parma Codified Ordinance 1153.02 PRINCIPAL USES AND BUIDLINGS: within any Single-Family House District, no building or premises shall be erected, used, arranged or designed to be used, in whole or in part, for the other than single-family detached dwellings. The proposal is to operate a contracting business out of an existing garage on a single- family zoned parcel. A variance would result in allowing a plumbing contractor’s business to operate in the single-family district. The applicant is also requesting two variances to 1153.02 ACCESSORY USES AND BUILDINGS. The first variance request is to section (c): Parking of Commercial Vehicles. (2) only one commercial vehicle not exceeding a gross weight of 8,500 pounds or an overall height of 82 inches may be parked per dwelling unit. Such vehicles must be parked either in an enclosed garage or on a hard-surfaced driveway or turnabout to the rear of the front setback line of the residence. In addition to the above restrictions, there shall be no parking of the following commercial vehicle trucks: B – Dump trucks; G- Any vehicle with a dual set of rear wheels. The proposal is to store multiple taller, heavier commercial vehicles and one with a dual set of rear wheels at a single-family zoned parcel. A variance would result in allowing multiple oversized vehicles that are not permitted to be parked in a single-family district. The second variance request is to section (i): STORAGE OF CONSTRUCTION EQUIPMENT AND NONMOTORIZED TRAILERS. The storage of construction equipment and nonmotorized trailers is permitted on a lot, provided that such storage is not out in the open but is in a garage or other approved accessory building. The proposal is to store construction equipment outside in the open on a single-family zoned parcel. A variance would result in allowing construction equipment to be stored outside in the single-family district. After discussion, George Mastrobuono made a motion to deny CMK-Daniel Komorowski as written, because it can be obviated in another manner and justice would be done by not granting the variance and the essential character of the neighborhood would be substantially altered by granting these variances. Michelle Green seconded the motion. Michelle Green, George Mastrobuono, and George Ziefle voted no to the variance. Motion made by Councilwoman Shuman seconded by Councilwoman Lime to thereafter read the variance application by title only. Further moved to refer the variance to the Planning Committee. Signs in residential districts are permitted only in accordance with the regulations regarding maximum number, area and height as presented in the following schedule. RESIDENTIAL DISTRICTS SCHEDULE OF PERMITTED SIGNS Multi-Family Free-Standing (major) # - 1 per lot1 SF - 20 Ht - 5 The proposal is to construct a 50 square foot major free-standing sign that is 12’ 8” tall. A variance would result in allowing a major free-standing sign that is 30 square feet larger and 7’ 8” taller than code allows. Michelle Green made a motion to grant the variance as requested because it would not substantially alter the neighborhood and it would be aesthetically pleasing to keep it the same height requested in order to keep the foliage. George Mastrobuono seconded the motion. Michelle Green, George Mastrobuono, and George Ziefle voted yes to the variance. Motion made by Councilwoman Shuman seconded by Councilwoman lime to thereafter read the variance application by title only. Further moved to refer the variance to the Planning Committee. DIVIS (By Request – Service Director) AN ORDINANCE AUTHORIZING THE MAYOR AND/OR THE DIRECTOR OF PUBLIC SAFETY TO ENTER INTO A CONTRACT WITH AXON ENTERPRISES, INC., A SOLE SOURCE PROVIDER AND STATE BID CONTRACTOR, TO PURCHASE FIFTEEN (15) IN-CAR POLICE CRUISER VIDEO RECORDING SYSTEMS, TEN (10) BODY WORN CAMERAS, AND NINETY (90) PRO-USER LICENSES FOR THE EVIDENCE.COM PLATFORM TO MANAGE DIGITAL EVIDENCE FOR THE PARMA POLICE DEPARTMENT, AND DECLARING AN EMERGENCY Councilwoman Wilson – Asked what this equipment will cost? Councilwoman Shuman – Referred Councilwoman Wilson to Exhibit A, which shows the cost as $602,996.10. Councilwoman Lime – Asked if this was a budgeted item for 2025? Safety Director Coury – Yes, $120,000 will be required for 2025 which is accounted for. Stated that upcoming years budgets will also include this purchase for the next 4 years. Councilwoman Lime – Asked how much this is costing us now? Safety Director Coury – Stated that the department is transitioning away from the Safely platform and moving to an entirely new platform with this equipment. The equipment is much more widely used in the nation, in fact, only 2 cities still use Safely. It can’t be really compared, as they are apples and oranges, but it is an upgrade. Councilwoman Lime – Stated that she felt this should have had at least one reading and not been under Suspension of the Rules. Safety Director Coury – Stated it is under Suspension of the Rules because the department has the equipment already, much of it through a grant, and it cannot be used until the licenses are purchased, so it needs to be done as soon as possible so it can be utilized. Councilman Kussmaul – Mentioned that the exhibit shows a savings of $52,872.21, and asked if this is the savings with the new equipment vs. the old equipment? Councilwoman Shuman – Stated that it looks like the Exhibit is showing the $52,872.21 as a savings based on the discounts given in the contract, that is not being compared to the current equipment. Councilman Kussmaul – Stated that if that’s the case, it looks like from the contract that we are getting a savings of $264,361.06 in savings by bundling these products together. Asked the Safety Director if this is correct? Safety Director Coury – Yes. Captain Siedlecki was able to negotiate an additional discount and those are the savings mentioned in the Exhibit. Further stated that we are at the 8 end of useful life on the Safely equipment that we currently have, and that Axon is a national company that uses top technology and will be a valuable upgrade to our equipment. KUSSMAUL A RESOLUTION ENCOURAGING THE UNITED STATES FEDERAL GOVERNMENT TO RELOCATE THE HEADQUARTERS OF THE NATIONAL AERONAUTICS AND SPACE ADMINISTRATION TO BROOK PARK, OHIO, AND DECLARING AN EMERGENCY Councilwoman Wilson – Asked why we are voting on this to go to Brook Park and what interest does Parma have in this? Councilwoman Lime – Stated that Brook Park is our neighboring city and if Brook Park were to get the NASA Headquarters it would help our city’s economy. Councilwoman Wilson – Stated that she felt the Resolution should be worded more specifically and showing the benefit to Parma in a more obvious way. Councilwoman Lime – Stated that she feels it does not need to be more specific. Stated that if Brook Park gets the NASA Headquarters, people will be getting jobs there and looking to neighboring communities for homes, shopping, churches, schools for their children, and so forth. Councilman Kussmaul – Stated that to Councilwoman Lime’s point, the 6th whereas clause of the Resolution is very broad, but it touches on the idea that we would be prepared to work with all levels of government to assist with the relocation. Stated that he feels that this is a great win for Parma. Motion made by Councilwoman Lime, seconded by Councilwoman Shuman to adopt Resolution No. 125-25. No: None; Resolution No. 126-25 is adopted. ------------------------------------------------------------------------------------------------------------ APPOINTMENTS AND CONFIRMATIONS: Councilwoman Boyd – The Appointment Scanning Committee met this evening to discuss the reappointment of Doug Zubricky to serve on the Building Board of Appeals. Mr. Zubricky’s term will expire on June 18, 2025. His new appointment would be for a five (5) year term ending on June 18, 2030. 9 Councilwoman Boyd – Stated that she has had the pleasure and honor to work with Mr. Zubricky over the last five years on the Building Board of Appeals and feels he is the guidepost of the board and that he should be reappointed. Motion made by Councilwoman Boyd seconded by Councilman Kussmaul to grant the appointment as recommended by the Mayor and the Appointment Scanning Committee of Council. Reminded everyone that the Summer Solstice Social, sponsored by Wards 4, 6, and 9, will be held on Friday, June 20 from 5-8 at the Keystone Pavillion in West Creek Reservation. ------------------------------------------------------------------------------------------------------------ Councilwoman Lime – Wished everyone a Happy and safe July 4th, as the next council meeting is July 7th. Stated that Scene Magazine just came out with their Best of Cleveland issue and that there were lots of Parma businesses that were recognized. Stated she will get a list to the Communications and Community Relations Director so this can be promoted on social media.
