1 MINUTES DECEMBER 1, 2025 COUNCIL MEETING PARMA COUNCIL CHAMBERS 6:30 P.M. Asked if there were any additions or corrections to the minutes? Stated, hearing none, the minutes will stand approved as printed. ------------------------------------------------------------------------------------------------------------------- COMMUNICATIONS, PETITIONS AND CLAIMS ------------------------------------------------------------------------------------------------- Clerk of Council Kristin Saban read the following variances into the record: THE PARMA BOARD OF ZONING APPEALS met on Tuesday November 18, 2025, at 6:30pm and PROPOSED TO VARY, subject to provisions of amended Ordinance Section 1127.13 (confirmation or

2 rejection by Council within forty days of receipt of this notice) FOR THE APPLICANT William and Diane Schneider 7648 North Linden Lane, Parma, Ohio 44130. PPN:457-14-001 SECTION 1153.03(a)-SINGLE FAMILY HOUSE DISTRICTS-ACCESORY USES AND BUILDINGS. Not more that one garage, whether attached or detached, shall be permitted on any one lot. However, no such garage shall exceed a total floor area of 800 square feet. The proposal is to erect a second garage with covered porch, 1944 square feet in area on a one-acre lot. A variance would result in allowing a second garage that is 1144 SF larger than code allows on a single-family residential lot. SECTION 1185.05 (d) – HEIGHT DISTRICT EXCEPTIONS. In residence districts, an accessory building shall not exceed 15 feet in height at the highest point of the roof nor more than one story. The proposal is to construct a 1-1/2 story garage that is 20 feet tall in overall height. A variance would result in allowing a garage that is 5 feet taller with an additional ½ story in height on a single-family residential lot. After discussion, George Mastrobuono made a motion to recommend to Council to grant the variances with stipulations. By granting these variances the essential character of the neighborhood would not be substantially altered. After discussion, George Mastrobuono made a motion to recommend to Council to grant the variance with the following stipulations: 1. The detached garage be setback a minimum of 20’ from the north property line. 2. The height of the garage shall not exceed 18 feet from garage. 3. The size of the garage shall not exceed 1600 SF in area including the covered porch. 4. No additional structures are permitted for storage of any kind. 5. No type of business operations be conducted from the property. 6. Any additional concrete shall be setback a minimum of 5 feet from all property lines. John Yurkiw second the motion. George Ziefle, Allesan Armstrong, George Mastrobuono, Michelle Green and John Yurkiw voted yes. Motion made by Councilman Euerle seconded by Councilwoman Shuman to thereafter read the variance application by title only. Further moved to refer the Variance to the Planning Committee. Motion Carried. ------------------------------------------------------------------------------------------------------------ THE PARMA BOARD OF ZONING APPEALS met on Tuesday November 18, 2025, at 6:30pm and PROPOSED TO VARY, subject to provisions of amended Ordinance Section 1127.13 (confirmation or rejection by Council within forty days of receipt of this notice) FOR THE APPLICANT Michael and Grant Sposit 6091 State Road, Parma, Ohio 44134, PPN: 446-05-003 1170.02 USE REGULATIONS. Building and land shall be used, and buildings shall be designed, erected, altered, moved or maintained, in the Retail Business District only for the uses set forth in the schedules and regulations of this Zoning Code. (d) A lot occupied by a structure containing a dwelling unit shall not be occupied by any other main uses permitted herein or by an accessory use other than a use accessory to the dwelling. (e) Dwellings of all types shall be prohibited in the Retail Business District. The proposal is to change the use of the upstairs from office space to a residential apartment.

3 A variance would result in allowing a retail business zoned commercial building to be mixed use with retail/office use on the first floor and residential use on the second floor. After discussion, John Yurkiw made a motion to recommend to Council to grant the variance stipulated as read. By granting this variance the essential character of the neighborhood would not be substantially altered. The adjoining properties would not suffer a substantial detriment as a result of us granting the variance. The property in question would yield a reasonable return and the integrity of the property would be upheld. Allesan Armstrong second the motion. George Ziefle, Allesan Armstrong, George Mastrobuono, Michelle Green and John Yurkiw voted yes. Motion made by Councilman Euerle seconded by Councilwoman Shuman to thereafter read the variance application by title only. Further moved to refer the Variance to the Planning Committee. Signs for uses in Retail Business Districts, shall be permitted in accordance with the following regulations. (a) Permitted Types, Number, Area and Height. Signs by structural type are permitted only in accordance with the regulations regarding maximum number, area and height as presented in the following schedule. The proposal is to install 1 additional Wall (major) sign, 23.75 SF in area and a Free-Standing (major) Sign 6 ‘ in height. A variance would result in allowing one additional major wall sign, 23.75 SF larger in area and a free-standing sign that is 1 foot taller than code allows. After discussion, George Mastrobuono made a motion to recommend to Council to grant the variance as read as justice will be done by granting the variance and the property in question would yield a reasonable return as there can be beneficial use of the property with the variance. Michelle Green second the motion. George Ziefle, Allesan Armstrong, George Mastrobuono, Michelle Green and John Yurkiw voted yes. Motion made by Councilman Euerle seconded by Councilwoman Shuman to thereafter read the variance application by title only. Further moved to refer the Variance to the Planning Committee. LIME A RESOLUTION REQUESTING THE BUILDING COMMISSIONER TO INSTITUTE A SUMMARY NUISANCE ABATEMENT OF PERMANENT PARCEL NUMBER 443-05-040, 7753 DRESDEN AVENUE, PARMA, OHIO, AND DECLARING AN EMERGENCY Councilwoman Lime – Addressed Council and asked for their support for this Resolution. She went on to explain that over the last 5 years this house was in Housing Court at least twice. There have been numerous violations since last April, and the last time the owner was in court, he asked for a trial and did not show up on the trial date. As a result of not showing up, there was a warrant for his arrest, he was arrested and posted bond. She went on to explain that this property has only a 60 foot lot with no room for any more junk to be put there. There has been a temporary fence and large screen put up without a permit. Neighbors are fed up with looking at all the various unused things scattered around the yard. Councilwoman Lime stated that she hopes finally things can get done, and would appreciate Council’s support. Motion made by Councilwoman Lime seconded by Councilwoman Shuman to adopt Resolution No. 226-25. Yes: Euerle, Kussmaul, Lime, Shuman, Soeder, Wilson, Zacharias, Boyd. No: None; Resolution No. 226-25 is adopted. ------------------------------------------------------------------------------------------------------------------- RESOLUTION NO. 228-25 12 /1/25 BY: D. LIME A RESOLUTION REQUESTING THE BUILDING COMMISSIONER TO INSTITUTE A SUMMARY NUISANCE ABATEMENT OF PERMANENT PARCEL NUMBER 449-05-058, 7611 SPRING GARDEN ROAD, PARMA, OHIO, AND DECLARING AN EMERGENCY Councilwoman Lime – addressed Council by stating that this house has been in Housing Court many times with various issues like a falling in porch and awnings. There was an addition put on to the garage with no permits that looks unsightly. She went on to explain that there was a fire in the basement. With the house being underinsured, there was very little renovation done. This house remains vacant, however it is unsecured and people have been seen going in and out of the house, as well as the garage. There remains a warrant for the home owner. Councilman Euerle – Asked how the inspector was able to get inside the home to take picture? Councilwoman Lime – Inspection was done after the fire for insurance purposes. Councilman Euerle – Stated that the photo stamp was dated 11-14-25 well past the date of the fire, which shows that someone was able to get into the home not long ago. Safety Director Coury – Explained that permission is sometimes asked of the homeowner when there are certain circumstances, and things need to be addressed quickly. Because of zero cooperation from the homeowner, remediation has to take place because conditions are not favorable for surrounding neighbors.

9 Councilman Kussmaul – Thanked the Safety Director for his support of the 2 Nuisance Resolutions. He asked if the money allotted in the budget earlier in the year will be used for the remediation going in, and making these properties whole. Safety Director Coury – Answered yes, and that expenses would also be placed on Property Taxes, as well as when there is any sale, the City would get their money back. Motion made by Councilwoman Lime seconded by Councilwoman Shuman to adopt Resolution No. 228-25. Yes: Euerle, Kussmaul, Lime, Shuman, Soeder, Wilson, Zacharias, Boyd. SHUMAN, A. BOYD (By Request – Service Director) AN ORDINANCE AUTHORIZING THE MAYOR AND/OR DIRECTOR OF PUBLIC SERVICE TO ENTER INTO AN AGREEMENT WITH THE NORTHEAST OHIO REGIONAL SEWER DISTRICT (NEORSD) THROUGH THE COMMUNITY COST- SHARE (CCS) PROGRAM FOR THE PURCHASE OF A NEW CAS CABLE FOR THE CITY’S SEWER CCTV OPERATION, IN THE CITY OF PARMA, AND DECLARING AN EMERGENCY Motion made by Councilwoman Lime seconded by Councilwoman Shuman to adopt Ordinance No. 230-25. Yes: Euerle, Kussmaul, Lime, Shuman, Soeder, Wilson, Zacharias, Boyd. No: None; Ordinance No. 230-25 is adopted. ------------------------------------------------------------------------------------------------------------------- PUBLIC SESSION No one wished to speak -------------------------------------------------------------------------------------------------------------------- MISCELLANEOUS BUSINESS Mayor DeGeeter – Addressed Acme closing it’s doors. He explained that everyone is shocked and reached out to the store manager who was also very shocked, and did confirm that Acme would be closing it’s doors. The Mayor explained that the Visconsi Group was just as surprised and believes that it was a business decision by Acme. He stated that Acme will continue to pay rent until the lease ends. The Mayor also stated that he is looking forward to Sunday’s parade, and Frosty Fest, and stated that it will be a great day for Parma. He thanked We are Parma Proud for all their work. ------------------------------------------------------------------------------------------------------------------- Safety Director Coury – Reported about the Police Chief and Deputy Police Chief selections, and with Captain Siedlecki becoming Deputy Chief, there will be a Captain’s vacancy, and said interviews will be conducted. Mr. Coury went on to be grateful for the co-operation of the Administration, Unions and Civil Service, with the Chief retiring in January, we can now hit the ground running, because all positions should be filled. ----------------------------------------------------------------------------------------------------------------- Service Director Vannello – No comment. ------------------------------------------------------------------------------------------------------------------- Auditor Day – No comment. ------------------------------------------------------------------------------------------------------------------- Law Director Tuma – Wished to express gratitude for all the well wishes and support for he and his family during the difficult time of the loss of his mother. -------------------------------------------------------------------------------------------------------------------

10 Treasurer Mastroianni – No comment. ------------------------------------------------------------------------------------------------------------------- Councilman Euerle – Stated that he was sorry he missed the last Council Meeting, but explained that his 4th child was born, and that both mom and baby are healthy. He thanked everyone that reached out with well wishes. Is looking forward to the parade and Frosty Fest. ------------------------------------------------------------------------------------------------------------------- Councilman Kussmaul – Congratulated Councilman Euerle on the birth of his son. He thanked the Mayor for the update on Acme. He explained that he took part in a ride along with police officers and was very impressed at the very professional way the officers handle all situations, and the way they interact with residents, even though many times it is not a great situation. Stated that he is also looking forward to Frosty Fest. ------------------------------------------------------------------------------------------------------------------- Councilwoman Lime – Stated that the news was reporting that other Acme stores will have reduced hours. She went on to wish all the employees of the Parma Acme store well.
