REGULAR MEETING MINUTES Village of Put-in-Bay Council Tuesday, December 3rd, 2024 9:00 AM Village Town Hall Mayor Berry called the meeting to order at 9:00am Roll: Stephens; present, Koehler; present, Market; present, Sulesky; absent, Biery; present, Cerny; absent, joined via zoom. ______________________________________________ Agenda Additions: Ordinance 1473-24: Retaining Nathan Manning and Manning Law, LLC as legal counsel for the Village of Put-in-Bay and declaring an emergency. *It was stated that this legal counsel is for Village of Put in Bay Mayors Court. This will serve as the first reading. ORDINANCES: ORD: 1470-24 SECOND ORDINANCE AMENDING TITLE TWO, BUSINESS REGULATIONS, CHAPTER 858, RENTAL VEHICLES, SECTION 858.01 LICENSE FEES; DEPOSIT INTO PUBLIC SERVICE STREET REPAIR FUND, AND DECLARING AN EMERGENCY BIERY MOVED THE SECOND READING OF THE ORDINANCE. Biery moved to approve up to $235,000.00 to be expended out of Fund 2011 Street Construction and Maintenance and the remaining amount up to $91,000.00 out of 5202 Sewer Capital Imp. Market moved to approve the November 2024 Billing credits/discrepancies as presented by the Village Administrator. Second by Stephens. Roll: Stephens; yes, Koehler; yes, Market; yes, Biery; yes. COUNCIL BUSINESS: Market would like to request an executive session to consider the appointment, employment, dismissal, discipline, promotion, demotion, or compensation of a public employee or official; and for the discussion of pending and imminent litigation. DEPARTMENTS: Chief of Police: Chief Kimble spoke with grant writer; she stated that hurricane victims are receiving the first disbursements of grant monies. COPS grant is still in the works. Chief also stated that Paragon is no longer preforming background checks; the Village will have to find someone else to preform them. Legal will research who does background checks for other municipalities. Administrator: See Report. Fiscal Officer: Provided council with a Healthcare coverage update; Medical Mutual was the most competitive. Will schedule a meeting with the employees to go over details of possible new plan. Mayor: It was brought to her attention that Veterans Day was not included on the list of Holidays the Village employees can observe. The Council did not entertain adding it to the list. One island One government restructuring committee has reached out inquiring about the Village councils

Position on the matter. All agreed that the council remains neutral and it is not up to them, as it is up to the voters. Need to start thinking about putting money aside in the building capital improvement fund for future Purchases and maintenance. PUBLIC PARTICIPATION: David and Debbie Bianchi; Rt 357. Mr. Bianchi has been a lifelong resident of PIB and has over 57 years of public service experience with the EMS and fire department. Brought to councils’ attention the most recent interaction that was had between them and Officer McMicheaux. He gave a detailed explanation of a traffic stop that happened. He was cited for left of center near Topsy’s due to cars parked on the side of the road forcing him to go around them to avoid collision. During the traffic stop Mr. Bianchi stated that he did not have his ID on him, but he would be able to go home and get it if officer McMicheaux would like to follow him. She stated it would not be necessary, and just ran the registration. In the meantime, Mrs. Bianchi phoned and stated that she would bring him his wallet. Mr. Bianchi told Officer McMicheaux that his wife would be coming to bring the wallet with ID. As Mrs. Bianchi approached the vehicle to hand wallet off, the officer told her to stop walking. Mrs. Bianchi is Hard of hearing and did not respond. This interaction happened a second time, leading the officer to put her Hand on her firearm which intern caused extreme panic for Bianchi’s. Mr. Bianchi pleaded with the officer to excuse the citation and just issue a warning. After Mr. Bianchi finished speaking, Lieutenant Seitz said he would sit down with them to talk about the interaction. Legal: Working on a roadmap/template for the enforcement of non-compliance of business licenses and vehicle Tax. HB 296; the increase of Ohio Police and Fire contributions is up for vote. The increase could be from 19.5% to 24.5% over 6 years. Village would need to budget accordingly. Request for Proposal for consideration/ approval for dock proposal is in the works. Meeting will take place December 3rd, 2024 to discuss. All information will be circulated to council. Executive Session: Stephens moved for council to enter executive session to consider the appointment, employment, dismissal, discipline, promotion, demotion, or compensation of a public employee or official; and for the discussion of pending and imminent litigation. Market reminded everyone of the committee meeting scheduled for 1:00 pm Tuesday, December 3rd. to discuss the traffic study conclusion and paid parking. Koehler mover to adjourn, Biery second.
